ORDINANCE NO.

5-2011

INSTITUTIONALIZING THE CONDUCT OF LA TRINIDAD STRAWBERRY FESTIVAL EVERY MONTH OF


MARCH IN THE MUNICIPALITY OF LA TRINIDAD, BENGUET.

Be it ordained by the Sanguniang Bayan of La Trinidad, Benguet Province, in session assembled


that:

Section 1. Short Title. This ordinance shall be known as the La Trinidad Strawberry Festival.

Section 2. The conduct of La Trinidad Strawberry Festival during the whole month of March of every
year is hereby institutionalized.

Section 3. Objectives. The celebration of the Strawberry Festival shall be focused to the following
objectives.

a. To encourage activities and programs which promotes tourism and preserve the
Municipalitys attraction as the Strawberry Capital of the Philippines by instilling a sense of
ownership and culture of tourism among the youth and populace;
b. To commemorate and celebrate the Guinness Book of World Record Award of the
Municipality for baking the largest strawberry shortcake.
c. Develop responsible tourism as a strategy for environmentally sound and community
participatory tourism programs, enlisting the participation of local communities, including
indigenous people, in conserving cultural diversity and identity of the Municipality.
d. Ensure the right of the people to a balanced and healthful ecology through the promotion of
activities geared towards environmental protection, conservation and restoration;
e. Promote and ensure the technical handling capability of the Municipality as an event and eco-
tourism destination.

Section 4. Activities. The La Trinidad Strawberry Festival will be highlighted with the following activities;

a. Any activity that features the Guinness Book of World Record Award of the Municipality for baking
the largest strawberry shortcake
b. Civic, cultural, drum and lyre and floral parade
c. Multi-cultural celebration
d. Commercial, Agro-Industrial and One Town One Product (OTOP) Trade Fair
e. Search for Mister and Miss La Trinidad
f. Literary Musical Competition
g. Balikbayan Day
h. Jobs Fair
i. Strawberry fun run
j. Gymkhana in La Trinidad
k. Other events as maybe authorized by the executive committee to be part of the festival.

Section 5. a. Executive Committee. An Executive Committee is hereby created to manage the annual La
Trinidad Strawberry Festival with the following composition:

Chairman: Municipal Mayor


Co-chairman: Municipal Vice Mayor
Co-chairman: SB Chairman, Committee on Tourism Special Events
Members: All Sanguniang Bayan Members
Chairman, Municipal Tourism Council
Municipal Tourism Officer
b. The specific functions of the Executive Committee are limited to the following:
i. Evaluate and decide on projects, programs and activities and its corresponding budget proposals
as recommended by the committees.
ii. For purposes of raising funds and upon recommendation of the Finance Committee, approve
the use of any appropriate municipal properties for festival activities or events.
iii. Formulate policies and mechanics for the conduct of the festival.
iv. Evaluate the conduct of the festival and approve the final report not later than three weeks
after the conduct thereof.
v. Appoint membership in all the working committees created under Section 6 hereof;
vi. Create other working committee(s), as the need arise to address other concerns.
vii. That in any eventuality, may decide to award the management and implementation of the La
Trinidad Strawberry Festival or any of the activities enumerated under Section 4 hereof, to any private
event organizer, and or tourism, culture and arts related organizations of good standing.

c. Meetings. The executive committee shall meet within the month of April immediately after the
celebration of strawberry festival and as often as necessary to re-formulate policies and to review the
assignment of the working committees including its reorganization, for purposes of preparing for the next
strawberry festival.

