[Subject . was transported by AMR to HMC. He sustained injuries
to his face bleeding from the face and his mouth. It was unknown how he

sustained the injuries. Later at 1100 hours reported through his mom
that he did not know how he sustained the injuries. Victim/Suspect
sustained a gunshot wound to his left elbow. He was released from HMC after
being treated.]

[DICVS/BWV WAS RECORDING.
On 11/19/2017 at 0332 hours I was waiting at the corner of Harvard Avenue and E
Pike St waiting for SUV when I heard approximately fifteen gun shots. I could
not tell where the shots were coming from, but it sounded like the shots were
within a block or two from my location. I heard an additional 10-15 shots and
then 3E3 called out a foot pursuit of someone running from the . I
responded to 3E3's location in the 1500 BLK of Boylston Avenue, where I saw
Witness/ proned out on the ground. He was detained, and it was
determined he had only saw the shooting and was not part of the incident.
W/ had told me that he saw two groups of approximately 5-10 males in a

verbal altercation in the lower level of the parking garage. He did not see
who shot, but once he heard gun shots he ran from the scene. He was identified
and released, with Sergeant Poblocki screening the unarrest. Officer Elliott
completed a Terry Stop Template.
Earlier in the evening, a large group had been kicked out of a club called
and once the group left they came to Capitol Hill. Third watch
officers told me that the group was a "walking disturbance" throughout the
night. Approximately 25 minutes prior to this call, a disturbance was
broadcast at Broadway/ E Pike St outside the , Incident
, and had been caused by this same group. A black Chevy Tahoe with
license plates was listed on this call. In addition, a dark Volkswagen
Jetta was involved in this incident.
Officers on scene of the shooting quickly got out information that the
following vehicles were seen driving out of the garage at a high rate of speed:
A black Chevy Tahoe, a black Chevy Malibu, a blue Honda Civic, black Volkswagen
Jetta and a silver Chrysler Sebring. Officers conducted a large area search to
locate these vehicles. Officers also stated that multiple casings were found
in the garage, along with a loaded 45 caliber magazine. The scene was roped
off for evidence to be collected later.

At the scene of the shooting, Officer Couet located surveillance from

security which captured the shooting. He saw two groups in the garage, one
located on the west side of the garage and the other on the east. The footage
was grainy. Officer Couet saw a white male with brown shoulder length hair, an
orange puffy jacket, black pants and white shoes shoot a firearm east towards
where a black Chevy Tahoe and a silver Chrysler Sebring were parked. The
white male took cover behind a large pillar. An unknown race male subject
wearing a yellow jacket appeared to shoot a firearm west towards the white
male. The gun fire stopped, and the suspect in the yellow jacket jumped into
the silver Chrysler Sebring followed closely by the black Chevy Tahoe. The
white male suspect ran to the blue Honda Civic and drove away. He was later
contacted at Swedish First Hill (see paragraph below). Another suspect who had
been near the Chevy Tahoe ran to a black Volkswagen Jetta and drove out of the
garage.
While in the parking garage, radio advised at 0346 hours that Swedish First
Hill called stating a gunshot wound victim had checked into the emergency room.
Officers went to the hospital to interview the victim and his girlfriend.
Officers observed that they had drove up to the hospital in a blue 2005 Honda
Civic and saw bullet damage on the side of the vehicle. Officers took photos
and uploaded the photos to DEMS. At this point, Officers believed that they
were only victims in the shooting. Officers interviewed S/ and he
provided a recorded statement, which was uploaded to DEMS. Later while I was
writing this report, Officer Holden showed me photos of the vehicle and I saw
that it was a blue Honda Civic. I observed that the center brake light was
covered by some yellow material. I remembered during the call that Officer
Couet had broadcast that one of the shooters had entered a blue Honda Civic
with the center brake light out. I showed the photo to Officer Couet and he
believed the vehicle was the same vehicle he saw on surveillance. Officer
Couet and Maehler went back to the hospital and found the vehicle parked on
Minor Avenue. On the driver's seat they saw an orange puffy jacket, which
appeared to be the same jacket one of the shooters wore in the scene. Around
this time, S/ returned to the vehicle. S/ was described by
Officer Couet as a white male with brown shoulder length hair wearing black
pants and white shoes. Officer Couet was certain that S/ was the same
individual who had been shooting in the garage. Officers informed S/
that his vehicle was going to be impounded to the processing room for evidence.
S/ was furious and stated, "What would you do if you were being shot at
and found a gun on the ground." Because there was no known victims on this
call other than S/ being injured, it was determined that S/ would
be released as Officers positively identified him. Officer Holden later
confirmed his identity through a KCJ Booking photo. The vehicle was impounded
to the processing room for evidence.
3E2 was able to locate the license plate number from Incident
and put the license plate on the call. Approximately three minutes
later at 0402 hours a black Chevy Tahoe with WA Plates and bullet hole

