2. Derogado por el artículo 2, Ley 995 de 2005. Modificado por el art. 27, Ley
789 de 2002. El nuevo texto es el siguiente:
Cuando el contrato de trabajo termine sin que el trabajador hubiere disfrutado
de vacaciones, la compensación de éstas en dinero procederá por año
cumplido de servicio y proporcionalmente por fracción de año, siempre que
este exceda de tres meses. Texto subrayado declarado INEXEQUIBLE por
la Corte Constitucional mediante Sentencia C-019 de2004; el texto en
cursiva fue declarado INEXEQUIBLE por la Corte Constitucional
mediante Sentencia C-035 de 2005.
3. La acumulación puede ser hasta por cuatro (4) años, cuando se trate de
trabajadores técnicos, especializados, de confianza, de manejo o de
extranjeros que presten sus servicios en lugares distintos a los de la
residencia de sus familiares.

11. Las empresas cuyas actividades tengan asiento en Colombia, que estén
interesadas en vincular teletrabajadores, deberán hacerlo con personas
domiciliadas en el territorio nacional, quienes desarrollarán sus labores en
Colombia.
According to the Colombian labor Law, vacations are a mandatory legal rest
to which all workers are entitled. Article 14 of the Labor Code determines that
the rights and guarantees contained in this code are of public order and
therefore are inalienable.
According to the law 1429 of 2010, (which amended Article 20 of the Labor
Code), the employer and workers can agree in writing and by request of the
worker, to be paid in money up to half of the vacation. That is to say that the
other half can not be compensated or fractioned, since it is a right of the
worker to take his vacation consecutively, unless the worker makes a previous
request to the company to take in advance some days of vacation in
exceptional circumstances.
In this law, it is determined that because of the special nature of the work of
teleworkers, the labor provisions that refer to the working day, overtime and
night work are not applied.
For that reason, in my opinion, the work of the company's agents would be
covered by the Labor Code, although the tasks performed are similar to those
of teleworking.
That is to say that labor standards must be followed regarding the working
day, overtime and holidays, which must be enjoyed by the workers
consecutively and as I mentioned above can only be compensated in money
up to half of the days of vacation .
