and CS plot No. !!62was belonged to Sheikh Monsur Ali who later sold
out 130

otl01.lug53. Said Buddhu Kazi got his name recorded in the SA Khatian No. 72L
.o...rpording Plot No. 1162. Thereafter, said Buddhu Kazi sold out 13.00 decimal

dated 28/05/1966. Said Buddhu Kazi sold out another piece of land in favour of Mrs
Rabeya Khanam vide a deed of Sale registered on 28/5/L966. Said Mr Tula Mia and
Rabeya Khanam got their names recorded in the RS Khatian No. 2989. Said Md. Tula
Mia died leaving behind his sons namely [i) A M Mabubur Rashid Khan, (ii) Md.
Matiar Rahman Khan, [iii) Md. Masud Khan, (iv) Md. Masum Khan, [v) Fazlur
Rahman Khan, (viJ Abdul Hamid Khan, (vii) Md. Moksedur Rahman Khan, 3
daughters namely (i) Ayesha Khanom, (iiJ Sufia Khan and [iii) Sultana Razia as legal
heirs for his property. Said A M Mabubur Rashid Khan & 9 others got their names
recorded in the Dhaka City Survey Khatian No.27277. Thereafter, said Mrs Rabeya
Khanom sold out 3.00 decimal of land vide Deed of Sale No. 73934 dated
72/05/L977 and another 1.00 decimal of land vide Deed of Sale No.21190 dated
22/08/1981 in favour of Azizur Rahman Khan. Thereafter, said Mr Tula Mia
transferred 2.50 decimal of land in favour of Azizur Rahman Khan vide Deed of
Heba-bel EwazNo.22422 dated 30/70/1984. Thereafter, said Azizur Rahman Khan
sold out 4.00 decimal of land in favour of Ayesha Khanom & Ahsanullah vide Deed
of Sale No. 4666 dated t4/IL/1982. It appears from Dhaka City Survey Khatian No,
L7257 that the said Ayesha Khanom & Ahsanullah got their names recorded in the
record of rights. Present owners, A. M. Mabubur Rashid Khan & 9 others &
Ahsanullah & Ayesha Khanom also mutated their names vide Mutation Khatian No.
t7251" & 27277,f ote No.
+ .# dated Lo/02/2ot| &24/04/201.4 and, paid the
land development tax up to 1.423 Bengali year.

10. Mutation of the present owners:


The present owners got their names recorded in the Mutation Khatian No. 17251 &

27277,|ote No. along with DCR vide Mutation Case No. 450/11 dated

LL. Land Development Tax Payment:

The present owners paid Land Development Tax up to 1,423 Bengali year, tax receipt
No. A- 0772L81 & A- 0772182.

NEC dated 06/11/20L6, Government Receipt No. 16217.

13. Opinion:

In the light of above discussion and history of chain, we are of the opinion that the
present owners acquire good title and ownership over the piece of land measuring
10.40 decimal and the building constructed thereon described in the Clause B above.
The present owners have saleable rights and title to the property and the proposed

mortgagor, upon purchasing the Schedule proper'ty through a Deed of Sale, can put
the property into mortgage as collateral security for the credit facility to be extended
by the Bank.
