How much is needed and where/how would it be deployed? Ours isn't particularly effective as a frontal barricade without being
anchored deeply (not very heavy)... does ok as a lateral divider or pedestrian cue. Also, it has JPJ Arena painted on it, so we
wouldn't want that in the primary media camera shot, ha.

Gents,

Dave is with Charlottesville Police and they are looking to possibly rent some bike rack on July 8 to help manage the rally
downtown in opposition to the City's decisions on the Civil War statues.

Jason- I thought I had a contact at UVA Athletics that we had used to rent bike rack ages ago before we purchased all of ours. Do
you know who Dave should talk with about that these days? I wasn't sure if 1P1 had their own or if it was all owned by Athletics.

We would handle the request but we may be hosting an event that day ourselves and need all of ours. Thanks for any assistance.

As you know,the IX Art Park has agreed to organize a Community Picnic on July 8, 2017
from 11:30am to 1:30pm to provide the public with an alternative safe space during the
upcoming planned KKK Rally. We will provide live music, tables, chairs, a tent, and games for
kids during the picnic. As previously discussed, we are happy to provide our space at no cost,
but there are other necessary expenses required to pull this event off, and it was not something
that the IX Art Park had originally budgeted for. At last week's press conference, Mayor Signer
and you agreed that the City could contribute between $3,000 and $5,000 towards this event.

Attached you will find our invoice for the Community Picnic on July 8, 2017. The event
will cost us $3,586.02, excluding space and table rental, which we will donate. Please confirm
the City's agreement to fund this amount by signing the attached invoice. A check should be
written to the IX Art Park LLC, P.O. Box 359, Keene, VA 22946. In order to be prepared for July
8, 2017, we need sufficient time to plan and organize the event so we need to ensure that funds
are forthcoming. Please sign the attached invoice to approve our expenditures by end of day
Friday, June 30, 2017, so that we can get the logistics underway.

My apologies for the late notice, but I wanted to send you a notice of a press conference that Chief Thomas, Mr. Jones, and myself would
like to hold tomorrow with members of Council and the community stakeholders involved in the Day of Unity to discuss public safety and
unity before, during, and after July 8. This is being organized late and quickly as Mr. Jones is going out of town for the rest of the week
tomorrow night, and there was just a final stakeholder organizing meeting this morning. Again, my apologies for the late notice.

We will convene at 3:00 p.m. on Tuesday, June 20 (possibly delayed to 3:30 p.m.) at CitySpace. The "run of show" will be the following:
Mr. Jones(3 minutes), Chief Thomas(3 minutes), then City Councilors(2 minutes each), and then representatives from the Clergy Alliance,
the African-American Heritage Center, the Ix Art Park, and the musicians and Pavilion (up to 2 minutes for each organization).

Stakeholders will BRIEFLY speak to the schedule and tentative activities for "Unity Day," which will be organized and promoted under a new
website titled UnityCville. The schedule currently looks roughly like the following:

- 9:00 - 11:00 a.m.: Programming at the African-American Heritage Center, designed with help of Office of Human Rights
- 11:30 a.m. - 1:30 p.m.: Community lunch and pot-luck picnic at Ix Art Parl
- 2:00 p.m. - 5:00 p.m.: Unity Day concert at the Pavilion

Staff and Council and, we hope, stakeholders, will emphasize that these will be alcohol-free, family-friendly events.

Throughout, the goal is to provide an alternative to the hate-filled, opportunistic KKK rally, not to take the bait, and to tell our story rather
than let it be told for us.

Needless to say, these alternative events, and the public policy message of safety and unity, are not intended to prevent anyone from
exercising their free speech rights to protest.

But we will also be emphasizing the message from the Chief on down that our preference is that people avoid engaging with these groups
and taking their bait, and that we are encouraged by these community units events.

The total number of arrests was 22. This is lower than the number I sent you yesterday, as one arrest was double counted initially.

