PETITION

PETITIONER, through the undersigned counsel, unto the


Honorable Court, most respectfully states that:

1. Petitioner is of legal age, married, and a resident of Bauan


West, Solana, Cagayan where he may be served with notices,
orders and other Court processes;

2. The subject Transfer Certificate of Title No. T-12345 registered


under the name AAA, located in the barrio of Bauan,
Municipality of Solana, Province of Cagayan contains an area
of Fifteen Thousand Six Hundred Forty One (15,641) square
meters; a true Electronic copy of TCT No. T-12345 is hereto
attached and marked as Annex “A”;

3. Sometime in December 31, 1967, petitioner bought a parcel of


subject lot with area of Six Thousand Two Hundred (6,200)
square meters from the registered owner; a verified original
copy of the Deed of Sale of a Portion of a Registered Property is
hereto attached and marked as Annex “B”;

4. The remaining portion of the lot was sold to CCC and to DDD
as shown at the back of the Deed of Sale of a Portion of a

Registered Property; the back portion of the Deed of Sal is
hereto attached and marked as Annex “B-1”;

5. Upon verification, the petitioner came to know that TCT No. T-


12345 has been partially cancelled and a new title was issued
pertaining to the remaining portion with area of Nine
Thousand Four Hundred Forty One (9,441) square meters;

6. In fact on the second page of TCT No. T-12345 hereto attached


and marked as Annex “A-1”, there appeared an encumbrance
showing the partial sale and the issuance of new title TCT No.
T-678910 cancelling and transferring a portion thereof;

7. The new Transfer Certificate of Title No. T-678910 is


registered under the name of EEE and containing an area of
Nine Thousand Four Hundred Forty One (9,441) square
meters; a true Electronic copy of Transfer Certificate of Title
No. T-678910 is hereto attached and marked as Annex “C”;

8. Following the cancellation of TCT no. T- 12345 and the


issuance of new title with TCT No. T-678910 under the name
of EEE, the latter gave to the petitioner the original copy of the
title;

9. The petitioner has always kept the original title at their


residence since 1985 when EEE successfully transferred the
portion she bought in her name;

10. Recently, when petitioner earned enough for the transfer


of title in his name, he discovered that the original title was
not in the folder he used to safe keep his important
documents;

11. Despite earnest and diligent effort and inquiry to search


the same, it proved futile and said duplicate title can no longer
be found which is now considered lost for all intents and
purposes;

12. In view of this, petitioner notified the Register of Deeds of


Cagayan of the loss of said title through a Notice of Loss
hereto attached and marked as Annex “D”;

13. Likewise, by the filing of this Petition, he undertakes to
comply with all the substantive and jurisdictional
requirements as mandated for by law;

14. In closing, petitioner is filing this instant Petition in good


faith and for the sole purpose of praying for the court to order
the Register of Deeds of Cagayan to issue another owner’s
duplicate copy in his favor in lieu of the lost one.

PRAYER

WHEREFORE, it is most respectfully prayed of the Honorable


Court, after due notice and hearing, to GRANT the instant petition
and to ORDER the following:

1. HOLDING and DECLARING the previous owner’s duplicate


copy of Transfer Certificate of Title No. T-12345 LOST and
henceforth without any force and effect whatsoever;

2. For the Register of Deeds of Cagayan to ISSUE a new Owner’s


Duplicate Copy of TCT No. T-12345 to the petitioner with all
the terms and conditions as embodied in the title;

3. Such other reliefs as may be just and equitable under the


premises.
