BARANGAY ORDINANCE NO. 2014-03-02

BARANGAY ORDINANCE ON ECOLOGICAL SOLID WASTE MANAGEMENT

WHEREAS, Barangay Leonarda is keen on its mandate on environmental protection, preservation and
conservation;

WHEREAS, the Solid Waste Management System under Republic Act No. 9003 clearly states the
responsibility of the barangay to its effective and efficient implementation;

WHEREAS, Section 16 of the Local Government Code (RA 7160) also provides:

“SEC. 16. General Welfare – every local government unit shall exercise the powers granted,
those necessarily implied there from, as well as powers necessary, appropriate, or incidental for
its efficient and effective governance, and those which are essential to the promotion of the
general welfare. Within their respective territorial jurisdictions, local government units shall
ensure and supports, among other things…promote health and safety, enhance the right of the
people to a balanced ecology, maintain peace and order, and preserve the comfort and
convenience of their inhabitants”. (Underscoring supplied.)

WHEREAS, unscrupulous and undisciplined waste disposal by households and business establishments
are causes of eyesore, worse, becomes a breeding ground for disease- carrying insects;

WHEREAS, practicing the 3R’s of garbage disposal (Reduce, Reuse, Recycle) helps conserve materials
derived from natural resources, at the same time helping the City Government in reducing the cost of
garbage collection;

NOW THEREFORE, upon recommendation of Punong Barangay Rizalino T. Luyun, duly seconded by
Barangay Kagawad Renato G. Juan,
BE IT ORDAINED BY THE SANGGUNINANG BARANGAY IN A SESSION ASSEMBLED THAT:

Article I

Title of the Ordinance

This Ordinance shall be known as the “Comprehensive Solid Waste Management Ordinance of
Barangay Leonarda”.

Article II

COVERAGE

This Ordinance shall apply to all residential houses, business establishments such as restaurants,
eateries, sari-sari stores, auto –repair shops; institutions like schools, hospitals or clinics, public and
private offices; other forms of establishments within the jurisdiction of Barangay Leonarda City,
Cagayan.

Article III

Authority and Purpose

SECTION 1. Authority. This Ordinance is enacted to implement the provisions of Republic Act. No. 9003
which mandates for the proper segregation and collection of household wastes.

SECTION 2. Purpose. This ordinance is enacted for the following purpose:

a) To regulate the generation of solid waste within the Barangay, and promote sanitary and orderly
system of the same;
b) To promote the general welfare in terms of public, health, safety, peace, and convenience, of
the inhabitants of the Barangay;
c) To minimize the generation of solid wastes by:
i. Encouraging the principle of “reduce, reuse, and recycle” by way of salvaging solid
wastes which may be reutilized for other purposes;
ii. Encouraging backyard composting; and
iii. Encourage everyone to segregate solid wastes which may be sold out to junkyards for
recycling process, thereby providing extra savings for the households.

SECTION 3. Goal. The primary goal of this Ordinance is to help conserve, preserve and protect nature
and our environs.

SECTION 4. Objectives. the objectives of this Ordinance are as follow:

a) To encourage cleanliness in every house and establishment by way of orderly and systematic
ways management;
b) To eliminate garbage which is an eyesore, along streets and open space;
c) To encourage the use of compost; and
d) To help minimize pollution in the air, on water, and also in land.

Article IV
Definition of Terms

SECTION 5. Technical Terms. This section defines the technical terms used in this Ordinances, to wit:

a) Biodegradable (or compostable) – can be reduced into finer particles by microbiological


organisms or enzymes; may be degraded or composed;
b) Biodegradable waste (or biodegradables) –any material which can be compostable, such as fruit
and vegetables peelings, spoiled or leftover foods, fish scales and throwaways, animal entrails
and carcases, corn cobs and sheaths, wt pieces of paper, coconut shells and husks, pet, poultry
livestock manure, garden or grass clippings, sawdust, and many others;
c) Compost – decayed organic material for use as fertilizer;
d) Composting – biological degradation under controlled conditions; the process of making
biodegradables into compost by mixing them with soil, water, additives, and air;
e) Domestic waste- wastes or refuse coming from households;
f) Recyclable wastes- plastic bags, Styrofoam cups and containers, cigarette butts, sanitary
napkins, disposable diapers, drinking straws, medicine bottles, ceramics, poultry feathers, etc;
g) Special wastes- paint and thinners and its containers, spray canisters, used household batteries,
used oil filters, broken tiles, etc; and
h) Bulky wastes- used rubber tires, garden debris, destroyed appliances, broken furniture, beds,
etc.
Article V
Segregation of Wastes

SECTION 6. Mandatory Segregation of Solid Wastes. It shall be mandatory for all households, business
establishments and institutions to property segregate their garbage according to the categories.

