Facts: May 1986, an information for violation of RA 6425 sec 4 Dangerous Drug Act 1972
was filed against petitioner (Khosrow Minuche) & (Abbas torabian) with the Regional Trial
Court, Branch 151, of Pasig City. The criminal charge followed a buy bust operation conducted
by the Philippine Police Narcotic agents in Minudlers house seizing a quantity of heroin.
August 3, 1998 micher filed a Civil Case #8845691 before the TRC, branch 19, of Manila for
damages on account of what he claimed to have been trumped up charges of drug trafficking
made by Scalzo
Issue: Whether or not scalzo could be immuned from civil suit in conformity with the Vienna
Convention of Diplomatic Relations
Held: Yes, Scalzo, being affirmed a member of the Diplomatic Staff of Us diplomatic to provide
criminal investigation expertise and assistance to foreign law enforcement agencies on narcotic
and drug control programs upon the request of host country. As a diplomatic agent entitled to
immunity from civil/ criminal suits.
