RESOLUTION DECLARING THE PROVINCIAL SPORTS COMPLEX COLISEUM


(COVERED COURT) AS AN EVACUATION CENTER IN TIMES OF DISASTERS AND
CALAMITIES.

Whereas, Philippine Disaster Risk Reduction and Management Act of 2010 declares that it
is the policy of the State to uphold the people's constitutional rights to life and property by
addressing the root causes of vulnerabilities to disasters, strengthening the country's
institutional capacity for disaster risk reduction and management and building the resilience
of local communities to disasters including climate change impacts;

Whereas, the Provincial Government sought the need to have an accessible venue that can
accommodate more people in times of disaster and calamities;

Whereas, the Office of the Governor, through a Letter dated January 19, 2017, requests
that the Provincial Sports Complex Coliseum (Covered Court) be declared as an Evacuation
Center;

Whereas, Section 16 of the Local Government Code, otherwise known as the General
Welfare Clause, specifically calls on LGUs to exercise the powers necessary, appropriate,
or incidental for its efficient and effective governance, and those which are essential to the
promotion of general welfare;

Whereas, Provincial Governor is mandated under Section 465 (vii) of the Local Government
Code to carry out the necessary emergency measures during and in the aftermath of man-
made and natural calamities;

Whereas, the Sangguniang Panlalawigan as mandated by Section 468 (iv) of the Local
Government Code to adopt measures to protect the inhabitants of the province from the
harmful effects of man-made or natural disasters and calamities, and to provide relief
services and assistance for victims during and in the aftermath of said disasters and
calamities;

Now, THEREFORE, on motion of ______________, duly seconded by


________________________, to approve a RESOLUTION DECLARING THE
PROVINCIAL SPORTS COMPLEX COLISEUM (COVERED COURT) AS AN
EVACUATION CENTER IN TIMES OF DISASTERS AND CALAMITIES.
ORDINANCE DESIGNATING THE PROVINCIAL SPORTS COMPLEX COVERED COURT AS AN
EVACUATION CENTER IN TIMES OF DISASTERS AND CALAMITIES

The Sangguniang Panlalawigan of Batangas, hereby ORDAINS that;

Section 1. Title. This ordinance shall be cited as the PROVINCIAL SPORTS COMPLEX COVERED
COURT AS A DESIGNATED EVACUATION CENTER.

Section 2. Declaration of Policy.

The Provincial Government recognizes the right of the people for the protection of their life and the
promotion of their general welfare.

Section 3. Scope and Coverage.

The Provincial Government shall establish and maintain a fully operational Evacuation Center, designate
the Provincial Sports Complex Covered Court as the Designated Evacuation Center, and provide facilities
to make the evacuation center responsive to disasters and declaration of state of calamities.

Section 4. Definition of Terms.

Disasters as defined in Republic Act No. 10121, refer to a serious disruption of the functioning of a
community or a society involving widespread human, material, economic, or environmental losses and
impacts, which exceeds the ability of the affected community or society to cope using its own resources.
Disasters are often described as a result of the combination of: the exposure to a hazard; the conditions of
vulnerability that are present; and insufficient capacity or measures to reduce or cope with the potential
negative consequences. Disaster impacts may include loss of life, injury, disease and other negative effects
on human, physical, mental and social well-being, together with damage to property, destruction of assets,
loss of services, social and economic disruption, and environmental degradation

Evacuation center - such places where the evacuated local residents will be temporarily taken

State of Calamity refers to a condition involving mass casualty and/or major damages to property,
disruption of means of livelihoods, roads, and normal way of life of people in the affected areas as a result
of occurrence of natural or human-induced hazard as defined in Republic Act No. 10121;

Section 5. Designation of the Provincial Sports Complex Covered Court as an Evacuation Center.

The Provincial Sports Complex Covered Court is hereby designated and utilized as an Evacuation Center
during times of disasters and calamities.

