AIRPORT POLICE COMPLAINT

iNCIDENT DATE : FRIDAY AUGUST 11, 2017


Community Emergency Response Team Volunteer responder answered a city of San Antonio
emergency declaration broadcast via city Fire Department website requesting first responder for
an emergency listed as unknown/other to Terminal B west doors. As I was heading north to
Ih35 on my way home after visiting my father and was on Wurtzbach Parkway approaching
U.S.281. I decided to make sure no major emergency requiring assistance was underway. I
pulled through the lower lever running code lights only as to not create a panic among the
general public. I was stoped by a uniformed AIRPORT POLICE OFFICER who asked where I was
going. I informed him that I was a volunteer responder answering a broadcasted declared
emergency listed as unknown/other terminal B west doors and showed him the City of San
Antonio fire departments web page active incidents that showed the request and the address of
the airport. He asked me what the emergency was and I said unknown that's why I was
responding. The officer let me pass. Upon reaching the western doors of the terminal I double
parked in the 2nd loading and unloading lane. Leaving my Red strobe lights on I exited my
vehicle carrying my blue trauma medical bag and entered the terminal. upon entry I surveyed
the area for the emergency not seeing anyone in close proximity I began to head east through
the terminal. There was two San Antonio Fire medics wearing standard bark blue short sleeve
shirts and pants about 35-40 feet ahead of me so I whistled to get their attention. When they
stopped and turned I asked if any assistance was needed. One of the two said No it was a
medical call, a man had fallen and broken his leg. I said okay, and thanks then turned around
and returned to my car. Upon putting my med-kit in the backseat of my cur and opening the
drivers door the Police officer who questioned me when I arrived approached me and
demanded to see me Id he then said he didn't think I was allowed to have the RED lights on may
car. I handed the clear plastic holder clipped to the front of my safety vest which held my Texas
Drivers License, A gate pass to all military bases in San Antonio issued by the personnel division
at Fort Sam Houston, and a City Of San Antonio background check identification with my picture
and fingerprint on the face of it. The officer began asking questions that were not relevant to
the issue he first raised being the flashing red lights on my car. I stated I am the CEO, President,
and Founding Member of the Community Emergency Response Team Garden Ridge/Natural
Bridge in Comal County a nonprofit unincorporated Association which operates as a volunteer
Fire department and I am a volunteer firefighter. He then asked me under who's authority was I
a firefighter. I said the Governor of the State of Texas under homeland security and I proceeded
to enter my vehicle and produce a ringed binder which held the original legal formation
documents and also held my OFFICIAL FEMA, DEPARTMENT OF HOMELAND SECURITY G-317
CERT certification issued August 26, 2016 by the New Braunfels office of emergency
management. I also had in my possession a vehicle identification for the Bexar County
Emergency Scene Rehab that I gave been a volunteer since 2010 as I was opening the rear
drivers side door to retrieve the identification the officer came up to me and shoved me away
from my car. At this first sign that all professional courtesy had been removed and my
movements were now being controlled I asked If I was being detained. The officer Said that I

was and then placed a pair of hand cuffs on me took me to the curb and sat me down there and
said I should have known better than to open the car door and reach inside. But I had opened
the drivers door and reached in for the binder he was reading through not more than 3 or 4
minutes before and he never said I wasn't to be entering my vehicle. So I asked what was the
problem and he said well right now its the lights I' ll probably be issued a ticket for them
because I'm not allowed to have them on a personal vehicle. only government and vehicles with
exempt plates are allowed to have red lights. He said he was waiting for his supervisor who
would confirm everything and then I would get my ticket and be on my way. Another uniformed
officer arrived at our location and the first officer showed him my ID's and said I think this one is
fake It does not look like any Government ID I have ever seen before. The second officer stated
that yes it is most definitely a fake ID I have seen fake ID's before and this is one. Then the first
officer said,yah it says personal on it instead of personnel every military ID I have ever seen says
personnel so I am sure its a fake ID. The officer cane over to me and stood me up and waled me
to the back of the patrol SUV and said were going to let you sit in the air conditioned patrol unit
since its so hot. While sitting in the patrol unit the officers began searching the inside of my
vehicle after I informed them that I did not consent to any searches. I now believe the officer
had another officer corroborate my U.S., Army gate pass was a fake to charge me with a felony o
they could then perform a search of my vehicle that would be allowed if I was arrested and
charged for the commission of a felony. the second officer open my glove compartment and
removed my holstered double action 22 revolver which was concealed until the officer
unconcealed it as required by house bill 1815. Then a third officer arrived with a K9 and
commenced a sweep of the vehicle and even had the dog approach the open drivers side
compartment. The dog never gave any alert anywhere on the vehicle. After another 10 minuets
a fourth officer arrived this time he was a corporal and had a digital camera and began
photographing everything in and on my vehicle. I had Magnetic door signs that displayed
Community Emergency Response Team and license plate markers on the front and rear plates
that also said community Emergency Response Team. Audible siren and lights including single
red light on the roof that was attached magnetically to conform with Texas Transportation Code
547.305(D) a private vehicle of a volunteer firefighter or a certified emergency medical
services employee or volunteer when responding to a fire alarm or medical emergency; and
which are allowed Sec. 547.702. ADDITIONAL EQUIPMENT REQUIREMENTS FOR AUTHORIZED
EMERGENCY VEHICLES. (a) An authorized emergency vehicle may be equipped with a siren,
exhaust whistle, or bell:

(1) of a type approved by the department; and

(2) that emits a sound audible under normal conditions at a distance of at least 500 feet.

