Robert E, Antonacsi Il (the “Claimant’) resides at S015 Brittany Lane, Syracuse, NY 13215, County of Onondaga and isthe Comptroller of Onondaga County. 2. Nature of claim ar against Onondaga County based upon the alleged actions of its ‘County Executive Joanne M. Mahoney (Mahoney), acting as its County Executive, the alleged actions of Duane Owens at all times relevant either the Commissioner of Faclties or Personnel, and the alleged actions of Dennis Duval, a board member of the ‘Onondaga County Board of Ethics, for negligence and/or negligent misrepresentation while reserving any other claims which may present themselves based upon further information, 3. On of about October 7, 2016 Dino Dixie (Diie) and two other county vendors filed a Federal lawsuit against Onondaga County and the undersigned in his capacity 35 Onondaga County Comptroller Page tof 3(On December 16, 2016 Mahoney was allegedly having dinner and/or drinks at the ‘eoteh and Sirloin Restaurant in Dewitt, NY with Disle, a county vendor and plaintf in ‘the Federal action, Upon information and belief also allegedly in attendance at the Scotch and Sirloin Restaurant meetingand allegedly sitting in the booth wih Mahoney was Duane Owens, the current commissioner of Personnel for Onondaga County and at the commencement of Plant Dixie's lawsuit the Commissioner of Falities for Onondaga County. In his oftial capacity Owens would have been responsible for awarding and ‘monitoring contracs the County of Onondaga had with Plaintiff Dixie and his company First Point LL. Upon information and belief Dennis Duval was allege atthe above referenced dinner meeting and Mr. Duval is allegedly a business partner with Plaintiff Dive, serves on the ‘Onondaga County Board of Ethics and i allegedly business partners with Marc Overdyk, the husband of Mahoney. Upon information and belie in the presence of said plaintif Dive, said county officers were carting with sald plaintiff without benefit of legal counselor notification to the claimant of sald meeting during the pendency of the federal action commenced by Dial, potentially hindering the defense of the federal ation or causing damage to the dlaimant and/or taxpayers of Onondaga County ‘Damages are unkrown at this tine but the actions of Mahoney, Owens and Duval a meeting with a plaintiff suing Onondaga County and clsimant without legal counsel and acting on behalf of Onondaga County may be detrimental to the defense of the Dive Page 2of3action causing damages in unknown amount to caimant and taxpayers of Onondaga County.
