Dear Sir(s),

We are appointed as the selling agent for marketing paper lotteries of State
Government of Mizoram vide an agreement dated 29.05.2012, which was
extended from time to time and the last extension of 3 years had been made
effective from 29.05.2015. We are selling the lotteries of the Govt. of Mizoram as
per the terms and conditions of the agreement(s) entered into between the Govt.
of Mizoram and us.

The Govt. of Mizoram has been selling its lotteries in the lottery playing States of
West Bengal, Maharashtra, Punjab, Goa and Sikkim and none of these States have
raised any objection of any kind or nature whatsoever with regard to the lotteries
of the Govt. of Mizoram. Resultantly, the lotteries of the Govt. of Mizoram has
been held to be legal and valid and complaint of the provisions of the Lotteries
Regulation Act, 1998 (for short "Act of 1998") by these lottery playing States. The
lotteries of the Govt. of Mizoram has been selling their lotteries in the lottery
playing States for more than 20 years.

As the selling agent of the lotteries of the Govt. of Mizoram, since 29.5.2012 we are
selling the lotteries of the Govt. of Mizoram in the States of West Bengal and
Maharashtra. There has been no complaint by these States in respect of the
lotteries of the Govt. of Mizoram from 29.5.2012 till date that these lotteries
violates any provisions of the Act of 1998 or the Rules framed thereunder.

It is a known fact since for at least 5-6 years in the lottery trade and is also well
known to the knowledge of the State Governments and the Central Govt. that the
State of Kerala does not permit the sale of lotteries of the other States within its
State and has created a monopoly of its own lotteries in the State of Kerala. It is
only the State of Kerala who wrongly and illegally raises one objection after
another in respect of the lotteries of other States to be sold within its State thereby
creating an absolute monopoly in respect of its own lotteries to be sold within its
State exclusively.

Surprisingly, the Central Govt. has not raised any objection to this illegality
committed by the State of Kerala, although the Central Govt. is the regulatory
authority under the Act of 1998. It is submitted as per the Act of 1998 and the
judgment of the Hon'ble Supreme Court in the matter of B.R. Enterprises, a lottery
playing State cannot prohibit the sale of lotteries within its State so long it is selling
its own lotteries within its State. As such, creation of monopoly by the State of
Kerala in respect of its own lotteries and directly and/or indirectly prohibiting the
lotteries of the other States is illegal, violative of the judgment of the Hon'ble
Supreme Court and is also violative of the federal structure of the Constitution of
India.

It is also a known fact that the lotteries sold by the State of Kerala are sold in the
same manner as sold by the other lottery playing States. For eg. the Govt. of Kerala
also does not receive the entire face value of the tickets sold by it from its agents
but receives the invoice value of such sale i.e. the face value - huge discounts of
approx. 27% to 29%. On a deeper scrutiny, it is evident that the State of Kerala
follows the same procedure in respect of the sale of its lotteries as followed by
other lottery playing State.

Section 3 of the Act of 1998 provides that save as otherwise provided in Section 4
no State Government shall organize, conduct or promote any lottery. Section 4 of
the Act of 1998 provides that the State Govt. may organize, conduct or promote a
lottery subject to the conditions stated in sub-sections (a) to (k) of Section 4 of the
Act of 1998. The obligation to fulfill these conditions is on the Organizing State and
no one else.

As far as we the selling agent is concerned, the State Govt. is selling the tickets
through us as provided in Section 4(c) of the Act of 1998. We cannot fulfill any
conditions, which the Organizing State has to fulfill in respect of its lotteries as the
obligation, and the burden to fulfill the same rests exclusively within the domain

and power of the Organizing State. We as agent are only selling the lotteries of the
State Govt. and cannot either impose or define or adjudicate as to whether the
conditions under Section 4(a) to 4(k) of the Act of 1998.

The power of adjudication does not vest in any lottery playing State as the
same exclusively vests in the Central Govt. under Section 6 of the Act of 1998 read
with Rule 5 of the Central Rules of 2010. Otherwise one State can become the
adjudicator in respect of the lotteries of the other State and prohibit the sale of
lotteries, which is legally and constitutionally impermissible and would adversely
affect Centre-State and State-State relations.