damage was located at 9th and James St. Officers pulled the vehicle over at
6th Avenue and Yesler Way and conducted a high risk vehicle stop.
Suspect/ and Arrested/ were removed from the
vehicle. S/ had been driving, and A/ had been in the passenger
seat. Officers could see in plainview a pistol which was partially shoved
underneath the front passenger floormat. Officers did not enter the vehicle.
A/ was read Miranda at the scene and said he did not want to talk to
officers. Both S/ and A/ were transported back to the East
Precinct. The vehicle was impounded to the processing room for evidence.
S/ was IR'd from the East Precinct. Officers had unhandcuffed A/

and were processing his release when they informed A/ that the vehicle
was going to be impounded and taken to the processing room for evidence.
Officers mentioned that they saw a gun in plain view, and A/ stated,
"That's my gun." A/ was then re-mirandized and stated that he had a
CPL to carry the pistol. He also stated that the gun may have been used
tonight but not by him. Officers ran the CPL and found a WACIC return for
A/ stating "Denied Firearm Applicant." Based on the WACIC return,
A/ is ineligible to possess a firearm. A/ was placed into
custody for Investigation of VUFA. He was transported to KCJ for Investigation
of VUFA. Sergeant Poblocki screened this arrest. A copy of the WACIC return
was submitted to DATA for scanning.
A/Lieutenant Watson had responded to the scene as did Sergeant Poblocki.

A/Lieutenant Watson called the , no reply was heard. Sergeant Poblocki
screened the incident with Detective Nelson from Homicide/Robbery. It was
determined that Officers would process the scene.
In the garage of in the lower level I located 27 shell casings of .45

caliber and 9mm. Most of the casings were located on the east side of the
garage. The loaded .45 caliber magazine was found on the west side of the
parking garage. The groups of casings were approximately 60ft apart from each
other. In the whole incident, four vehicles were damaged. The earlier
referenced black Chevy Tahoe and blue Honda Civic as well as a 1982 white VW
Rabbit with WA Plates and a silver 2006 Nissan Murano SUV with WA
Plates . The VW Rabbit was struck in the windshield and the bullet

appeared to have been lodged in the front passenger seat. The Nissan Murano
was struck on the driver's side bottom corner windshield and no visible bullet
fragment was found. I left business cards with the incident number on both
vehicle windshields.
I took photos of the garage and all the casing, jackets from the ammunition,
the 45 caliber magazine and all vehicles still located inside the garage. Each
casing, magazine and ammunition jacket was labeled, bagged, and photographed.
The evidence was submitted to Park 90/5.
Surveillance is available from The security guard was unable to burn the
surveillance and told me that management can burn the surveillance. There may
also be surveillance at the of vehicles leaving the scene. In
addition, the would have captured Incident , where the
disturbance involving the Chevy Tahoe had been prior to this incident. Felony
alert packets were completed and sent to .
