an animal, or cruelly work an animal when it was unfit for labor, and the violation was intentional and

Complainanthasinvestigatedthefactsandcircumstancesofthisoffenseandbelievesthefollowing
establishesprobablecause:

On05/22/2017,MinneapolisPolicerespondedtoinvestigateananimalwelfaresituationstemmingfrom
anincidentoccurringonorabout05/17/2017,atanapartmentcomplexat2300PleasantAvenueSouth,
Minneapolis,HennepinCounty,MN.Thepropertymanagerattheapartmentcomplexreceivedarequest
fromC.Z.,VICTIMherein,toreviewsurveillancevideofootagefromtheearlymorninghoursof05/17/2017.
VICTIMhadbeentoldbyherboyfriend,TAYLORJOSEPHWINUM(DOB:11/07/1988),DEFENDANT
herein,thathercat,Marcus,hadfallenfromhersecondstorybalcony,resultingininjuriesthatrequired
Marcustobeeuthanized.

VICTIMfirstlearnedofMarcussinjurieswhenherroommatediscoveredbloodontheapartmentliving
roomfloor.VICTIMthenlocatedMarcusunderthecouchwithasevereamountofblooddrippingfromhis
mouth.VICTIMsaidsheaskedDEFENDANTwhathappenedtohercatandheexplainedthathewas
afraidtotellherthathercatwasinjured.DEFENDANTsaidontheearlymorningof5/17/17,Marcus
jumpedontothe2ndfloorpatiorailingandfelloffthebalcony.DEFENDANTstatedthatheranoutsideto
getMarcuswhowasnowhidingundersomecarsinthebackparkingarea.DEFENDANTsaidwhenhe
triedtograbMarcusandbringhiminside,thecatbegantobiteandscratchhim.

MarcuswasbroughttotheUniversityofMinnesotaVeterinaryClinic.TheveterinarianfoundthatMarcus
"hadswellingandevidenceoftraumatohishead.Hewasunabletoclosehisjawwithamal-alignmentof
themandibletotheright.Hehadatraumatichardpalatefracture.Hehadbruisingandfullthickness
lacerationsonhistongue.Hehadanincreasedrespiratoryeffortwithharshlungsoundsandhewas
coughing."Marcushadtobeeuthanizedbecauseoftheseinjuries.

PolicereviewedsurveillancevideofromtheapartmentcomplexandobservedDEFENDANTcarrying
Marcusbythethroatfromtherearentranceoftheapartmentcomplex.DEFENDANTisthenseenashort
timelateratthefrontmaindoorofthecomplexthrowingMarcusintotheyardareabytheheadinaviolent
manner.ItappearedMarcusflewquiteadistanceintheairbytheanglepresentedinthevideo.Videolater
showsMarcusrunningawayfromDEFENDANTasiftryingtoescapebutseemsdisorientedasheruns
intoandknocksoverastandingcigarettebox.DEFENDANTisseenchasingandeventuallycatching
Marcusbythefrontmaindoor.DEFENDANTisthenobservedsqueezingMarcus'sneckandthroatarea
withextremeforce,whichappearedtorenderthecatmotionless.WhileDEFENDANTissqueezing
Marcusbythethroatarea,DEFENDANTcanalsobeseenrotatinghiswristsinwhatappearstobean
attempttobreakthecat'sneck.DEFENDANTdoesthismotionforapproximately10-12secondsbefore
hethenforcefullyslamsMarcustothegroundinthemainentryareaoftheapartmentcomplex.When
DEFENDANTre-entersthebuildinghepicksupMarcusandbeginstosqueezehimbythethroatandneck
areawhilewalkingoutofcameraview.DEFENDANTappearstobeusingextremeforceasheis
observedtobeclenchinghisteethandflexinghismusclesasifstraining.

VICTIMalsoshowedpolicetextmessagesfromDEFENDANTinwhichDEFENDANTexpressedthathe
hatesVICTIM'scatsandwishedtheywouldkilleachother.