"First andforemost, our primary goal was community safety and protecting the civil liberties of all of our citizens. At the end of
the day, three people were transported to the hospital;2for heat related issues and onefor an alcohol related issue. I was
pleased with the professionalism and commitment of our law enforcement partners as our safety plan was well executed.
Officers traveledfrom near andfar to assist the CPD in maintaining law and order during this difficult endeavor.

Hundreds oflocal citizens rose up in a non-violent protest against the hate that was being spewed in Justice Park. When klan
members arrived, the atmosphere quickly became emotionally charged. Several outside groups made it clear they would become
confrontational; however, we were preparedfor the unrest that occurred near the conclusion of the event which unfortunately
resulted in a number of arrests. Order was quickly restored and our community remains safe.

As is common practice, we will be reviewing the events of the day over the next weeks and months to assess our successes and
shortcomings. We are committed to providing our residents with a strong,safe city to live in and to being a partner to our

Capt. Shifflett reached out to VSP Lt. Cooper about media talking points on our timeline of events, as well as the gas v powder. If
you wouldn't mind sharing these with him?

This is the statement I prepared yesterday in regards to the powder...but it was then decided we would not respond to media
inquiries on the matter further.

Statement on Release of Dispersion Powder


In order to regain the peace and for the safety of the protestors and law enforcement,state police deployed three canisters of
CS dispersion powder. The use of this localized irritant — similar to that of OC (Oleoresin Capsicum)spray — was a mutual
decision made after lengthy discussion and consideration by State Police and the Charlottesville Police Department based on
the following: the city of Charlottesville had declared the remaining several hundred protesters as an "unlawful assembly"
(Code of VA 18.2-406); upon being publicly and repeatedly notified of the unlawful assembly declaration, the crowd still
refused to disperse; and the protesters had become increasingly aggressive and hostile towards law enforcement. The
protesters were also repeatedly cautioned that if they continued to refuse to disperse, then there would be a deployment of
this localized, chemical irritant.

As intended,the deployment of the powder safely and quickly dispersed the protesters from the immediate area. There were
no reported injuries or medical treatment required of the EMS crews on stand-by.

• The City of Charlottesville Police made to the decision to declare the "Unlawful Assembly."

• The 2"d unlawful assembly was declared by the city when a group of protestors converged on the parking garage and
prevented the KKK rally members from exiting the garage. VSP, CPD and ACPD responded to this location to clear the road
and garage driveway of the protesters, so the KKK members could depart. The law enforcement response was to prevent any
protestors from being struck/run over by exiting vehicles and to expedite the departures of the KKK members from the
immediate area.

• As soon as the KKK members exited the garage and were on their way, law enforcement stood down and began walking
back to the park. The crowd of approximately 1,000 protestors did not disperse but instead grew more aggressive towards
law enforcement, both verbally and physically:

o As the law enforcement personnel — VSP, CPD and ACPD — were walking back to the park, a large crowd of protestors
followed along. The protestors continued shouting and chanting at the law enforcement personnel as they made their
way back to the park.

o When two UVA Transit buses arrived by the courts complex to transport VSP personnel back to the Area Office, a
splinter group of protestors mobbed the buses. The crowd continued to mob the buses despite being told to stand
back. One woman who refused to comply with officers' repeated commands to not proceed down the road toward the
buses was taken into custody. As she was being walked to the courthouse for processing, the officers and woman were
mobbed by a significant number of protestors. Being surrounded by the protestors at close range posed a serious
safety issue for the officers and woman taken into custody.

o At one point, a protestor began spraying the troopers on the front line with OC spray.(This was later confirmed
through video and the discovery of a can of OC spray left on the ground.)
• Despite being advised repeatedly to disperse, the crowd continued to get more aggressive towards the law enforcement
personnel staged at the park. As a result, VSP commanders and the CPD Chief and command staff began discussing the need
to deploy tear gas as the best non-physical, non-violent means of dispersing the crowd.
o VSP Tactical Field Force troopers were advised to put on their gas masks, which was done in full view of the
protestors.