SECTION 7. Requirements for the Segregation and Storage of Solid Wastes while awaiting Collection.
Pending collection of garbage, all households’ establishments and institutions shall be guided by the
following:

a.) There shall be a suitable container such as a plastic bag or the like for the ecological
solid waste before these are brought out along the streets or being brought out at
the assigned dumping areas.
b.) There shall be a separate container for each type of waste from all sources:
Provided, That in the case of bulky waste, it will suffice that the same be collected
and placed in a separate and designated area; and
c.) The solid waste container depending on its use shall be properly marked or
identified for on-site collection as follows:

i. Biodegradables/Compostables or “Nabubulok”;
ii. Recyclables or “Di-nabubulok na maaari pang pakinabangan”; and
iii. Residuals & Special Wastes or “Di-nabubulok na ‘di na mapapakinabangan.”

ARTICLE VI

Collection and Disposal

SECTION 8. There shall be a designated dumping area for all households, business establishments and
institutions in the Barangay.

SECTION 9. Time of dumping of ecological solid wastes for collection at the collection sites shall be from
five o’clock to six o’clock in the morning, and only on the specific schedule of collection days by the City
Garbage Collection team.
ARTICLE VII

Penal Provisions

SECTION 10. Prohibited Acts and its Fines and Penalties. The following shall be considered as
prohibited acts in this Ordinance:

a.) Bringing out and dumping of garbage not on collection day and not on proper time, and on
places not designated as dumping area;
b.) Burning of any form of garbage in any area (backyard, school or office grounds, etc.);
c.) Non-segregation of wastes according to category;
d.) Unauthorized removal of recyclable materials intended for collection by duly authorized
persons; and
e.) Non- provisions of labelled or marked receptacles or garbage bins by households, establishment
and institutions.
f.) Fines and penalties for violating this ordinance shall be:

i. First Offense – Warning


ii. Second Offense – Php250.00 fine plus 3 days community service;
iii. Third Offense – Php500.00 fine plus 5 days community service; and
iv. Subsequent offenses – Php1,000.00 fine plus one week community service.
g.) If the offense is committed by a corporation, partnership, or other juridical entity duly organized
in accordance with law, the chief executive or other officer-in-charge shall be liable for the
commission of the offense penalized under this Ordinance.
h.) Violators shall not be given barangay clearances and certifications until he/she has paid and/or
served his/her fines/penalties. Their names also shall be posted at conspicuous places in the
barangay.

SECTION 11. Utilization of Collected Fines. Funds collection from the fines shall be used as follows:

a.) Twenty five percent (25%) shall accrue to the General Fund for appropriations for the next
fiscal year.
b.) Seventy five percent (75%), which shall be called as Ecological Solid Waste Management
(ESWM) Fund, to be used for;
i. Honoraria of Barangay Eco-aides;
ii. Procurement of Materials, Protective Gears and other items necessities for the
implementation of the Ecological Solid Waste Management programs of Barangay
Leonarda;
iii. Capability-building activities, IEC campaigns and MRF;

ARTICLEV III
The Barangay Ecological Solid Waste Management Committee

SECTION 12. The Barangay Ecological Solid Waste Management Committee (BESWMC) shall be
constituted as follows:

a.) Punong Barangay as Chairman;


b.) Members shall include:
i. Barangay Kagawad who is Chair of Environment Committee;
ii. Barangay Kagawad who is Chair of Health and Sanitation;
iii. President of Homeowners Association;
iv. President of Parent- Teachers- Community Association;
v. Representative from the business sector;
vi. Representative from the religious sector;
vii. NGO representative concerned with the environment;
viii. Representative from other pertinent groups.

SECTION 13. The BESWMC shall perform duties and responsibilities in conformity with the provisions of
Republic Act 9003. It shall also formulate plans and programs consistent with that of the City.

Article IX

Miscellaneous Provisions
SECTION 14. Citizen Suits. Any persons may file appropriate civil or criminal action in the Barangay
against any person who violates or fails to comply

SECTION 15. Separability Clause. If any provision of this Ordinance, or the application of such provision
is declared unconstitutional, the remainder of the Ordinance shall not be affected by such declaration.

SECTION 16. Repealing Clause. All existing ordinances and resolutions of Barangay Leonarda found to be
inconsistent herewith are hereby repealed or modified accordingly.

SECTION 17. Effectivity. This ordinance shall take effect in accordance with the provisions of the Local
Government Code of 1991.
