1987 Constitution (Sec.

1, Art IV)

The following are the citizens of the Philippines:

1. Those who are citizens of the Philippines at the time of the adoption of this Constitution.

2. Those whose fathers or mothers are citizens of the Philippines

3. Those born before January 17, 1973, of Filipino mothers, who elect Philippine citizenship upon reaching the age of majority; and

4. Those who are naturalized in accordance with law.

1973 Constitution (Sec. 1, Art III)

The following are the citizens of the Philippines:

1. Those who are citizens of the Philippines at the time of the adoption of this Constitution.

2. Those whose fathers or mothers are citizens of the Philippines

3. Those who elect Philippine citizenship pursuant to the provisions of the Constitution of nineteen hundred and thirty-five.

4. Those who are naturalized in accordance with law

1935 Constitution (Sec. 1, Article III)

The following are the citizens of the Philippines:

1. Those who are citizens of the Philippines Islands at the time of the adoption of this Constitution.

2. Those born in the Philippine Islands of foreign parents who, before the adoption of this Constitution, had been elected to public office in the Philippines Islands.

3. Those whose fathers are citizens of the Philippines.

4. Those whose mothers are citizens of the Philippines and upon reaching the age of majority, elect Philippine citizenship

5. Those who are naturalized in accordance with law.

Election of Phil. Citizanship - CA no. 625

1. election is expressed in a statement signed and sworn by the party concerned before any official authorized to administer oaths

2. Statement is filed with the proper Civil Registry

3. Statement is accompanied with an oath of allegiance to the Constitution and Philippine Government

Naturalization by Judicial Proceedings - CA no. 473

1. File a petition for intention one year prior to the filing of petition for naturalization

2. Then, you file the petition in a competent court

3. Prior to the hearing, there must be a publication

4. The petition, as well as the order of trial should be published 6 months prior to the actual hearing.

5. After that, presentation of evidence.

6. Then, decision. The decision is not immediately executory. It is supposed to take effect after 2 years, because the so-called waiting period intends to determine whether or not the
petitioner suffers none of the disqualification from the time the petition is made up to the time the judgment is rendered and 2 years after that.

7. After the 2-year waiting period, the judgment will become final and may be executed. This is presumes that there is no appeal taken by the REpublic.

8. THen, the ACR will be cancelled and the Certificate of IDentification as Phil. Citizen will be issued.

Naturalization by Administrative Proceedings - RA 9139

1. File with the Special Committee on Naturalization

2. Pay Fees
Reacquisition of Citizenship - RA 9225 and CA no. 63

Procedure:

1. take an oath of allegiance (RA 9225)

2. Make a personal and sworn renunciation of any and all foreign citizenship before any public officer authorized to administer an oath (to those seeking elective public office)

Repatriation - RA 8171

Procedure:

1. taking the necessary oath of allegiance to the RP

2. Registration of the Cert of Repatriation in the proper civil registry and in the Bureau of Immigration. BOI will cancel the ACR and issue cert of identification as Filipino citizen
