This Court issued a temporary restraining order on April 19, 2017. (Dkts. 30, 34.)
Defendant George Ian Boxill has moved to modify the temporary restraining order and
for expedited discovery, (Dkt. 37), and Plaintiffs have moved for a preliminary
injunction, (Dkt. 45). The Court held a hearing on May 1, 2017, and took these motions
under advisement. By this Order, the Court extends the temporary restraining order as
modified below pending the disposition of the motion for a preliminary injunction.
ORDER
Based on the foregoing and all the files, records and proceedings herein, IT IS
HEREBY ORDERED:
1. The Courts April 19, 2017 temporary restraining order, (Dkts. 30, 34), is
2. Defendant George Ian Boxill, and others acting in concert with him, shall
not publish or otherwise disseminate any unreleased recordings that comprise the work of
Prince Rogers Nelson that are alleged to be within the scope of the Confidentiality
3. Defendant George Ian Boxill shall deliver all of the recordings acquired
through his work with Paisley Park Enterprises, including original recordings, analog and
digital copies, and any derivative works, to Plaintiffs counsel for use in this litigation
only. Counsel for Defendants may retain a forensic copy of the disputed recordings for
4. This temporary restraining order will expire at 11:59 p.m. on May 22, 2017,
5. Plaintiffs Paisley Park Enterprises, Inc., and Comerica Bank & Trust, N.A.,
as Personal Representative of the Estate of Prince Rogers Nelson, shall post a bond in the
amount of $1,000,000 no later than 5:00 p.m., Central Daylight Time, on May 12, 2017.
If such bond is not posted, the temporary restraining order shall be dissolved.