It is submitted that this self-adjudication and self-judgments are being passed by

the Executive of the State of Kerala who being an interested party (as it is selling its
own lotteries and desires to create monopoly) is illegal and void ab-initio. No such
powers have been conferred and/or can be legally conferred in a State by the
Constitution or the Acts or the Rules as it would violate the federal polity.

Surprisingly, in order to stall the sale of lotteries of the other State within its
State, the State of Kerala has been consistently filing FIRs, arresting the agents and
its employees and filing false cases in respect of alleged violation of Section 4 of the
Act of 1998 even prior to the sale of lotteries thereby creating fear and terror in the
minds of the Executive of the other lottery playing States and their agents and their
employees etc. so that no one sells the lotteries of other States in the State of
Kerala in the foreseeable future. Surprisingly, the Centre has chosen to remain a
quiet spectator and take no action as if it is against the north-eastern States and is
siding with the State of Kerala who has no regard for the law of the land.

It is reiterated that the Central Government is the ultimate authority to decide

whether the lottery schemes of a particular state are as per the provisions of the
Central Lottery Act/Rules or not and take action and State Government has no
power to take any action in this regard. The Central Govt. has to consider the
undisputed fact that other lottery playing States have treated the lotteries of the
State of Mizoram as being compliant of the provisions of the Act of 1998.

In the above background, it is submitted that the Govt. of Mizoram desired to sell
its lotteries in the State of Kerala and directed us to be the selling agent for the
same. Accordingly, we had vide lease agreement dated 6.7.2017 took the premises
on rent at Ernakulam, Kerala. Further, we had vide a lease agreement dated
19.7.2017 taken a godown on rent at Palakkad.

By the letter dated 13.7.2017, the Govt. of Mizoram directed its security printer i.e.

lottery tickets from the Draw to be held from 7.8.2017 of Lottery Scheme of
Super Deluxe Monday as per approved Scheme and that the bill for printing
charges should be submitted to the Govt. of Mizoram for payment. Copy of the

letter dated 28.3.2016 of Indian Banks Association and the letter dated 13.7.2017
of the Govt. of Mizoram to its security printer is enclosed herewith and marked "A"
and "B" respectively

The Govt. of Mizoram vide its letter dated 14.7.2017 conveyed its approval in
respect of the sample ticket. Copy of the letter dated 14.7.2017 of the Govt. of
Mizoram is enclosed herewith and marked as "C".

The Govt. of Mizoram wrote a letter dated 19.7.2017 to the Security printer

directing them to deliver the lottery tickets from the Draw to be held from
7.8.2017.

After these directions to the security printers and to us for selling the lotteries of
the Govt. of Mizoram in the State of Kerala and after coming into force the GST Act,
2017, we took the registration under the GST Act, 2017 vide reference no.
AA3207170263949 dated 17.7.2017 in the State of Kerala. Certificate dated
19.7.2017 was issued by the Govt. of Mizoram in this regard. Copy of the certificate
dated 19.7.2017 is enclosed herewith and marked "D".

The Govt. of Mizoram wrote a letter dated 21.7.2017 to the Chief Secretary of the
Govt. of Kerala intimating various facts with regard to the commencement of the
lotteries of the Govt. of Mizoram in Kerala. All requisite info rmati on/documents
were furnished. Copy of the letter dated 21.7.2017 of the Govt. of Mizoram
(without annexures) is enclosed herewith and marked as "E". It is learnt that no
reolv to this letter dated 21.7.2017 had been given by the Govt. of Kerala to the
Govt. of Mizoram. If any adverse reply had been given by the Govt. of Kerala, we
would not have been permitted by the Govt. of Mizoram to initiate the process of
selling lotteries of the Govt. of Mizoram in the State of Kerala.

Thereafter, the Govt. of Mizoram issued a notification dated 24.7.2017 under Rule
3(3) of the Lotteries (Regulation) Rules, 2010 for organizing lotteries in the State of
Kerala wherein it is stated that the revenues generated from the sale proceeds
shall be invested for the welfare of Health care, Education, Public Sanitation and
other Social Sectors for the people. Copy of the notification dated 24.7.2017 is
enclosed herewith and marked as

The copy of this notification dated 24.7.2017 was, inter-alia, endorsed to the
Joint Secretary (CS), Ministry of Home Affairs, New Delhi and the Chief Secretary to
the Govt. of Kerala but, it is learnt, no negative response was received either from
the Joint Secy. (Home) and from the Chief Secy. of Govt. of Kerala till
date.Therfore,It is presumed that there was nothing wrong or adverse in respect of
the lotteries of the Govt. of Mizoram, which were to be sold in the State of Kerala.

