Congress Street Tucson Arizona 85701 Re: Clerk directed “Judge Shopping” Dear Sir: In reference to you" letter dated December 4, 2013: LR.Civ.P 3.7, in pertinent part, provides for automated, random judge selection. Nevertheless, since Judge Bury was first “assigned” to Worden v Garcia, 4:07-cv- (00664 in 2008, each of my 4 consecutive filings has (eventually) been “assigned to” or ended up in the hands of Judge Bury and his Magistrate Velasco, and were dismissed. Three of their dismissals were appealed; two were reversed and remanded: the first because Judge Bury misapplied the simple doctrine of res judicata, and the second because Judge Bury ruled the complaint failed to state a cause of action (the Ninth Circuit found 5) Now; Judge Bury has been dismissing my cases for nonsensical reasons because he is either Stupid, Senile, or Malfeasant. Frankly | don’t care which. However; please be advised in the coming weeks | intend to file a series of new actions. If through happenstance, or merely “bad Luck” any of these actions are “assigned” to, or end up in the hands of Judges Bury or Velasco, | will (1) file a civil suit against you and the Clerk’s Office for the U.S. District court for conspiracy to violate rule 3.7 and (2) a criminal complaint with the U.S. Attorney for obstruction of justice.
