JUDICIAL AFFIDAVIT

Purpose of the testimony: Respondent Spouses Leonora Gomez and

Gabriel Gomes is presenting the testimony of PO1 MELCHOR F. ROSALES to
prove that the accident occurred on March 7, 1997; that the it was due to
the negligence of herein plaintiffs driver and the latter tried to evade
responsibility by escaping from the place of the accident.

I, PO1 Melchor F. Rosales, of legal age, Filipino citizen, with postal

address at #2154 Matimayas street, Lealtad Sampaloc City, after having
been sworn in accordance with law and fully conscious that I do so under
oath and that I may face criminal liability for false testimony or perjury in a
way of answer to the questions propounded to me by Atty. Raymond R.
Rogacion, with office address at 1880 Cavite Street, Sta. Cruz Manila, do
hereby deposes and states:

ATTY. ROGACION: We are offering the testimony of the witness in

order to prove that he is the investigating officer at the time and place of
the incident;
Q1: Mr. Witness, can you state your name and designation?

A: I am PO1 Melchor F. Rosales, a Patrol Office of Quezon City

Police Department

Q2: As a patrol officer, what is your particular task?

A: We are assigned to a particular post to monitor peace and

order in the vicinity.

Q3: Where were you at between the evening of March 6 until

morning of March 7?

A: I was in the corner of E. Rodriguez, Sr. Avenue and Katipunan

Road between 11 in the evening until 7 in the morning

Q4: Why are in you in that place?

A: I was on duty at that time attorney.

Q5: Can you recall and incident that happened during the time of
your duty?

A: Yes atty. There was an accident that happened at around 5:30

in the morning involving a truck and a bus.

Q6: Will you state for the record, what exactly happened?

A: At around 5:30 in the morning a white Isuzu truck with plate

numbr UAW 582 coming from Katipunan Road heading
towards E.Rodriguez, Sr. Ave was travelling along the
downward portion of the Boni Serrano Avenue when upon
reaching the corner of Rivera Street fronting St. Ignatius
Village, its left front portion was hit by Mayamay bus.
Mayamay bus while traversing the opposite lane intruded on
the lane occupied by the Isuzu truck.

Q7: What did the bus driver do after the incident?

A: The bus driver tried to escape by speeding away from the
scene but he was apprehended in Katipunan Road corner C.P
Garcia Avenue by on Traffic Enforcer and a security guard of St.
Ignatius Village.

Q8: What did you do after witnessing the incident?

A: I approached the scene to gather information, made an

incident report and filed the same in our department.