The Govt. of Mizoram vide its office order dated 26.7.2017 appointed PU K.O. Ajay
Kumar, Deputy Resident Commissioner, Govt. of Mizoram to receive lottery tickets
on behalf of the Govt. of Mizoram on 26.7.2017 and deliver the same to us. Coiy of

the order dated 26.7.2017 of the Govt. of Mizoram is enclosed herewith and
marked as "G". Consequently, PU K.O. Ajay Kumar received the lottery tickets from
the security printer on 26.7.2017 and delivered the same to us.

18. On 28.7.2017, the Finance Minister of the Govt. of Kerala gave a speech that the
Govt. of Kerala has taken a pledge to keep out the lotteries of the other State Govt.
to be sold within the State of Kerala. Thereafter, 28.7.2017 at about 3 PM a huge
police force came to our godown premises at Palakkad and detained our partner on
the night of 28.7.2017. The Police dismantled the computer and server.

19. Since the night of 28.7.2017 our partner, Mr. Jethmal Mehta, one Mr. T.R. Girish
Kumar and four employees of our firm have been taken into illegal custody. A F.I.R.
No. 0892/2017 has been illegally registered against our firm, our Partners and
employees on 29.7.2017 under Section 7 (3) of the Act of 1998 (when we have no
role in respect of any such alleged violation) and the following items were illegally
seized by the Kerala State Police and with the help of Cyber Cell Officer:-

Murugan Transport Bill - 2 Nos.
NU Tech Delivery Note - 2 Nos.
Delivery Challans for distribution of Mizoram Lotteries
Mizoram State Lotteries in Gunny Bags.
Godown at Palakkad is locked and sealed ,which contains 80 lakhs lottery
tickets for 7 days.
20. It is, however, learnt that these persons are being illegally arrested/detained for
alleged violation of Section 4 of the Act of 1998 when we are not at all responsible
or liable fulfilling the conditions under Section 4 of the Act of 1998. These persons
are still in the illegal custody of the Police. It is evident from the foregoing facts that
we are being harassed for no fault of ours.

21. In fact, the Govt. of Kerala is unleashing a regime of terror and fear in the States of
the Union and its Executive and their agents etc. so that they will not be able to sell
the lotteries of the other State Govt. within the State of Kerala. These acts of the
Govt. of Kerala are illegal and are designed to create monopoly in the Govt. of
Kerala by adopting illegal means and methods, which is detrimental to the State-
State relations.

22. We request the Ministry of Home Affairs, Govt. of India to intervene in the matter
on an Urgent basis so that the relations of the State amongst themselves or the
agents/executives of the State with one and another do not deteriorate and the
agents/employees of the State are not victimized and harassed and made to live in
terror and fear so that they cannot do their business in the State of Kerala when
under law the Govt. of Kerala cannot prohibit such business of the other States.
Our position that the Govt. of Kerala is committing illegalities and exerting pressure
to ensure that they monopolize the business of lotteries is evident from the

The Minister of Finance, Govt. of Kerala has in the face of overwhelming

evidence to show on record that the lotteries conducted by the Govt. of Mizoram is
in accordance with law is misleading the general public alleging the lotteries of
Govt. of Mizoram are not Govt. lotteries.

It is evident from the foregoing, that we as selling agent of the lotteries of the Govt.
of Mizoram had on their instructions initiated the process of selling lotteries on
their behalf in the State of Kerala and had incurred huge expenses in respect
thereof. It is also evident that despite the letter dated 21.7.2017 written by the
Govt. of Mizoram to the Chief Secretary of Govt. of Kerala, no objections were
raised by the Government of Kerala with regard to the commencement of the
selling of lotteries by Govt. of Mizoram through us in the State of Kerala. As such,
we have suffered huge losses and damages etc. on account of no fault of ours.