o The CPD Deputy Chief made public announcements asking the protestors to disperse or that tear gas would be
deployed. Upon hearing this, the media even began Tweeting the announcement. A couple hundred of the protestors
remained in place, surrounding and some even behind law enforcement when the CPD Deputy Chief gave the signal to
deploy the gas. Three canisters were deployed by the VSP Tactical Team upon the CPD command. The crowd then
quickly dispersed.

o Deployment of the gas prevented physical confrontations with the protestors; safely diffused the situation; quickly
dispersed the crowd; and prevented additional arrests.

o No one was harmed by the gas; nor did anyone exposed to the gas request treatment by EMS personnel on stand-by
for the event.

• VSP made a total of seven arrests:6 for obstruction of justice and 1 for obstruction of free passage.

First Sergeant John Turner and myself were responsible for assigned to the Downtown Mall. Our
responsibility was

However, after the Unlawful Assembly declaration different groups began to splinter off and cause problems at different locations
in and around the Mall. We responded to several locations and I believe we were an effective deterrent as no businesses were
damaged and no one was injured to my knowledge. We were the front line until the TFF could respond if needed. CPD was quick
to respond to our needs and communication between them and VSP was good. Our squad made no arrests and none of our
personnel were injured. We were treated very favorably by local business owners and CPD was proactive in making sure we were
hydrated and fed.

On Sunday our group was assigned to Jason Kessler's press conference. As you know this event was disrupted by unknown
individuals. I believe we would have been better served if we would have formed an interior perimeter between the speaker and
the press and public. Once this event was disrupted our squads blocked off the street until the TFF arrived. Again, none of our
personnel were injured during this event.

CPT Mitchell:

I received direction from CPT Worsham to provide you information regarding fights, encounters and behavior that was observed
regarding the rally on August 12`h. I was the Emancipation Park Zone four supervisor from VSP.
We were in the zone behind the statue and behind the park.

In supervising my zone I observed the following:


