MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement executed this ____ day of January 2018 in Calapan City,
Oriental Mindoro, by and among:

MRS. ZENAIDA CASTILLO of legal age, with postal address at Ibaba West, Pangasinan, herein
referred to as the FIRST PARTY; and

Lee Garis Dela Cruz, Arnold Dela Cruz, Bessy Dela Cruz, Virgie Rovira, Romelyn Rovira,
Myrna Rovira, all of legal age, married, with postal address at Ibaba West (Pob.) Pangasinan,
herein referred to as the SECOND PARTIES;

WITNESSETH: THAT

WHEREAS, the FIRST PARTY is the daughter of Mr. Emmanuel Dela Cruz (deceased), the
registered claimant/occupant of a parcel of land situated in the City of Dagupan Pangasinan,
bounded and described as follows:

TRANSFER CERTIFICATE OF TITLE NO.T-50278

"IT IS HEREBY CERTIFIED that certain land situated in the City of Dagupan
Pangasian, Phillippines…..bounded and described as follows:

A PARCEL OF LAND (Lot No.173 of the subdivision plan Bsd-04-001808, being


a portion of Lot 166, Cad. 104, ___________, L.R.C. Record No. ).situated in the
Barangay ______________________. Bounded on the S.,along line 1-2 by Lot 166 and
along line 2-3 by Lot 165., on the SW.,along line 3-4 by 174, on the NW, along line 4-
5 by Road Lot 37, and on the NE, along line 5-1 by Lot 172, all of the subdivision
plan.

Beginning at a point marked “1” on plan, being S.86 deg. 47’W., 445.59 m. from
B.B.M. No. 2, Cad-104, ___________………………………………….

Beginning; containing an area of ONE HUNDRED NINETY SIX (196) SQUARE


METERS. All points referred to are indicated on the plan and marked on the ground
by P.S. Cyl. Conc. Mons. 15x60 cm., bearings trye, gate of original survey, Sept. 17-
Oct. 8, 1908 and that of the subdivision survey, Feb. 30March 30, 1987 which was
approved on June 3, 1987,

is registered in accordance will the provisions of the Property Registration Decree in


the name of the City of Dagupan.

WHEREAS the SECOND PARTIES are the sibling, in-laws, niece and nephews of the FIRST
PARTY and they acknowledge the latter’s legal ownership of the above mentioned property by
virtue of the payment made by the FIRST PARTY on behalf of his father who is the registered
claimant/ occupant of above mentioned property;

WHEREAS, the above mentioned property was previously occupied and used by the parents and
the FIRST PARTY when they are still living;

WHEREAS, the registered occupant/ claimant of the above mentioned is already deceased by
the time the award was made by the City of Dagupan, but no one in the family was willing to pay
the gross amount of the land imposed by the City Government which costs Thirty Nine Thousand
Two Hundred Pesos.
WHEREAS, if not for the payment made by the FIRST PARTY, the abovementioned property will
not be awarded to the claimant and will be transferred to other applicants.

WHEREAS, the FIRST PARTY paid the gross amount of the land costs Thirty Nine Thousand
Two Hundred Pesos (P39, 200) as evidenced by OR No. 2761957 dated November 13, 2009
and by a Certification from City Treasury Department .

Whereas, the FIRST PARTY likewise paid the Tax Declaration of said property as evidenced by
OR. No. 9148198, dated January 12, 2018.

NOW, THEREFORE, in consideration of the foregoing premises, the parties hereby agreed as
follows:

That the SECOND PARTY hereby relinquishes all its rights in the above mentioned property in
favor of the FIRST PARTY.

That the SECOND PARTY hereby irrevocably, freely and voluntarily release and forever
discharge the FIRST PARTY his heirs and assigns, from any and all manner of action, sum of
money, damages, liability, responsibility, obligation, claims and demands whatsoever in law or
equity, which they had, now have, or may have against each other, including, but not limited to,
actual, moral, exemplary and all other damages or causes of action provided for under the law,
all of which claims or causes of action by these presents the parties hereby abandon and waive.

That this agreement shall not in any way be construed as an admission on the part of the FIRST
PARTY of any fault, negligence or liability, of whatever kind and nature, in connection with this
MEMORANDUM OF AGREEMENT and WAIVER OF RIGHTS TO PROPERTY.

IN WITNESS WHEREOF, the parties have hereunto set their hand this ____ day of January
2018 in Dagupan City, Pangasinan.