We further request the Centre to intervene and issue necessary directions to the
Govt. of Kerala under the Constitution so that our people are released from
custody and the Govt. of Kerala is prevented from perpetuating illegalities one
after another on us or the business of the other State Govt. which is to be treated
equally under the Constitution and the Act of 1998 as interpreted by the Hon'ble
Supreme Court.

We request your goodseif to kindly issue necessary directions in the above matter
urgently before the situation is further worsened. In any event, it is our humble
submission that some check has to be imposed by the Central Govt. on the
activities of the Govt. of Kerala in respect of the business of lotteries more
particularly to the illegal modus operandi adopted to prohibit the lotteries of the
other States by the State of Kerala in Kerala.

MIs. NuTech Security Printers printing unit located 23-DLF Industrial Estate, Phase
II, Faridabad 121003, flaryana as a security printer for printing of MICR instruments
for a ftrthcr period of two years from Pt April, 2016 to 31 11 March, 2018. Accordingly,
the recommendation of the above unit will be valid upto 31 11 March, 2018.

The recommendation is subject to the following conditions:

That the unit will continue to have the required Technical infrastructure.
That the unit will continue to maintain the security measures as prescribed by the
Association.
That the Printing of MICR instruments will have infi -astructure to incorporate "CTS-
INDIA' watermark as per CTS Standard in terms of the guidelines issued by the
Reserve Bank of India.
That recommendation accorded is valid only for the unit indicated above and the
rights and privileges under the recommendation shall not be exercised by any other
unit of the same company/firm etc.
That the rejection rate is maintained below 1%.
That the rcconiinendation is without prejudice to the Association's right to review

Sub: Marketing of Mizoram State Lotteries in the State of Kerala.

Ref: GO! letter F.No V17013/2/2O11CSR --- I dated 02.08.2011

Sir,

Kindly refer to the aforesaid letter dated 02.08.20 11 of the Government

of India issuing directions under Section 10 of the lotteries (Regulation)Act, 1998. In
pursuance of the said letter dated 02.08.2011, we are hereby intimating the following:

The Government of Mizoram which has been organizing and selling

lotteries through the Institutional Finance and State Lottery department,
Government of Mizoram, has decided to sell its lotteries in the State of
Kerala and this is advance intimation that the State of Mizoram would
be commencing its sale / marketing of its paper lotteries in the state of
Kerala.

These lotteries would be organized as per the applicable rules and

regulations in due compliance of the lotteries (Regulation) Act, 1998 and
the lotteries (Regulation) Rules, 2010. The Government of Mizoram
ensures that the entire proceeds of the sale of lottery tickets as received
from the distributors would be credited into the Treasury/Public Ledger
Account /Consolidated fund of the Organizing State. It is pertinent to
point out that the collections of the lottery are utilized by the State of
Mizoram towards welfare activities.

The Government of Mizoram has entered into an agreement dated

29.05.20 14 (as per format furnished by the ministry of home affairs,
Government of India being the model agreement issued by the ministry
of home affairs, Government of India vide letter No.V-17013/1/2010-
CSR-1 dated 28.11.2011) with M/s Teesta Distributors, a Partnership
Firm having its office at 1-19(D), Peace Villa, Beside PWD Building,
Tuikhuahtlang, AIZAWL-79600, Mizoram and branch office situated at
No xvii/85, Kaniyampuzha Road Eroor, p.o Tripunithura Ernakularn-
682306. The warehouse is situated at No. 23/332, K.P.D. Building, 1st
Floor, Near Kuridikkad Junction, Pudussery West Village, Behind
Power Best Electricals Pvt. Ltd., Palakkad Taluk, Kerala - 678007. The
Agreement between the Government of Mizoram and Sole Distributor
(Purchaser) is effective from 29.05.2014 to 28.05.2015 and further
extended for a period of 3 year with effect from 29.05.2015. A copy of
the agreement and the letter of extension are enclosed herewith. Thus
M/s Teesta Distributors is entitled to sell Mizoram State Lotteries
through its Agents, Retailers, and Sellers etc. in the State of Kerala.

