ARTICLE 2 SECTION 26

The State shall guarantee equal access to opportunities for public service and prohibit
political dynasties as may be defined by law.

LIMITATION OF TERMS OF OFFICE

The provisions limiting the terms of office of elective officials enhance equal access
to political opporunities.

PROHIBITION OF POLITICAL DYNASTIES

The constitutional policy on the prohibition of political dynasties expresses a national


commitment to democratize election and appointment to positions in the
government.

PROHIBITION CONSTITUTIONALLY MANDATED

The law implementing the constitutional policy shall define what constitutes political
dynasties and having in mind the evils sought to be eradicated and the need to
ensure the wildest possible base for the selection of elective government officials.

ARTICLE 3 SECTION 3

1) The privacy of communication and correspondence shall be inviolable except upon


lawful order of the court, or when public safety or order requires otherwise as
prescribed by law

2) Any evidence obtain in violation of this or the preceding section shall be


inadmissible for any purpose in any proceeding.

RIGHT OF PRIVACY

Right to be left alone; right of a person to be free from undesired publicity or


disclosure.

BASIS AND PURPOSE OF THE PROVISION

The right to privacy is considered as belonging to that class of rights which every
human being possesses in his natural state and which he does not lose or surrender
by becoming a member of organized society.

By the above constitutional provision, there is an express recognition that persons


may communicate and correspond with each other without the State having a right
to pry into such communication and correspondence subject to the ever pervading
police power of the State.

EVIDENCE ILLEGALLY OBTAINED

Inadmissible any evidence obtained in violation of the right against unreasonable


search and seizure and the right to privacy of communication.
Reason the reason for the inadmissibility of evidence competent as such, which has
been unlawfully acquired, is that its exclusionis the only practical way of enforcing
the constitutional guarantees.

Right of Owner since evidence obtained illegally is not admissible, the owner has a
right that the articles seized be returned, unless they are in themselves prohibited or
forbidden by law such as illegal drugs, unlicenced firearms etc.