Nothwithstanding such designation, the BPSC shall remain to be an Economic Enterprise as stated in
Section 4 (2) (b) of Provincial Ordinance No. 009 year 20031;

(2) Batangas Province Exhibition Center-Sports Complex (BPEC-SC)

(b) General Operation of BPEC-SC an economic enterprise, the BPEC-SC with existing
facilities shall be open for rental and fees. The exhibition center/covered court shall be

open for concerts, assemblies and big social and commercial gatherings and activities.
The ground and second floors of the covered court shall be designated commercial areas
for commercial stalls and other income generating activities to be leased out at fixed rates.
The rentals/fees for this economic enterprise shall be approved by the Batangas Province
Economic Enterprise Board.

Section 6. Operation of the Evacuation Center.

The Designated Evacuation Center shall be made ready and manned by the Subcommittee on Disaster
Response, Section 2, Article III of Provincial Ordinance No. 001 year 2011 2;

a. Function.

The primary or primordial responsibility of this subcommittee is the provision of emergency


services and public assistance during or immediately after a disaster or crisis in order to save
lives, reduces health impacts, ensure public safety and meet the basic needs of the people
affected.

b. Composition.

Chairperson- Provincial Government Department Head, Provincial Social Welfare and


Development Office
Members: Provincial Health Officer
Philippine Red Cross-Batangas
Provincial Information Officer
Bureau of Fire and Protection-Batangas
Department of Education Superintendent
Provincial Veterinarian

Section 7. Facility Requirements.

The following shall be the minimum facilities requirement for the Designated Evacuation Center:

1. Parking areas for emergency and other vehicles.


2. At a distance from any danger area or hazards like flooding or landslide.
3. Proper ventilation system.
4. Floor area devoid of permanent fixtures to be used flexibly for assemblies and as sleeping
area.
5. Eating area.
6. Sufficient water supply.
7. Centralized kitchen and laundry areas.
8. Shower and toilet facilities, according to gender.
9. Generator or back up power supply.
10. Stockroom for relief goods.

aftermath of crisis
11. Isolated area that can be used as a clinic.
12. Trash collection area.
13. Other physical provisions guaranteeing humane conditions for evacuees.

Section 8. Provision in compliance with Republic Act No. 10821 known as the Childrens
Emergency Relief and Protection Act.

Under Section 4 (b) of Republic Act No. 10821, Establishment of Transitional Shelters for Orphaned,
Separated, and Unaccompanied Children, the Local Government Unit of the areas declared under a state
of calamity, immediately establish an option for transitional shelters, prioritizing vulnerable and marginalized
groups including orphaned, separated, and unaccompanied children, and pregnant and lactating mothers.
New transitional shelters, established pursuant to this Republic Act 10821, shall be designed with the
following considerations: gender-specific emergency latrines, bathing cubicles, and hand washing facilities
specifically designed for children. It shall provide mother and child-friendly spaces where children can take
part in child activities. It shall also have provisions for maternal and newborn and infant care and rooms to
protect, feed, provide personal care, and ensure the right to privacy. Existing transitional shelters shall be
modified to the extent possible to comply with the abovementioned considerations.

Section 9. Maintenance of the Evacuation Center.

The Batangas Provincial Disaster Risk Reduction and Management Office shall ensure the maintenance of
the facilities and amenities of the Evacuation Center.

Section 10. Structural Requirement.

The Provincial Engineering Office shall ensure that the structural capacity of the designated Evacuation
Center is in accordance with the specifications of Republic Act No. 6541 or the National Building Code of
the Philippines and be able to withstand wind speeds of three hundred twenty (320) kilometres per hour or
two hundred (200) miles per hour and a moderate seismic activity of at least 7.2 magnitude.

Section 11. Appropriations.

The amount needed to supplement the requirement for the operation of the Designated Evacuation Center
shall be taken from the 70% PDRRMF for Disaster Response, subject to the existing rules and regulation
on the utilization of the LDRRMF.

Section 12. Repealing Clause.

All ordinances and resolutions inconsistent with the provisions of this Ordinance are hereby repealed or
amended accordingly.

Section 13. Separability Clause.

If, for any reason, any part or provision of this Ordinance is declared invalid or unconstitutional, any part or
provision not affected thereby shall remain in full force and effect.

Section 14. Effectivity Clause.

This Ordinance shall take effect upon approval.
