This labor agreement is made on the of February 2017 in Islamabad by

& between the parties as follows:

China Railway First Group Co Ltd. (Pakistan), having office at House No. 32
Embassy Road, G-6/4 Islamabad, ( CRFG also means Party 1 )

The expression of CRFG (Party 1) & Mr (Party 2) shall where the text
admits, means and includes their respective successors in interest and permitted
assignee and hereinafter referred to individually as a Party and collectively as
Parties.

WHEREAS the Party 1 desires that the under mentioned items of work activities
in connection with the XXXXX NAME OF THE PROJECT
XXXXX should be executed by Party 2 as per agreed rates
given against each items of Work as shown table 2.1 below.

NOW THEREFORE, in consideration of the matters set forth above (which are
incorporated herein), the parties hereto agree as follows:
1. SERVICES & SCOPE OF WORKS:
A. Party 2 is being engaged for the period of Five(05 months by Party
1.Party 2 shall provide the services for the laying of the base course,
surface course pavement, including Asphaltic Base Course & Asphaltic
Wearing Course along with the Emulsified Bituminous Prime and Tack
coat and other allied activities, for the above mentioned project.
A. Quantities as mentioned in table 2.1 are estimated and may vary at
the time of execution. Any variation in quantities shall not change the
agreed rate under this agreement.
B. Party 1 shall assist Party 2 in coordination, land requisition & locals
issues. Party 2 shall submit weekly progress report to Party 1 including
all impediments at project area.
C. Party 2 personnel shall work under the supervision of nominated
Engineers of Party 1
D. The following terms and conditions will apply for the hiring of
machinery/equipment
E. The machinery rent will be at the following rate for 208 hours duty
time (starting from 8:00AM to 04:00PM) only in per month (26 working
days) at the above said work site.

F. Over time will be paid at the above rate for working beyond 8 hours
per day (Starting from 08:00AM to 04:00PM) duty time, it is without
adjustment of idles hours.
G. Mess and accommodation for operators and proper security of
Machinery will be the responsibility of Party No.2
H. Party No. 2 shall have to deal with personal injury insurance to all its
construction personnel
2. ITEMS & RATES
Party 2 shall Supply of the materials for the said items of works which the
cost is inclusive in item rate. The payment shall be made on Unit rate basis
as listed in table 2.1.The rate of each item of work includes all the cost
subject to satisfactory execution of work of Party 1 as per specifications
attached herewith this agreement (Annex-1).

3. WORK AS PER SPECIFICATIONS & DRAWINGS

Party 2 undertakes the responsibility for the execution of works & remedying
the defects thereof if any, as per Specification and drawings supplied by
Party 1.
4. COMPLETION TIME
Contractual completion time for construction work activities as mentioned in
table 2.1 is 6 months(TENTATIVE) from the date of sighing of this agreement.
Party 2 shall submit for its approval monthly work programme, Seven (07)
days in advance in case party 2 fails to achieve this programmed target ,The
Party 1 shall have right to terminate the services of Party 2 partially and/or
wholly.

5. CHECK REQUESTS (materials & works)

Party 2 shall submit Check Request to the nominated Engineer of Party
1.Party 2 shall be responsible for obtaining the approval of the executed
works from the Engineers Representative on the check requests for
approval of material and machinery/equipment and for the construction
activities to be executed one day in advance. Party 2 shall bring all the
materials on construction site

6. SURVEYING

Party 2 shall deploy a survey team along with required survey equipment for
survey works as instructed & approved by Project Manager of Party 1.

7. QUALITY TESTS

Party 2 shall obtain quality tests free of costs to be conducted at laboratory

facilities including laboratory staff provided by Party 1

8. METHODOLOGY
 Party 2 shall execute the works as per approved Work Methodology (method
statement) as issued by Project Manager of party 1.
9. CONTIGENCY
In case of any contingency, Party 1 may provide materials or other services
and costs thereof shall be deducted of payable bills of Party 2

10. MEASUREMENTS OF EXECUTED QUANTITIES

The Quantity of the above mentioned works(table 2.1) shall be measured &
paid on the basis of approved Check Requests i.e. basis of measurement
will be approved check request of the related items of work.

11. EQUIPMENT PLANT & MACHINERY

Party 2 shall arrange the numbers & type of equipment, plant & machinery
required for different items of work keeping in view the workmanship of the
particular items of work, and/or whatsoever resources be required for the
execution of said works. In case of slow progress as per approved work
programme, Party 2 shall deploy additional required resources at its own
costs as instructed by Party 1 for acceleration. Party 2 shall not remove any
major equipment without the instructions of Project Manager of Party 1.

12. PAYMENT SCHEDULE

Party 1 and Party 2 agrees on the following Payment Schedule:

A. Party 1 shall pay the submitted & certified bills of Party 2 (after due
deduction of income tax) within 14 working days after receipt of
respective payment from the project.
B. The rate of Work Item payable to Party 2 shall be adjusted for rises
or falls in the cost of high speed diesel through, as per adjustment
Table attached herewith this agreement (Annex-2).Adjustment is
prices do not take effect on short term contract of 6 months. this
clause shall apply with subject to extension of this agreement
C. Party 1 will retain 05 (five) percent amount from the payments
payable to Party 2 as retention money. This retained money shall be
released to Party 2 on completion & joint measurement certificate
of listed items in table 2.1 above. All Payments shall be made
through crossed cheques to payees Account only.

13. JOINT MEASUREMENT OF WORKS

The parties under this agreement shall jointly carry out joint measurements
 at the completion of the works as listed in table 2.1 above. This joint
measurement between the parties shall be final and Party 2 shall not be
liable for any subsequent measurement by party 1 or any other Authority.
Experience certificate shall be issued to Party 2 after the joint measurement.

14. The nominated representatives of Party 1 & Party 2 will resolve all disputes(if
arise) amicably.

15. BANK GUARANTEE:

Within 28 days after signing this contract, subcontractor shall provide 34
million rupees (34000000 rupees the whole) issued by bank

IN WITNESS WHEREOF the Parties hereto have caused this agreement to be

executed in accordance with the laws of Islamic Republic of Pakistan under their
respective seals and by the hand of their proper authorized person, on the day,
month, and year indicated above.
