Apprentice Training Act 2014

An Act to ensure that apprentices are given effective training in their occupation; and
to prevent abuses of lower pay rates for apprentices.
[24th October 2014]

B E IT ENACTED by the Queen's most Excellent Majesty, by and with the advice and consent of
the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled,
and by the authority of the same, as follows:

1 Employer responsibilities
(1) An employer shall provide, at no expense to an apprentice except reasonable travel
costs, a minimum of 30 days per year of training; and shall remunerate the
apprentice, for the duration of the training, as the apprentice would normally be
remunerated for work carried out.
(2) The training shall
(a) be carried out away from the apprentice's place of work,
(b) be relevant to the apprentice's job, and
(c) be in accordance with the apprentice's capabilities.
(3) A large employer may, with the consent of the Regional Training Board, directly
provide such training.
(4) The employer is to pay any examination fees.

2 Apprentice responsibilities
An apprentice shall attend
(a) the training provided under section 1(1), and
(b) any examination related to the training and paid for by the employer under
section 1(4),
and an apprentice who fails to attend without reasonable cause shall be liable for
any fees paid by the employer for the training or examination.

3 Training standards
The training and examinations an apprentice is required to attend under section 2
are to comply with the standards prescribed by the Regional Training Board.

4 Disputes
The Regional Training Board is to decide any dispute between an employer and an
apprentice in relation to
(a) the level or standard of training,
(b) the payment of fees (whether by the employer or the apprentice), or
(c) any other relevant issue.

5 Holidays
For the purposes of determining the apprentice's entitlement to holidays and
holiday pay, within the meaning of section 1(4)(d)(i) of the Employment Rights
Act 1996 (terms and conditions in the particulars of employment relating to the
entitlement to holidays and holiday pay), the time the apprentice spends attending
training required to be provided under section 1 is to be regarded as time spent
normally working.

6 Offences
A person or body corporate who fails to comply with section 1 commits an offence
and is liable on conviction to a fine not exceeding 5,000 for each apprentice in
relation to which a failure to comply occurred.

7 Interpretation
In this Act
apprentice means a person paid at the rate prescribed by article 13(2) of the
National Minimum Wage Regulations 1999 (S.I. 1999/584) as amended by the
National Minimum Wage (Amendment) Regulations 2013 (S.I. 2013/1975);
place of work means any place where an employer carries out business;
training means any instruction or education not including self-study.

8 Extent, commencement and short title


(1) This Act extends to the whole of the United Kingdom.
(2) This Act comes into force on 1st January 2015.
(3) This Act may be cited as the Apprentice Training Act 2014.
