JUDICIAL AFFIDAVIT

That I, MARCO XIN DE VERA, of legal age, Filipino Citizen, and a resident of No. 63 Lopez
Jaena Street, Aurora Hill, Baguio City, after having been sworn in accordance with law, hereby
depose and say:

PRELIMINARY STATEMENT

The person examining me is Atty. Mae Ann Y. Badua with office address at the 2nd Floor
Alviar Tower, Abanao cor. Shagem Streets, Baguio City. The examination is being held at the
same address. I am answering his questions fully conscious that I do so under oath and may
face criminal liability for false testimony and perjury.

Q1: Kilala mo ba ang mga akusadong sina Artemis Gulay and John Green? Do (you know the
accused in this case, Artemis Gulay and John Green?)
A1: Opo, Sir(Yes, sir.)

Q2: Bakit mo sila kilala?(Why do you know them?)

A2: Magkakapitbahay po kami sa Lopez Jaena Baguio City( We are neighbors at Lopez Jaena
Barangay, Baguio City.)

Q3: Nasaan ka noong Fenruary 20, 2012?(Where were you on February 20, 2012?)
A3: Nasa Lopez Jaena po ako kasama sina John Green at Artemis Gulay at pumunta kami sa
Office of the City Engineer. ( I was at Lopez Jaena with John Green,and Teresita Gulay, then
we went to the Office of the City Engineer.

Q4: Bakit kayo pumunta Doon sa Office of the City Engineer?(Why did your group go to the
Office of the City Engineer?)
A4: Upang maberipika yung road widening project daw sa Lopez Jaena ni Kapitantado ay
aprubado ba. (To verify if the alleged road widening of Lopez Jaena Road of Kapitantado has
been approved.

Q5: Anong nangyari nang kayo ay nasa City Engineers Office ?(What happened when you
were at the City Engineers Office?
A5: Ipinakita sa amin ni Engr. Jus Miyo ang naturang papeles at plano at nabanggit niya na
itoy hindi pa aprubado. (Engr. Jus Miyo showed us the papers and plan of the widening project
at Lopez Jaena and confirmed that it is not yet approved.

Q6: Anong ginawa niyo nang sinabi sa inyo na hindi pa aprubado ang road widening
project?(What did your group do when you were informed when the road widening project
was not yet approved?)
A6: Bumalik kami sa Lopez Jaena at kinausap naming si Kapitantado na ipatigil ang
pagbabakbak dahil wala naman silang aprubadong proyekto.( We went back to and told
Kapitantado to stop the digging as there is no approved project yet.

Q7: Anong nagyari matapos nun?(What happened after that?

A7: Dumating si Engr. Miyo at kinausap si Kapitantado.( Engr. Miyo arrived and talked to
Kapitantado)

Q8: Anong nangyari pagkatapos nun?Then what happened next?

A8: Kinabukasan, maaga akong lumabas para magsimba ngunit nakita kong nandoon nanaman
sina Kapitantado at mga trabahador niya sisimulang magbakbak ngunit pinigilan sila nina John
Green, tapos minura ni Kapitantado sina John Green at Artemis Gulay.(The next day, I went out
early to go to church, but then I saw Kapitantado and his workers who were about to start the
digging but were prevented by John Green and Artemis Gulay, then kapitantado jeered at John
Green and Artemis Gulay.)

Q9: Ayon kay Mr. Kapitantado noong ika 20 ng Pebrero 2012 ng mga alas nuwebe imedya ng
umaga , lumapit daw sa kanya , si John Green at nanigaw sa kanya, anong masasabi mo?
(According to Mr. Kapitantado, on February 20, 2012, at about 9:30 a.m. along Lopez Jaena, Mr.
Green approached him and alternately shouted at him. What can you say to that?)

A9: Wala pong katotohanan iyon, si Kapitantado ang walang respetong nanigaw sa matanda.
( That is not true, sir. It was Mr. Kapitantado who disrespectfully shouted at the old man,
(referring to John Green.)

Q10: Mayroon ka pa bang idadagdag sa iyong Judicial Affidavit?(What else can you say or add
to your Judicial Affidavit?
A10: wala na Po (None Sir).

I hereby execute to attest to the truth of the foregoing and to constitute as my direct
examination as witness for the petitioner in this case and for all intents and purposes.
