Q. And how did you come to know about this theft of one (1) scrap engine block
housing and scrap metals you have mentioned in your shop?

A. My caretaker told me through cell phone, sir.

Q. When?
A. Sometime July 29, 2004.

Q. What time?
A. At around 8:00 oclock in the afternoon.

Q. What is the name of your caretaker?

A. Joey Ramos, sir.

Q. What did Joey Ramos tell you in the cell phone?

A. Iyong guard namin ay nagnanakaw.

Q. And what did you do upon knowing that?

A. I immediately returned to my shop, sir.

Q. And what happened at your shop when you returned?

A. I saw the stolen items outside loaded in a cart already.

Q. And what else happened?

A. I brought him to the precinct.

Q. Whom were you referring to?

A. Albert Torregosa, sir.

Q. You mean to say when you returned to your shop and you saw these stolen
articles loaded in a cart, Albert Torregosa, the accused was still there?
A. Yes, sir.

Q. And how about your caretaker Joey Ramos, was he also there?
A. Yes, sir.

Q. Mr. Witness, you were not actually present at the time the alleged theft
incident happened?
A. Yes, Maam.

Q. So you have no personal knowledge of that alleged theft incident?
A. Yes, Maam.

Q. At that time, on July 29, 2004, you had other two-(2) security guards aside
from the accused in this case?
A. Yes, Maam.

Q. And in fact these two (2) security guards are no longer connected with your
junk shop now?
A. Yes, Maam.

Q. And that they have not been connected with you junk shop since this alleged
theft incident?
A. Yes, Maam.

Q. And it was only the accused in this case who did not leave the premises of
your junk shop at the time of the alleged incident happened?
A. Yes, Maam.

Q. Because of the plight of these two (2) other security guards, namely: Luther
Villariz and Val Roger of course you also suspected them to be the
perpetrators of that theft incident?
A. Yes, Maam.

Q. But you did not file any case against them?

A. No, Maam.
Q. And in fact you filed a complaint for this qualified theft against the accused
based merely on the information relayed to you by one Joey Ramos?
