SB Member The reading of the Minutes of the 73rd Regular Session on April 13, 2015 was
dispensed with on motion of Hon. Juan A. Maralit, Jr., jointly seconded by
Hon. Harold A. Montes, Hon. Gina Y. Libre and Hon. Edna B. Bote. Hon. Juan A.
Maralit, Jr. then moved for the approval and adoption of the said Minutes and Journal
LUZ M. QUIONES of Proceedings, duly seconded by Hon. Cenen A. Angsinco.

GINA Y. LIBRE 1. Committee Report No. 2015-08

SB Member Reported by the Committee on Barangay Affairs, thru its Chairperson
Hon. Arfran L. Quiones, dated March 25, 2015, which dwelt on the subject matters to
wit: (Per Referral): A) Reference No. 1968 - Indorsement letter from the Office of the
Hon. Mayor Domingo A. Lim, requesting for a resolution for the issuance of Net
JUAN A. MARALIT, JR. Borrowing Capacity; and B) Reference No. 1969 - Requesting the herein sanggunian

for a resolution granting authority to the Local Chief Executive to secure, apply and
contract a loan with the Land Bank of the Philippines in the total amount of
P206,502,887.90.

SB Member Facts, findings, and recommendations were presented.

The Hon. Robert R. Simbahon commented that the Findings in the Committee
Report was a consolidation of raw data and the analysis of the reporter. Referring to
Findings No. 3, Hon. Simbahon opined that the proper office to provide the outstanding
ARFRAN L. QUIONES loan balance of P70 Million is either the Municipal Accountants Office or the
Liga ng mga Barangay President
Municipal Treasurers Office, which didnt happen in the committee hearing. The
Hon. Simbahon also observed the absence of the Municipal Treasurer during the
committee hearing. The Hon. Arfran Quiones answered that the data presented were
not speculative, but were based on records, specifically of the MDFO loan for the four
(4) heavy equipments acquired by this local unit in 2012.

74th Regular Session The Hon. Juan A. Maralit, Jr. likewise commented that there must have been
17th Sangguniang Bayan corresponding attachment to vouch the assertions in the committee report, such as the
April 20, 2015 P27 Million interest per year and the remaining loan balance of P70 Million which is
still subject to proper computation. Further, he opined that the committee
recommendation in the committee report was against the recommendation in the
previous joint committee report on the same referral and subject matter, and on that
note, he suggested that the herein committee report shall be treated as a dissenting

Mun. Vice Mayor suggestion of the Hon. Maralit, Jr.

The Hon. Arfran Quiones detailed his basis in computing the loan balance and
interest. He also said that his committee report will be different from the previous joint

report since they have different resource speakers; he hinted that his findings will be

supported by Certifications which he has already requested from, but not yet provided
by, the concerned offices.

EDNA B. BOTE Referring to committee recommendations, the Hon. Harold A. Montes

SB Member emphasized that the cited P27 Million interest per year was mere speculation
considering that there was no document to support the specific terms of LBP loans.
Hon. Montes also inquired from the reporter if he is willing to support the plan of the
local government to purchase any lot along the stretch of Batasan to Magdagondong,
CENEN A. ANGSINCO other than the Angsinco property, and build a new transport terminal, which the
SB Member Hon. Arfran Quiones did not categorically answered.

Hon. Gina Y. Libre expressed her confusion as to her personality in the two (2)
committee reports with conflicting recommendations, she being a member of both
HAROLD A. MONTES committees. She emphasized that she had participated, voted for and concurred with the

previous joint committee report, and for that very reason she had not participated in the
committee hearing of the reporting committee.

LUZ M. QUIONES To shed light on the issue, Hon. Simbahon read Rule VIII, Committee
SB Member Functions, Section 2.a of the Internal Rules of Procedure of the herein sanggunian; and
he opined that the same subject matter maybe jointly referred to and treated by different
committees rather than the sanggunian adopting separate reports with the same subject
matter.

Finally, the Hon. Maralit, Jr. reiterated his suggestion to consider the subject
committee report as a dissenting opinion to the previously adopted joint committee
report, specifically both treating the same subject matter.

SB Member After thorough deliberation, the Hon. Presiding Officer ruled that the
Committee Report No. 2015-08 will be considered a dissenting opinion to the Joint
Committee Report No. 2015-06.

Reported by the Committee on Education, thru its Chairperson Hon. Gina Y.
Libre, dated April 14, 2015, which dwelt on the subject matter to wit: Memorandum
No. 2015-004 from the Office of the Municipal Mayor, this municipality, dated March
2, 2015, RE: Existing problem of Anangilan Elementary School (New School Site), c/o
Mr. Roland Deligero-Principal.
Findings and recommendation were presented.

Hon. Cenen A. Angsinco provided additional information that the Honorable

Congresswoman Thelma Z. Almario is willing to allocate funds equivalent to half of

HAROLD A. MONTES AN ORDINANCE ENACTING THE HEALTH AND SANITATION CODE OF
SB Member THE MUNICIPALITY OF LUPON AND FOR OTHER PURPOSES.

The Hon. Bote enjoined the honorable body to study the said proposed
LUZ M. QUIONES ordinance and the deliberation will be on the next session.

the proposed ordinance.