The Secretary, Finance Department (IF&SL), Government of Mizoram

has been entrusted with the responsibility to carry out the needful and
ensure that all required steps are taken in the State of Kerala.
The tickets sold will be of lottery schemes which have been notified by
the Government of Mizoram in its official gazette. The notification,
which is enclosed, inter alia outlines the purpose, scope, limitation and
methods of the lotteries and carries the following particulars;-
Name of the lottery scheme.
Prizes of lottery tickets.
Total number of tickets printed.
Gross value of the tickets printed.
Name or names of the distributors or selling agents with their
addresses and contact information.
Prize structure.
The amount offered as prize money.
Ii) Periodicity of the draw.
The place where the draw shall be conducted ; and
The procedure for drawing the prize winning tickets or prize winners.

/ (g) The paper lotteries will be printed at Nu-Tech Security Printers, New
/ Delhi 110020 which is a high security press enclosed in the panel of the
Resee Bank of India or the Indian bank Association, Mumbai. A copy
of the accreditation granted by Indian Bank Association is enclosed
herewith. Any change in printing will be informed accordingly.

The State of Mizoram, through subsequent correspondence, will intimate

the particulars of the Government Official / Personnel monitoring the
dispatch and receipt of the lottery tickets.

The State Government of Mizoram ensures that

(a) The total number of lottery draws except bumper draw from all the
lottery schemes put together is less than 24
(b)The minimum prize of the tickets is not less than Rs.2.
(c)The first prize in the notified lottery scheme is not less than Rs.
10,000/-
(d)The draws will not be held on National Holidays.
(e) The result of the draws would be published in one national and two
State level Newspapers out of which one will be in English as well
and also in the official gazette of the Government of Mizoram.

THIRUVANANTHAPURAM: Kerala Finance Minister T M Thomas Isaac today said selling of Mizoram lottery
tickets was illegal in the state.
"Selling of lottery tickets of Mizoram in the state is illegal and it is without getting the states permission,"
Isaac told reporters here.
The government would investigate to find out who was behind the selling of Mizoram tickets by giving
advertisements, he said.
"The lottery (tickets) coming into the state is not the Mizoram lottery, but tickets of lottery king Santiago
Martin," he alleged.
Efforts were on from certain quarters to sell lottery tickets in the state after the GST came into force, he said.
The government has issued notification imposing restrictions on the sale of lottery tickets of other states, he
said.
Meanwhile, the leader of the Opposition in the state assembly, Ramesh Cherinithala alleged that lottery
tickets of other states were coming back to Kerala with the help of CPI-M-Ied LDF government.

Kerala Finance Minister Thomas Isaac claimed yesterday that selling Mizoram lotteries in
the state was illegal and without the government's authorisation.
Isaac added that the government would investigate as to who was advertising the sale of
Mizoram lotteries in the state and indicated that lottery king Santiago Martin seemed to be
behind the move. The government has also issued notification imposing restrictions on the
sale of lottery tickets of other states, he noted.

He also added that after the imposition of the Goods & Services Tax (GST), efforts were on
from various states to sell lotteries in Kerala.

Isaac was instrumental in prevailing upon the GST Council to impose a higher GST rate on
sale of lottery tickets authorised by the state government but sold by private distributors.
According to him, having a 28% rate on lotteries sold by other states through private
distributors would curtail fraud and maipractices associated with the business.
The Kerala government has been vociferous in the sale of other state lotteries within its
territory and has claimed that sale of such lotteries violated many rules. Recently the
Comptroller and Auditor General of India (CAG) also found several irregularities in the
conduct of Mizoram state lotteries.

The CAG report claimed that proceed from sale of lottery tickets worth Rs. n,8o8 crores
was not deposited in the state exchequer from the period 2010-15. The report also pointed
out many other irregularities in the issuance of tenders to private operators to conduct the
lottery draws and the flaws in the revenue share model adopted by the state government.

THIRUVANANTHAPURAM: With reports of plans being made to launch the fvlizoram

state lottery in Kerala without the consent of the state government, finapce minister T M
Thomas isaachas asked the police and tax officials to confiscate the lotteries if they are being
sold in the state.
Terming it as illegal and in violation of the Lotteries (Regulation) Act, Isaac warned that Kerala
state lottery agents found selling such lotteries will lose their registration.
Central government rules mandate that if lotteries from another state in introduced in Kerala, the
government of that state will have to inform the Kerai governmentin writing. Also, such
lotteries can be sold in Kerala only as per the directions under the Act, he said.
"The Ivflzoram government hasn't informed us about the plan. It is learnt that Santiago Martin is
behind the move and the Mizoram government is not involved," said Isaac.
A lottery cannot be sold offering a prize money of 53% of the total sales, and that too after
paying 28% tax. Hence, the Mizoram lottery should be seen as a fraud and their aim is to either
not pay the tax or not to give away the prizes. This was the method they adopted last time they
came into the state, he said.
"The state government cannot ban other state lotteries. But the Centre has promised us to take
action if such lotteries are being sold without following rules. Hence, it has been decided to write
to the Mizoram government first and to the Centre later, informing about the violations," he
added.

