TheTamilNaduLandReforms(FixationofCeilingonLand)Act,1961(TamilNaduAct58/61) was

enacted with a view to reduce the disparity in the ownership of the agricultural land and concentration of such
landwithcertainpersonsandtodistributesuchlandamongthelandlesspoor.

TheTamilNaduLandReforms(FixationofCeilingonLand)Act,1961cameintoeffectonthe6thdayof

April,1960,whereintheceilingareaforafamilyconsistingoffivemembershadbeenfixedas30standardacres.
For every additional member of the family consisting of more than five members, an additional extent of 5

standardacreswasallowedinadditiontotheceilingareaof30standardacres,subjecttotheoverallceilingof60

standardacres.AsonthedateofthecommencementoftheAct(i.e.)6.4.60,anyfemalememberofthefamily
havinglandsinherownname,willbeentitledtoholdstridhanapropertyuptoaceilingof10standardacres.The

notifieddateofthesaidActwas02.10.1962.Thereferencedateforholdingoflandwasason06.04.1960.

Withaviewtoincreasethenumberofbeneficiariesbyacquisitionoftheagriculturallandsheldbythebig
landownersinexcessoftheceilingareaandforthedistributionofsuchlandstothelandlessandotherruralpoor,

reductionofceilingonlandwasintroducedintheyear1970,byamendingtheParentAct,bytheAct17/70tothe
effectthattheceilingareafixedearlierat30standardacreshasbeenreducedto15standardacres.Thenotified

dateoftheActwas02.10.1970.Thereferencedateforholdingoflandwasason15.02.1970.

ItmaybeseenfromtheParentAct,thatexemptionsweregrantedunderthePrincipalActforthelands
grownwithsugarcaneandthelandsusedexclusivelyforgrazingpurposes.Withaviewtoachievetheobjectof

distributionofceilingsurpluslandstothelandlessandruralpoor,theexemptiongrantedunderthePrincipalAct

(Tamil Nadu Act 58/61) for lands grown with sugarcane and grazing lands were ordered to be withdrawn by
amendedAct,41/71witheffectfrom15.01.1972.

Theoverallceilingareaof60standardacres,asfixedundertheParentAct,58/61hasbeenrefixedat40

standardacresthroughanamendedActcalledtheTamilNaduLandReforms(FixationofCeilingonLand)
SecondAmendmentAct,1971(TamilNaduAct20/72).ThisActalsocameintoeffectfrom01.03.1972.

Subsequently,byanotheramendedAct,viz.,TamilNaduLandReforms(FixationofCeilingonLand)

Fourth Amendment Act, 1972 (Tamil Nadu Act 39/72), the overall ceiling limit was further reduced from 40

standardacresto30standardacres.ThisActalsocameintoeffectonthe1stdayofMarch1972.Eventhough
theTrustswerenotattractedbytheprovisionsoftheParentAct,58/61,ceilinglimithasbeenfixedfortheTrusts

throughTamilNaduLandReforms(FixationofCeilingonLand)ThirdAmendmentAct,1971(TamilNadu

Act37/72)accordingtothecharacteroftheTrusts.Tosumup,asondate,30standardacresoflandisthe

maximumextentoflandthatafamilycanholdintheState.

plantations.

Section73(vii)landsconvertedonorbeforethe1stdayofJuly1959intoorchardsortopesorarecanut

gardens,whetherornotsuchlandsarecontiguousorscattered.
