DON’T AVOID MUNICIPAL ELECTIONS : An Appeal by the Forum for Good governance
To effect democratic decentralization by empowering local self governments as third tier of India’s Federation,
the constitution (74th amendment) Act 1992 was passed by Parliament which elevated the status of Municipal
bodies from statutory to constitutional.
In A.P., 92 Municipalities and 11 corporations are completing their term by 29th of September, 2010. As
per Sec. 243-U of the (74th amendment) 1992 Act, an election to renew the municipality shall be completed
before the expiry of its duration. Government of A.P. for the reasons best known to it, is dragging its feet for
conducting elections to Municipalities and Corporations. The reasons cited are about the difficulties in identifying
B.C.’s for reserving the seats and the desire to reserve 50% of the seats to women.
Here, it is to be pointed out that local self government is an exclusive state subject under entry 5 of list
II of the seventh schedule and the state government does not require any clearance from outside. The civil
society organizations feel that government is not interested to conducts election to local bodies in near feature
and intentionally delaying the matter.
Therefore, the civil society organizations demand, in the interests of good governance:
To conduct elections when they are due without postponing and to complete the reservations expeditiously;
To conduct local body elections on Non-party basis;
The C.E.O. of the local body (Mayor / Chairperson of Municipality) must be elected directly.
