GENERAL ORDINANCE NO.

ORDINANCE GOVERNING THE SPEED LIMIT OF PUBLIC AND PRIVATE VEHICLE


IN THE MUNICIPALITY OF ROSARIO AND ITS BARANGAY AND THE
INSTALLATION OF ROAD SIGNS

WHEREAS, Republic Act No. 4136 otherwise known as the "Land Transportation
and Traffic Code which regulates the traffic law of the Philippines, embodying therein the
speed limits on all highways.

WHEREAS, the number of accidents and fatalities due to the unregulated speed
of vehicles in the municipality is alarming and shall be delimited to safeguard the well-
being of all citizens of the municipality of Rosario.

WHEREAS, even there is existing ordinances and regulations being implemented


by the assigned and appropriate agencies of the local government involving safe driving
and precautions, it is still insufficient and the its implementation of such is not as strict as
it should be to ensure the effectivity of such ordinances.

WHEREAS, there is a need to provide other facilities and measures to effectively


promote road safety for every traveler and transporter in the municipality of Rosario
including its citizens.

Section 1. SHORT TITLE This Ordinance shall be known as Speed Limit and Road
Signs Ordinance of 2017

Section 2. DECLARATION OF POLICIES. The following are the declared policy of the
Speed Limit and Road Signs of 2017 to ensure the road safety and well-being of every
citizen of the municipality of Rosario:

a. Promote the well-being of every citizen of Municipality of Rosario specially in the


road;

b. Provide necessary facilities for the improvement of the implementation of this


ordinance;

c. Minimize, reduce, if not completely abolish, the number of accidents related to the
unregulated speed of all vehicles;

d. Promote community educations and seminars regarding such for the participation
of the community and to welcome possible improvements for this ordinance.
Section 3. SCOPE The provisions of this ordinance shall cover all type of vehicles,
private and public, light weight and heavy weight and motorcycles.

Section 4. DEFINITION OF TERMS -

a. Speed Limit - the maximum speed at which a vehicle may legally travel on a
particular stretch of road.

b. Private Vehicle Vehicles owned by a person used for personal purposes,


including company and vehicles used in business.

c. Public Vehicle Vehicles owned by a person which is available for use by the
general public for transportation and compensation of passengers.

ARTICLE II

APPLICATION OF THE PROVISIONS

Section 5. Rate of Speed: The rate of speed of all types of vehicles inside the vicinity of
Rosario shall be limited to the following:

a. In the highways of Barangays Quilib, San Roque 75 kilometers per hour

b. In the highways of Barangays Namunga, Masaya, San Ignacio, Marilag 75


kilometers per hour

c. In the highways of Barangays Namuco, Itlugan, Maalas-as, 75 kilometers per


hour

d. In the highways of Barangays Bagong Pook, San Carlos, Biga, Baybayin,


Lumbangan, Tiquiwan, Alupay, Natu, Puting Kahoy 75 kilometers per hour

e. In the highways of Poblacion, Barangays A, B, C, D and E 55 kilometers per


hour

Section 7. Installation of Traffic and Road Signs There shall be road signs found,
not limited to signs informing speed limits but also the appropriate signs needed by
streets, to be installed in all affected highways, streets and roads within the municipality
of Rosario;

Section 8. Installation of CCTVS There shall be enough numbers of CCTVs installed


in the highways, streets and roads of Rosario to ensure the regulation of the speed limit.
Section 7. Sanctions Violators shall be subjected to:

(a) First Offense: Confiscation of License and payment of 1, 000;


(b) Second Offense: Confiscation of License and payment of 5, 000;
(c) Third Offense: Confiscation of License and imprisonment for 3 days minimum
to maximum imprisonment of 3 months

ARTICLE IV

FINAL PROVISIONS

Section 9. SEPARABILITY CLAUSE If for any reason or reasons, any part or provision
hereof shall be held to be unconstitutional or invalid, other parts or provisions hereof which
are not affected hereby shall continue to be in full force and effect.

Section 10. REPEALING CLAUSE All ordinances, resolutions or laws of local


application and effect inconsistent hereto are hereby modified, superseded and repealed
accordingly all precious ordinances shall be deemed repealed or modified accordingly.

Section 11. EFFECTIVITY CLAUSE This Ordinance shall take effect immediately after
the signing hereof.