Section 6. a. Creation of Working Committees for the La Trinidad Strawberry Festival. To address the
various concerns in the implementation if the strawberry festival working committees are necessary in
order that activities are properly screened and assisted, endeavors are monitored according to plan,
income from tourism are maximized and transparency achieved.
b. Composition of the different working committees may include memberships from Non-
Government Organizations (NGO), Peoples Organization (PO), private sector and all other stakeholders.
c. The working committees are as follows with its corresponding functions;

1. The Festival Directorate. The main function of this Committee is to supervise and ensure the
proper implementation of all programs, projects and activities including all policies, decisions
or orders issued, approved or adopted by the Executive Committee. Specially, it shall:
i) Ensure coordinated movement of all working committees
ii) Advise the Secretariat in ensuring that all administrative concerns are met.
iii) Recommend strategies in all levels of planning and implementation of the festival.
iv) Provide official information and publish official press release related to the strawberry
festival.
v) Receive and decide in its level, minor concerns or issues that may arise during the celebration
of the festival.

2. Marketing and promotions committee


i) Recommend guidelines, policies and strategies in the marketing and promotions of the
strawberry festival and implement the same upon approval of the executive committee.

3. Events and Program committee


i. Review and recommend project proposals relative to the conduct of the strawberry festival
events in accordance with the general schedule approved by the executive committee.
ii. Recommend a scheduling of events and venues for the approval of the executive committee.
iii. Plan out mechanics and standards for specific strawberry events and submits the same for
approval to the executive committee.
iv. Recommend prospective sponsors and strategies for the promotion of festival events and
forward the same for screening by the marketing and promotions committee.
v. Screen and recommend prospective event organizers for the approval of the executive
committee.

4. Finance Committee
i. Recommend accounting and auditing procedures and implement the same upon the
approval of the executive committee, relative to the conduct of the festival.
ii. Appraise assistance whether in cash or in kind based on approved accounting and auditing
guidelines.
iii. Collect and disburse cash based on approved accounting and auditing guidelines as
approved by executive committee.
iv. Prepare update financial report and submit the same to the executive committee anytime.
v. Recommend ways and means to raise funds for the annual strawberry festival.

Section 7. a. The La Trinidad strawberry Festival secretariat. The Secretariat is hereby created headed
by the Municipal Tourism Officer or any designate. The members of the Secretariat shall be appointed by
the Executive.

b. Functions of the Secretariat.


i. Custodian of all records and documents relative to strawberry festival.
ii. Supply records and information as requested by various committees.
iii.Take down notes during meetings conducted by the committees ensure that concerned
committees are supplied with the minutes of the same.
iv. Do other tasks assigned by the Chair of the Executive Committee
v. Prepare general schedule of events as a guide for pre-festival preparations.
Section 8. Funding

All advertisement, booth rentals and all other fees and donations collected from the staging of
the strawberry festival shall be deposited in a trust fund. This fund shall be considered and
exclusively used as a revolving fund for the Annual Strawberry festival. All the other uncollected
income derived from previous staging of Strawberry festival shall be included hereto.

Further, for the purposes of raising funds, any appropriate municipal owned properties may be
temporarily allowed to be used during the La Trinidad Strawberry Festival.

Section 9. Supplementary effects of other laws, rules and decrees. The provision of this ordinance shall
be without prejudice to the application of other laws and ordinances of the Municipality which are
inconsistent with the provisions of this ordinance.

Section 10. Separability Clause. If any provision of this ordinance will be declared by the courts to be
unconstitutional or invalid, such decision shall not affect the validity of the ordinance as a whole or any
part thereof other than the part so declared to be unconstitutional or invalid.

Section 11. Repealing clause. All ordinances, rules or regulations which are in conflict with the provisions
of this ordinance are hereby repealed.

Section 12. Effectivity. This ordinance shall take effect upon approval in accordance with the provisions
of the Local government Code of 1991.
ORDINANCE NO. 7-B-2013

CREATING THE POSITION OF MUNICIPAL TOURISM OFFICER I WITH SALARY GRADE 11 IN THE
MUNICIPALITY OF LA TRINIDAD, BENGUET AND APPROPRIATING FUNDS THEREFOR, AMENDING
ORDINANCE NO. 03 -01 FOR THIS PURPOSE.