1) Upon reporting to my zone I observed several women with clipboards who appeared to be writing down tag numbers and
gathering intelligence regarding the police vehicles and police on scene in my zone. These women appeared to be
associated with the counter protesters and were unfriendly to police on scene.
2) Due to the fact that the sound crew for the protesters were setting up equipment beside my zone,the sound crew asked
me numerous questions about setting up, where they could go, how they could unload their equipment and how they
could later remove their equipment. The sound crew at all times was polite and courteous to the police and Troopers. As
the violence intensified prior to an unlawful assembly being declared the sound crew repeatedly asked me about bringing
their speaker up to the microphone and starting his speech. I relayed the information but was told to delay because an
unlawful assembly was about to be declared due to the increasing violent clashes.
3) The sound crew was told they could not bring their truck into zone four so they gathered 30 people together to unload
sound equipment from the truck on 2nd Street NE north of Jefferson Street. They could not go through Zone 4 so they
walked around the block (carrying flags) up Market Street and up 2nd Street NW by McGuffey Park where Black Lives Matter
members were sighted. A heated argument ensued but no apparent violence occurred, however, apparently some of the
BLM protesters followed the 30 sound crew helpers across a parking lot to 2nd Street NE where a physical confrontation
occurred. I did not witness the confrontation, however, a Charlottesville officer told me that the fight started when some
of the counter-protesters shoved hard one of the 30 carrying the flags. I responded with a to
assist LT Crannis-Curl who had gone with one Trooper to break up the fight. I observed a white male and two white
females with bloodied faces that appeared to be associated with BLM. We rendered aid to the two females who seemed to
be more concerned that they were being arrested. It is my understanding that they were given some medical assistance by
paramedics on the scene but they refused any further treatment and walked back up 2nd Street NE.
4) Shortly before an unlawful assembly was declared I was standing high on the hill by the statue. From this vantage point I
observed smoking canisters that appeared to be CS grenades or smoke grenades being thrown from a crowd at the
intersection of Market Street and 2nd Street NE. The canisters were being thrown by what I understand to be Antifa
members who were mixed in the crowd of counter-protesters. The canisters were thrown into Emancipation Park into the
crowd of permitted protesters. I observed at least two canisters and possibly three thrown into that crowd. I was told by
several of the Troopers closer to that location that they thought CS was being thrown by Antifa. Troopers in this area
started putting on gas masks as a result.
S) After the park was cleared I was later told to report to the intersection of Market Street and 2nd Street NW to disperse a
crowd. I responded with . We were in Class A uniforms with riot helmets on. We formed a
two squad line and moved people out of the roadway on 2nd Street NW. We stopped at the North side of the intersection
facing South on 2nd Street NW. I observed what appeared to be of mobile field force from Charlottesville PD who
lined up facing west on Market Street at that same intersection. We encountered a crowd which originally numbered
approximately 100 people carrying Black Lives Matter signs as well as anti-police signs. We were taunted and insulted by
some of the crowd and approximately 8 people locked arms in front of us facing us across the street. We remained at this
location and eventually the people locking arms grew bored and dispersed. From this location I later observed a group of
men wearing green tactical gear and carrying assault rifles walk east on Market Street up to the line of Charlottesville
mobile field force. The group of 20-30 men then seemed to line up in front of the Charlottesville Police and assume a
stance almost as if they were protecting the police from the crowd that was already at the intersection. Most of the crowd
previously at the intersection had moved up onto the grass on the NW quadrant of this intersection at this point. Many
others had begun to disperse. The green clad armed men were heavily taunted by the counter-protesters but seemed to
be posturing a great deal as if in challenge to the counter-protesters. They then posed and took photos in front of the
Charlottesville Police and then eventually walked south on 2nd Street NW.
6) Troopers stationed at the bike racks at Jefferson Street and 2nd Street NW reported some BLM members and counter-
protesters yelling obscenities at the Troopers. Some of the citizens walking up the street thanked us for being there but
one woman carrying a large baton pointed the baton in the face of one of the Troopers and yelled "Fuck You!" at the
Trooper before walking away. From this location I observed a small group of white males who I had previously seen among
the permitted protesters. One of them appeared to be suffering from chemical agent exposure and was being helped to
walk north on 2nd Street NW by two other white males. I later observed several small groups of men and women carrying
baseball bats and batons,some wearing helmets and one wearing a screen printed t-shirt that had a stick figure hitting
another stick figure over the head with a baton. I identified most of the armed individuals by their signs, clothing and
behavior as Antifa or BLM members. These small groups were walking north or south on 2nd Street NW. Some of them
insulted Troopers as they passed but mostjust walked past or into or out of McGuffey Park.

would like something from each of the Sergeants supervising the squads. This is more about fact finding
and observations than it is about debriefing and making improvements. That is another discussion. I'm
looking for disorders that were broken up, injured that were helped, behaviors observed.The more
specific the better. We are looking to paint the accurate picture of what occurred and add correct context
to the sensationalized media reports. Please let me know if there is anything you can do to help with this.

VSP Tactical Field Force (Delta) platoon was staged at Our objective was

We deployed our assets as planned once the Unlawful Assemble was declared but did not encounter
any resistance. However, we did have some heavily armed individuals try to walk from the mall up 11t
Street. They were stopped and advised an unlawful assembly had been declared and they were subject
to being arrested if they went up there. After a brief moment,they turned and departed south. The
crowds seemed to funnel east and west on Market Street in lieu of 151 Street and 2"d Street. Our platoon
did, at times, confront pockets of crowds on Water St. and South Street West but we did not have any
resistance.

Delta platoon did not deploy any munitions nor did we make any arrest.

Sunday:

Delta platoon staged to be a for the press conference at City Hall.