As per the Act, the government of the state selling lotteries in another state (in this case, Kerala)
should inform the host state about the marketing arrangements being made and provide details
of the persons or firms involved in selling, distribution and printing of such lotteries.
These should be physically verified by the officials of both the governments.
The details of the unsold lotteries should also be provided. Also, the entire proceeds of the sale
by the distributors or agents should first be credited to the treasury account of the organizing
state government.

"It is clear that the intention in this case is to cheat people. Hence, the police have been told to
nab those found selling the illegal lotteries," said Isaac.

The Kerala government is planning to move the Centre with a plea to ban the sale of Mizoram
lottery in the State, even as the police initiated a crackdown on stocks of the lottery at various
places on Saturday.
Finance Minister T.M. Thomas Isaac told a press conference here that the Mizorarn government
had flouted regulations in its bid to promote the sale of lottery tickets in Kerala. The government,
he said, had failed to furnish information as mandated by Central law.
"A letter received by the Chief Secretaiy on Saturday merely mentioned the list of distributors.
The marketing arrangements and details of the printing, distribution and sale of lotteries were not
revealed. The Mizoram government will be informed that this is unacceptable. Stocking tickets
before completing these formalities constitutes a violation of the law and is hence illegal," he
said.
Dr.Isaac said the police had initiated a crackdown on stocks of Mizoram lotteiy in Kerala. "One
godown at Palakkad has been sealed and steps are on to seize tickets stocked elsewhere," he said.
The Minister said the performance audit on the Mizoram State lotteries conducted by the
Comptroller and Auditor General had revealed several irregularities. "The audit detected flaws in
the agreement between the State and the four distributors, the revenue sharing mechanism, the
design of the tickets and the draw. The letter received by the Chief Secretary states that the sale of
Mizoram lottery in Kerala would be based on the same agreement that cannot stand up to
scrutiny," he said.
Dr. Isaac said the Kerala government would move the Union Home Ministry seeking a ban on the
sale of Mizoram lottery in the State.

The state Finance Minister Thomas Isaac told media on Sunday that Mizoram government had
violated rules regarding the sale of lotteries.
He also alleged that Mizoram has not followed the central law regarding this.
"A letter received by the Chief Secretary on Saturday merely mentioned the list of distributors.
The marketing arrangements and details of the printing, distribution and sale of lotteries were
not revealed. The Mizoram government will be informed that this is unacceptable. Stocking
tickets before completing these formalities constitutes a violation of the law and is hence illegal,"
minister said, reports The Hindu.
He also informed that police started the shutdown of Mizoram lottery centres in the state and
one such centre in Palakkad has been sealed.
The Minister said that an audit conducted by Comptroller and Auditor General had revealed
many irregularities in the state lottery sale.
He pointed out that there were flaws in revenue sharing mechanism, agreement with the
distributors, in design and draw of tickets.
Kerala also rejected the letter sent by Mizoram government on the sale of its lotteries in the
state.
Thomas Isaac said in the press meet that there was not enough information in the letter and it
only mentioned about distribution arrangements while there was no information regarding
sales, printing etc.
"Mizoram is also obliged to provide other details as requested by the state. Agents brought
crores of tickets to the state without completing the formalities. This is illegal and the police
have arrested some persons in Palakkad for possessing the tickets," the Minister said, as

The report also says that the letter to Chief Secretary included a copy of the agreement between
Mizoram Government and Teesta Distributors on the basis of 'minimum guaranteed revenue.'
This is against the Lotteries Regulation Act and the Comptroller and Auditor General (CAG) had
earlier criticised the Mizorarn Lotteries Department for entering into such an agreement.
