19 BE IT REMEMBERED that upon the hearing

20 of this cause, on June 20, 2017, before the

21 Honorable Leslie E. Ghiz, a judge of the said

22 court, the following proceedings were had:

1 THE COURT: We are back in the

2 record in chambers. I am sealing this,

3 these proceedings, under the Rules of

4 Superintendence 45.

5 I have present counsel for both

6 parties in State of Ohio versus Ray

7 Tensing.

8 We were asked a question by the

9 jury. There were actually two

10 questions. The first question is, "May

11 we have a list of the Defense

12 witnesses?" And the second question is,

13 "Can we have a copy of the audio and

14 video from Roder's presentation? We

15 were only given the paper format."

16 With regard to these questions,

17 I've conferred with Counsel, and we have

18 decided that I will go back with the

19 court reporter and read the defense

20 witnesses from Thursday and Friday to

21 them, and they are not going to be given

22 a copy of the audio and the video. They

23 have everything they need. Everything

24 that was submitted into evidence is with

25 them in the back. So that is it.

4 MR. MATHEWS: Yes, Judge.

6 Ms. DeGraffenreid?

7 MS. DEGRAFFENREID: Yes.

10 Can you go back with me, Colleen?

11 (The following is held in the

12 jury room with only Judge Ghiz and the

13 court reporter present with the

14 12 jurors.)

15 THE COURT: I'm on the record and

16 back with the jury.

17 I did get permission from Counsel

18 for both parties to come back and speak

19 with you.

20 We were given questions that I

21 read into the record a bit earlier.

22 With regard to the list of witnesses,

23 you asked for the Defense witnesses.

24 They agreed that I could give you the

25 Defense witness names.

1 So on Thursday here is who we

2 had. I can't give you this piece of

3 paper, because my writing is on it.

4 Thursday was Scott Roder, Nate Asbury

5 from the Cincinnati Police Department,

6 Derek Noland from the UC Police

7 Department, Jeff Van Pelt from the UC

8 Police Department, and Rick Haas from

9 the UC Police Department, retired.

10 And on Friday you had James

11 Scanlon from the Columbus Police

12 Department, who is retired also, and

13 Mr. Tensing.

14 With regard to the audio and

15 video from Roder's presentation, I

16 cannot give you anything other than what

17 you have that was submitted into

18 evidence. So please use your collective

19 memories. You have everything you need

20 in those screen shots.