Our mission at this event was not as clear. We were advised if the crowd got out of hand we would
maneuver around the crowd
Once the press conference started we tried to maneuver into position,
however,the crowd quickly overwhelmed the press conference and the speaker retreated towards 7th
street. The majority of our platoon held the crowd at 71h street. A squad was able to provide security
for the speaker until he was escorted into the PD. One arrest was made for simple assault.

August 12 Casualties: 107 total treated. 39 participants (26 lacerations, 6 broken bones, 3 head trauma,
4 spinal - these include 16 treated at the motor vehicle crash site prior to EMS arrival) 68 police officers,
(61 heat/dehydration, 2 diabetic emergencies, 1 blood pressure, 1 chest pain, 2 lacerations).

August 13 Casualties: 2 total, both Troopers (Kidney Stone, Major Blisters)

Event Totals: 109 treated by VSP Medics (39 protesters, 70 police officers).

As far as participants treated, some were alt right and some were the opposite side, but from our
perspective we only collected whether those treated were police or civilian.

would like something from each of the Sergeants supervising the squads. This is more about fact finding
and observations than it is about debriefing and making improvements. That is another discussion. I'm
looking for disorders that were broken up, injured that were helped, behaviors observed.The more
specific the better. We are looking to paint the accurate picture of what occurred and add correct context
to the sensationalized media reports. Please let me know if there is anything you can do to help with this.

I was responding on a case by case basis with the National Guard Military Police Unit. The first
encounter I had with subjects from both sides of the free speech/protest movement was in front of the
parking garage on Market St. I had just taken the NG unit to Main St. to help our VSP Tactical Field Force
Unit and was returning to my patrol vehicle parked on Market St. with one of the buses. Upon returning
to this location a large contingent of people was unexpectedly moving in me and Trooper May's
direction on Market St. As they approached the parking garage a fight broke out with an estimated
twenty five or more people. Several subjects were knocked to the ground. At the present time there
were only two of us present and we attempted to break up what we could with what seemed like little
response on behalf of the protestors. Several people were yelling at me and Trooper May during this
encounter but I am unable to recall what all was said due to the chaos. There were people with gas
masks,firearms and other weapons such as flag poles or whatever they could use to strike each other.

After this fight had subsided there was a black male sitting up against the building across from the
parking garage holding his head with blood present from being struck with something. Several people
began yelling at Trooper May and I to provide assistance to this gentleman. As I attempted to help,
several black protestors and several white protestors began yelling that they would not let a "white"
police officer help. As I attempted to get to him, two white protestors stepped in my way with some
sort of wooden stick or pole and blocked me from accessing the injured individual. At this point one of
the black protestors stated something similar to "oh shit, it's a white cop, he will shoot your ass so
everyone get your hands up." They then began yelling "hands up, don't shoot." Ultimately they would
not get out of the way until a black officer or medic was present to help.

I was also present at the scene of the crash with the National Guard and Tactical Field Force Unit
attempting to secure the scene when a group of protestors continually cursed all the police and
antagonized law enforcement as much as they could. When the State Police Tactical Field Force opened
Main St. and proceeded to move out several of the protestors followed them up one of the alley streets
in an attempt to still antagonize them into some sort of response.

The front of Emancipation park, from the Robert E. Lee statue to Market street, was split in half
by barricades which in theory was to separate protesters from counter protesters. However, most
counter protesters congregated on Market Street. As protestors would march down market street,
they were met by counter protestors which promoted a lot of the violence. The personnel and
barricades in place deterred violence within zone 2; however mob violence on Market street was a
problem. There were no arrests made within zone 2 as an unlawful assembly was declared before the
event actually started. Once unlawful assembly was declared
Protestors were moved south out of the park
toward Market Street. No zone 2 personnel sustained any injury, utilized force, or made arrests.