WHEREAS, the state declares tourism as an indispensable element of the national economy and
an industry of national interest and importance, which must be harnessed as an engine of socio-economic
growth and cultural affirmation to generate investment, foreign exchange and employment, and to
continue to mold and enhance sense of national pride for all Filipinos;

WHEREAS, La Trinidad, Benguet as the Strawberry and Rose Garden Capital of the Philippines,
is a tourism destination outside of the city of Baguio;

WHEREAS, Ordinance No. 12-2102 entitled establishing a tourist information and assistance
center in the Municipality of the La Trinidad states that the center shall be managed by a Tourism officer
who shall perform matters relative in promoting La Trinidad as a tourism destination by properly
disseminating relevant informations pertaining to tourist locations, products; and assisting tourist and
tourism enterprises in the delivery of competitive services.

WHEREAS, section 126 of the Implementing rules and regulations of RA 9593 states that Local
Government Units shall allocate appropriate funds for the construction and maintenance of the tourist
information and assistance center, including the provision of personnel to manage the center.

Now therefore on motion of councilor Roderick C. Awingan, be it ordained by the Sanguniang


Bayan assembled that:

Section 1. Title. The title of the ordinance shall be creating the Municipal Tourism Officer I with
Salary Grade 11 in the Municipality of the La Trinidad, Benguet and Providing Funds. Therefore, amending
Ordinance No. 03-01 for this purpose.

Section 2. Declaration. There shall be created a Municipal Tourism officer I, SG 11 which shall
operate under the supervision of the Office of the Municipal Mayor and whose primary responsibility is
the setting of direction, development, coordination and implementation of municipal tourism programs.

Section 3. Qualifications of the Municipal Tourism Officer. The Municipal Tourism Officer
provided under Section 125 of the IRR of RA 9593 shall be appointed by the Municipal Mayor based on
the following minimum qualifications.

a.) Must be a Filipino citizen permanently residing in the LGU where the position is available.
b.) Must obtain relevant bachelors degree in tourism, business law, economics, marketing,
public administration or any other related fields.
c.) At least five (5) years of substantial work experience and involvement in the tourism industry
either in the private sector or government ; and
d.) Must undergo and pass the training programs undertaken by the Department.

Section 4. Functions of the Municipal Tourism Officer. Municipal Tourism Officer shall perform
the following duties and functions;

a.) Prepare, implement, coordinate, monitor and update local tourism development plans;
b.) Ensure the proper enforcement tourism standards of tourism standards, laws, rules and
regulations;
c.) Submit regular reports on status of tourism plans and programs, tourist arrivals, employment,
occupancy rates, investment and tourist products, among others, to the Department of
Tourism;
d.) Coordinate with the Department of Tourism and its attached agencies and corporations in
regard to the development and promotion of tourism in their locality.
e.) Assist tourism enterprises in the accreditation process offered by the Department.
f.) Assist tourist and tourism enterprises in the delivery of services.
g.) Maintain a logbook where all tourist shall register and possibly seek assistance for
whereabouts of tourism sites and destinations in the Municipality of La Trinidad, Benguet.
h.) Maintain a core group of accredited tour guides who shall be responsible in assisting and
guiding tourist and visitors to any of the Municipalitys identified tourism site and
destinations.
i.) He/ She shall manage the tourist Assistance and Information center.
j.) Performs other duties and responsibilities as maybe assigned by the Municipal Mayor as it
may relate to tourism.
k.) To act as a member of the Municipal Tourism Council.

Section 5. Funding. The funding requirements for the creation of the position of the Municipal
Tourism Officer shall be incorporated in the annual appropriation of the Municipality of La Trinidad subject
to budgeting and accounting rules and regulations.

Section 6. Separability Clause. - If for any reason or reasons, any part or provision or this
Ordinance shall be held to be unconstitutional or invalid, other parts or provisions thereof which are not
affected shall continue to be in full force and effect.

Section 7. Supplementary Clause. - This Ordinance shall be an addendum to Ordinance 03-01 or


An ordinance Adopting and establishing the organizational structure and staffing pattern in the Municipal
Government of La Trinidad, Benguet.

Section 8. Effectivity. - This Ordinance shall take effect in accordance with the provisions of the
Local Government Code of 1991.
