ANSWER
Defendant hereby answers Plaintiffs complaint as follows:

I. ADMISSIONS/DENIALS
1. That defendant ADMITS the contents of paragraphs 3 through 5 only insofar
as the defendants circumstances are concerned.

2. That defendant ADMITS that it does operate under the service mark Green
Cab Pizza Haus, as cited in paragraph 9.

3. That defendant vehemently DENIES what plaintiff regarded as a colorable


imitation of its registered YELLOW CAB PIZZA CO. mark on identical
goods and the checkerboard design in its flyers and advertisements, as
alleged in paragraph 10.

4. That defendant DENIES having received a cease and desist letter from
plaintiff Yellow Cab, contrary to what is stated in paragraph 11.

5. That defendant denies each and every allegation contained in paragraph 12 of


the complaint.

WHEREFORE, the defendant respectfully prays that:


a. The Plaintiffs action be dismissed with prejudice;
b. There be an order that Plaintiff shall take no relief from the complaint;
and
c. Plaintiffs be ordered to pay the costs of this suit.

Other relief and remedies as may be deemed just and equitable under the
premises are likewise prayed for.