(b) The operator of an authorized emergency vehicle shall use the siren, whistle, or bell when
necessary to warn other vehicle operators or pedestrians of the approach of the emergency
vehicle.

(c) Except as provided by this section, an authorized emergency vehicle shall be equipped with
signal lamps that:

(1) are mounted as high and as widely spaced laterally as practicable;

(2) display four alternately flashing red lights, two located on the front at the same level and
two located on the rear at the same level; and

(3) emit a light visible at a distance of 500 feet in normal sunlight.

(d) A private vehicle operated by a volunteer firefighter responding to a fire alarm or a medical
emergency may, but is not required to, be equipped with signal lamps that comply with the
requirements of Subsection (c).

(e) A private vehicle operated by a volunteer firefighter responding to a fire alarm or a medical
emergency may be equipped with a signal lamp that is temporarily attached to the vehicle roof
and flashes a red light visible at a distance of at least 500 feet in normal sunlight. A personal
vehicle Sec. 541.201(g).

The arresting officer has used the color of law to create first the appearance that a violation if
the Texas Transportation Code was violated which he could then use as a basis to perform an
illegal stop in order to commence an official investigation that would lead to an escalation from
a traffic ticket to a false felony charge of tampering with a government document when no such
activity had ever occurred. Then based on information learned through an illegal search and
seizure of information under the guise of s field investigation the officer would learn I had been
ticketed for soliciting without a permit in Schertz and the officer making the charge had
provided hearsay Testimony to the court claiming he spoke with my brother who is the CERT
Citizen Corps Coordinator for 10 counties in Texas and was told Im not affiliated with CERT in
any capacity, Was told I was not allowed to solicit for donations claiming collection is for CERT,
and I had been arrested for it before. Because of this false testimony by the Schertz officer the
City prosecutor Darryll Dullnig and the Municipal Judge TAKAS believing the officers testimony
initiated contacting all the

surrounding law enforcement agencies stating I was qmisrepresenting to the public my standing
and status in order to unjustly enrich myself. The City of Selma Has acted on the false report by
charging me with soliciting without a permit and has even arrested and booked me into the
Guadalupe county jail that I have been released on a Personal Recognizance bond then next
morning. All of these documents were inside the Business binder that was seized as evidence
on a second felony charge of impersonating a public servant. What the officer didn't see was
the filed motions to dismiss the charges with prejudice and a complaint to the Judicial Review
commission and the State Bar Association and a sworn complaint with the chief criminal
investigator in the DA's office in Guadalupe County requesting the Texas Rangers begin an

investigation on Mr Dullnig for holding court as a municipal elected judge when he was only a
contracted city prosecutor. and for defamation of our Association. with various law enforcement
agencies and all 3 county offices of emergency management.

Even with documentation of soliciting without a permit there is nothing to give rise to Texas
Penal Code - 37.11. Impersonating Public Servant.

"To impersonate", is generally understood to mean, "to pretend to be another person." One
who honestly believes that he is entitled to the title of the office under which he acts lacks the
requisite intent and, thus, cannot be found guilty under Section 37.ll(a). See Strahmann v. State,
70 S.W.2d 709, 709 (Tex.Crim.App.1934) (interpreting the predecessor statute).

If Defendant's current position as CEO, President, & Founding Member of the Community
Emergency Response Team Garden Ridge/Natural Bridge,UNA. which operates as a volunteer
fire department entitled him to daim that he was a volunteer firefighter. Or, if his belief that he
was a volunteer firefighter caused him to act without pretense. Then he could not have been
impersonating, and any indictment will fail to allege a crime for which Defendant can be
prosecuted.

The Physical removal of all identifying markings from my vehicle claimed to be in the collection
of evidince which has been siezed without a warrant and keept from my legal use that denies
me the right to quit enjoyment of my purchased property.
Also removed from me was my safety vest which is used to protect me while responding to an
incident on a texas roadway as required by OSHA standards. a black ball cap with a CERT
patch, a beofang 2way UHF/VHF/FM handheld transciver in a black nylon clip on case, and my
City of San Antonio TNC fingerprint background License issued by the San Antonio Police
Transportation unit and a blue xticker that was attached to the Passanger rear door stating
that I have been verified by the City Pokice Department to be safe to provide rideshare
services for hire in the City of San Antonio.
There was no reason for the removal of the "Been Verified" notice and my City License
that in any way is connected to the charges against me. Because the officer has taken them
from me I have been denied my right to earnings as my company requires I have them at all
times. This was an intintional act perpatrated to deny me the ability to prove I had passed the
fingerprint and background investigation by the San Antonio Police Department. and could
legally operate commercially.
I find it highly irregular and suspecious that as a ressult of any offical investigation it would be
necessary to take mechanic tools to my vehicle to remove my CERT identifying items that were
visiable from the front and rear along with removing my CERT magnetic door markers. The
siezure of my CERT safety vest and ball cap. Confiscating My SAPD Fingerprint background
license. Removing my 2 way HAM radio. And taking and keeping all my original legal
documents showing the formation of the Community Emergency Response Team Garden
Ridge/Natural Bridge Nonproffit Association that are in the front of my FEMA CERT basic
orginization and operation manual claiming it was 4 necessary to remove these items from my
access as they are evidence of the charges pending when as an official act the Airport Police
department had photographed all evidence and the surrounding physical location by a
uniformed officer who's assignment it was to aquire the necessary photographic documenting
of the scene.