I have been thinking a lot about the need to change the narrative and ever increasing fear about the August 12th. event. As with all
things, cooler heads and a methodical approach will prevail. In that vain, I have attached a letter I think we should consider sending
out first thing this week.

Here is the methodology:

1. We send the first letter (attached) out to every group we know or think may be attending this week. We then release it to the
media.
2. Next week we send a letter to the community via facebook and media (I have this one prepared as well). This letter will talk about
the demonstration, projected numbers, road closures, pedestrian closures and the need for assistance from our law enforcement
partners, given the scope of the event and the continued chatter of violence through social media.
3. The following week, several days prior to the event, we release the final letter to the community via facebook and media. This
letter will update the community on resources, road closures, pedestrian traffic etc. But most importantly it will inform the community
of who and who did not commit to nonviolence. At best, all the groups will fill compelled to publically acknowledge their commitment
to nonviolence. At least, we have some commitment we would have otherwise not have. And at worst, we will be informing the
community upfront of the potential violence and with what groups. It could also serve to be very useful in many other regards.

Most certainly the letter should be proofed by the city attorney first. We also should identify policies, case law, de-escalation
tactics etc. and begin documented training right away. Let me know your thoughts!

Most recently our community has found itself as the epicenter for those that seek to oppose an
ideology demonstratively different than others. The belief systems of others, however
fundamentally flawed you may believe they are, are no less protected by our constitutional rights

Such extreme prejudices of belief alone are enough to provoke heightened emotions and a leap
towards a conscience of civil obligation to resist. Most are convicted to serve their community,

such as, sit-ins and other methods of passive resistance. And lastly, some consciously and
purposefully participate in illegal violent acts.

As you discuss and prepare for upcoming demonstrations in our community, I implore you to
consider the words ofReverend Dr. Martin Luther King Jr:

"The principle ofnonviolent resistance seeks to reconcile the truths oftwo opposites —
acquiescence and violence — while avoiding the extremes and immoralities ofboth. The
nonviolent resister agrees with the person who acquiesces that one should not be physically
aggressive toward his opponent.; but he balances the equation by agreeing with the person of
violence that evil must be resisted. He avoids the nonresistance oftheformer and the violent
resistance ofthe latter. With nonviolent resistance, no individual or group need submit to any
wrong, nor need anyone resort to violence in order to right a wrong."

It is my fervent hope that we may boast on this common thread; the desire to live in a community
where the physical wellbeing of our fellow human beings are not threatened by those that would
be void of such a desire.

To advance this commonality between us, I request you commit to my agency and our
community at large, to participate in future demonstrations in a nonviolent and lawful way.
Committing to such, can only serve to strengthen bonds throughout our community and
emotionally disarm those that would delight in provoking you towards violent actions.

Gentlemen,

Tomorrows briefing should be very beneficial for all of us. Here are my thoughts on how we should move
forward (now that the city is back to a manageable status). I know there are several things I am missing.

1. Maybe we should focus on specific things they did at the briefing tomorrow. If this becomes a "what we
should have done or what he or she did not do" we may miss important facts that we need to know now.
An event of this scope may require two or three briefings with each having an intended purpose.

2. Direct each zone commander to immediately brief with their CPD officers and discuss what they did
with respect to intervention. Did they verbally, physically etc. intervene to stop disorders verbal or
physical. Immediately produce a supplement detailing the result of the debrief along with the detail of
where the zone commander deployed their squad through the day and night. We should put a deadline
on this task.

3. Did they witness vsp or national guard intervene? We(CPD) were a very small force on the ground in
comparison to vsp and national guard. How do we get this info from the other forces that were on the
ground? Are they requiring any written documentation from their officers? Can we get this? Did any of
the deputies do anything intervene/arrest? If so, can we get documentation?

4. Have zone commanders review body camera video of their CPD squad members that may have
intervened. We should create a spreadsheet with the information (officer, body camera video, time,
location). Maybe add any vsp and national guard info we can get.

5. We need to get ECC recordings for all channels right away. Can we identify specific traffic to be
transcribed right away?

6. Produce a detailed timeline of events.

7. We need to capture photos of the militia groups and how they resembled the police, specifically
around the park and the market st. Garage.

8. We should go through our calendars and produce a spreadsheet of every meeting and briefing
leading up to the event.

9. Investigations is working on detailed report on all communications with Kessler's group before and
during the event.

10. Memo to file on training and stress training. We still need to get all the arrest information compiled in
one document CPD/vsp/ sheriff dept.

11. 1 think we pull all of this together and produce a brief PowerPoint for the chief. Pictures, audios,
information etc. This can be used for council.

Just wanted to lay this out as a starting point for us. Maybe we should keep our calendars clear for next
week and we find a hiding place to work on this. And by the way, it was and is an honor to serve with
each of you!! What we did and are doing, is historical and unprecedented.

We all are exhausted and frustrated but at the end of the day, we will be the template for many many
departments in the weeks and years to come. We are not trained in urban warfare and that was
essentially the environment these officers were in and we lead. That my friends, was no small task!!

We are naturally concerned about the possibility of an event focused on rallying a response
related to the discussion of the Confederate monuments in the two parks between which CBI is located,
especially since Saturday is the Sabbath for worshippers at CBI.

The CBI leadership is holding for right now on any action, other than notifying you and Agent
Blake, until we have an opportunity to see how this develops and to discuss this further. One option we
will discuss is the possibility of having an off-duty officer in the CBI courtyard during Shabbat services.

Please advise if you feel a position other than "wait and see" is warranted at this time.

No one wants to see this dispute end in tragedy. Yet heavy-handed tactics,
militarized equipment, excess force and an authoritarian approach to law-and-order could
very well set the match to an increasingly volatile situation.

As you know, The Rutherford Institute' has been vocal in warning that the use of
aggressive tactics by police officers establishes a confrontational relationship between
law enforcement and those they are charged with protecting and serving. Too many

communities across the country are suffering the aftershocks that result from police
employing an unwarranted and excessive use offorce in situations that might have been
resolved with less aggressive methods.2

In an effort to avert a similar outcome in Charlottesville, I am urging you to take


steps now to reduce the aggression used by officers in order to foster greater trust and
cooperation with the community.

When police treat citizens as hostile forces and approach encounters anticipating
violence and exercising control through the demonstration and application offorce,
thereby adopting overly aggressive and confrontational tactics, true community
policing—which results by forming partnerships with citizens—cannot be achieved.
Instead, we will find ourselves locked in a vicious cycle of distrust that will only make
the community less safe.

This climate of distrust and heightened tension will only be aggravated by the
arrival of outsiders intent on bringing their unrest and demonstrations to the City.3

For starters, I would caution you against relying on heavy-handed, militarized,


shock-and-awe tactics(swarms of police banging on doors in the middle ofthe night,
SWAT team raids, flashbang devices, etc.)for routine police work,4 which send an
ominous message to the community and could result in the kind oftragedies that we do
not want or need in Charlottesville.

Just recently, for instance, in a gross display offorce, at 12:30 a.m. on June 2,
2017,five Charlottesville police officers and five police cars executed a warrant for a
misdemeanor assault charge against 72-year-old Jeffrey Fogel, a respected local attorney
and candidate for the office of Commonwealth's Attorney, at his residences

This ill-advised show offorce on the part ofthe Charlottesville police was
undertaken in the middle ofthe night despite the fact that Mr. Fogel is well-known within
the community and to the local police, and clearly presented neither a risk offlight nor a
danger to officers. Moreover, even though it is standard practice to advise a person

charged with a minor crime ofthe existence ofthe warrant and allow them to voluntarily
appear on the charge, Charlottesville police chose to personally execute the warrant for
the misdemeanor assault charge in such a manner as to exacerbate an already tumultuous
situation.'

In another ill-advised show offorce, a "phalanx" of police carried out another


late-night arrest of a local activist, again for a minor offense.7 And in yet another
incident, Charlottesville police carried out a SWAT raid accompanied by the use of a
flash-bang grenade against two individuals who were accused of attempting to rob a food
truck with a weapon.

Despite the fact that no money was taken and no one was injured during the
alleged attempted robbery, Charlottesville police mounted a SWAT team raid on the
suspects' home, which is in the middle of a populated urban area. The flash-bang device
which police used to enter the home ignited a fire on a couch in the residence, requiring
the deployment offirefighters to the scene.8 Although the residence suffered $500 in
damages, thankfully, no one was injured as a result ofthe Charlottesville SWAT team's
use of a flash-bang device.9

That is not always the case, however. A few years ago, in Georgia, a SWAT
team—attempting to carry out a faulty "no-knock" search warrant—threw a flash-bang
grenade into a home in which a family with four young children (ages 7, 5, 3 and 18
months)was staying. The grenade landed and detonated in the toddler's pack-and-play
crib, leaving him with severe burns, a collapsed left lung and a lifetime of plastic
surgeries to correct the disfigurement from the burns.10 The suspect the police were
pursuing was later arrested hours after the raid without the need of a "no-knock" warrant
and without the use of a SWAT team.

Five officers and five police cars arrived at Mr. Fogel's residence at 12:30 a.m., and proceeded to bang on
his door, ignoring a doorbell that was available to summon him Mr. Fogel, who was asleep, answered
promptly and agreed to cooperate with his arrest, but was denied permission to change into appropriate
clothing or to bring his keys with him. Although a summons could have been issued in this case, Mr.
Fogel's arrest was ordered by the magistrate in this case because, according to Mr. Fogel, of the way Mr.
Fogel had spoken to police earlier in the evening. As a result of this charge, Mr. Fogel was required to post
a $5000 personal recognizance bond and is forbidden from leaving the state.

The Imminent Lawless Action test provides criteria to determine whether- a speaker's
actions are protected under the First Amendment.
Under the test, a speaker's words are not protected if such words are:

• Directed at inciting an imminent violation of the law


or

• Likely to incite an imminent violation ofthe law

When confronting an individual using threatening or seemingly unlawful speecli, ask yourself:
• Is the speaker advocating art imminent violation of the law?

Speech must be directed at inciting unlawful action, or likely to incite such action, in order
lose protection under the First Amendment.

A speaker telling a rioting crowd to tip over a police car, or beat an indiN idual in the crowd,
is an example ofimminentlawless action, as such directions to injure specific people or
property were likely to be followed.

A statement to antiwar crowd that"We'll take the street later (or again)," as police officers
were trying to clear the street, was not enough to constitute imminentlawless action.

Public sidewalks and streets are traditional public forums, where
protections for speech are very broad. In most cases, they should not be arrested.
Before asking a demonstrator to move or arresting that citizen for trespassing, be sure dmt:
• The demonstrator is not on a public sidewalk, street, park, or other public property open
to pedestrian traffic and free demonstration.

• The property on which the demonstration is taking place is not a public easement.
■ Public easements across private property are common,and speech is protected on
this property.

• The individual has been made aware that he or she is trespassing.
The demonstrator is not trespassing it' lie or she:
• Has permission from the property owner for the activity
• Is on a public easement across private property, or on a public sidewalk, street, or other
public area open for speech
■ This includes sidewalks adjacent to or abutting private or nonpublic property.8
However, demonstrators may be subject to reasonable time, place, and manner restrictions.

S 18.2-405 1 Any unlawful use, by three or more persons acting together, offorce or violence which
seriously jeopardizes the public safety, peace or order is riot. Every person convicted of participating ill any
riot shall be guilty of a Class 1 misdemeanor. If such person carried, at the time of such riot, any firearm of
other deadly or dangerous weapon, he shall be guilty of a Class 5 felony.
