6 2. This action meets the original jurisdiction requirements of28 USC § 1441(a)
7 and is removable by Defendants pursuant to 28 USC § 1446(a). A case is removable
8 from state to federal court ifthe action could have been originally commenced in federal
9 court. 28 USC § 1441(a); Grubbs v. General Electric Credit Corp., 405 US 699,702
10 (1972). The propriety ofremoval is determined at the time the petition for removal is
11 filed by reference to the plaintiffs complaint filed in state court. La Chemise Lacoste v.
12 Alligator Co., 506 F.2d 339, 343-344 (3d Cir. 1974). When the complaint states a claim
13 invoking the original jurisdiction of the federal comi, the action is removable. [d. Under
14 the Judicial Code, federal district courts have original jurisdiction over all actions
15 brought under 42 USC § 1983. See, 28 USC § 1343(a)(3). Moreover, the Code confers
16 original jurisdiction in the district courts over all actions involving federal questions.
17 See, 28 USC § 1331.
18 3. The gravamen of this action are the federal civil rights claim set forth in the
19 first, second, and fifth causes of action of Plaintiffs Complaint. This claim confers
20 original jurisdiction to this Court.
21 4. State claims are also asserted in the third, fomih, and sixth causes of action of
22 the Complaint. When an action originally filed in state court is removed to federal court,
23 the federal tribunal has jurisdiction to determine not only the federal claims but all
24 pendent state claims which derive "fi-om a common nucleus of operative fact." United
25 Mine Workers v. Gibbs, 383 U.S. 715, 725, 86 S. Ct. 1130, 16 L. Ed. 2d 218 (1966).
26 5. To date the Defendants listed below have been served with Plaintiffs

Wolf was forced to hire counsel to protect his rights and ultimately succeeded in having
2 all of the criminal charges dismissed. Plaintiff Joseph Wolf now brings forth this action
3 to seek damage to compensate him for the unreasonable and unlawful actions of
4 Defendants, and each ofthem.

6 JURISDICTION
7 2. Jurisdiction is confen'ed upon this court by Section 1983, of Title 42,
8 United States Code. Concurrent jurisdiction was granted to this court under Williams vs.
9 Horvath (1976) 16 Cal.3d 834, 837. Also, this Court has jurisdiction to award damages
10 pursuant to Article VI Section 10 of the California Constitution.

13 3. Plaintiff JOSEPH WOLF, at all relevant times herein, was residing in the
14 County of Los Angeles, State of California.
15
16 DEFENDANTS
17 4. At all times herein mentioned, Frank Hernandez ("Hernandez") was a
18 police officer employed by the City of Los Angeles and acting under color of law.
19 5. At all times herein mentioned, B. Grabiak ("Grabiak") was a police officer
20 employed by the City ofLos Angeles and acting under color oflaw.
21 6. At all times herein mentioned, D. Orpin ("Orpin") was a Sergeant
22 employed by the City ofLos Angeles and acting under color oflaw.

At all times herein mentioned, the CITY OF LOS ANGELES, was a
2 governmental entity organized and existing under the laws of the State of California.
3 II. Plaintiff is unaware of the true names and capacities of the Defendants
4 named herein as DOES 1 through 25, inclusive, and therefore sue said Defendants by
5 such fictitious names. Plaintiff will seek leave of court to amend this complaint to allege
6 the true names and capacities of said Defendants when the same are ascertained, Plaintiff
7 is informed and believes and thereon alleges that each of the aforesaid fictitiously named
8 Defendants is responsible in some manner for the happenings and occurrences hereinafter
9 alleged, and the P1ilintiff's damages and i'1iuries as herein alleged were caused by the
10 conduct of said Defendants.
II
12 FACTS
13 12. On or about December 12,2008, at approximately 9:30 a,m" Joseph Wolf,
14 was awakened by the sound of a helicopter circulating above his home. He went outside
I5 to see what was happening and then went back inside to get a sweatshirt, because it was
16 cold outside.
17 13. When he came back outside, he was shot in the leg by Officer Hernandez.
18 In order to cover up the unreasonable use of force that is a bad shooting, allegations were
19 fabricated that Plaintiff was carrying a weapon and pointed it at Officer Hemandez.
20 14. As a result of the false charges and accusations, Plaintiff was arrested for
21 assault with a deadiy weapon on a peace officer and remained in custody until December
22 IS, 2008 when he was able to bail out ofjail. Criminal charges for assault with a deadly
23 weapon and exhibiting a fireaim in the presence of an officer were sought against hinl by
.'~4 the Los Angeles District Attorney's office based upon information provided to the
J?5 District Attorney from Defendants, which contained false statements and/or had material

\26 omissions in the presentation to the District Attorney's office.
(~7 IS. All criminal charges were finally dismissed against Plaintiff on July 31,
28 2009 on a Motion by the People.

.. ,23 21. Plaintiff has a constitutional right to be free from the use of excessive force
:24 by law enforcement officers. The shooting of Plaintiff was unnecessary and excessive.
li1 5 22. Therefore, the individual Defendants, and each of them, are liable to

{~7 23. In acting as alleged herein, Defendants, and each of them, caused Plaintiff
28 severe physical and emotional injuries, as well as other damages, including attorney fees

I in the underlying criminal matter, all in an amount to be determined at the time of triaL
2 24. Due to the conduct ofDefendants, and each of them, Plaintiffhas been
3 required to incur attorneys' fees and will continue to incur attorneys' fees, all to Plaintiff's
4 damage in a sum to be proved at trial and recoverable pursuant to 42 U.S.C. §1988.
5 25. The individual defendants acted with a conscious disregard of Plaintiff's
6 rights conferred upon him by Section 1983, Title 42 of the United States Code, the Fourth
7 Amendment to the United States Constitution and California Civil Code Section 3333, by
8 virtue of intentionally shooting Plaintiff and then covering up a bad shooting and causing
9 the arrest of Plaintiff and the filing of criminal charges against him. Defendants, and
10 each of them, had an interest in seeing Plaintiff charges with criminal conduct to detract
II from Defendants' bad conduct and unreasonable shooting. Such conduct constitutes
12 malice, oppression and/or fraud under California Civil Code Section 3294, entitling
13 Plaintiff to punitive damages against the individual Defendants in an amount suitable to
14 punish and set an example of said Defendant.

4 investigations of police misconduct such that future violations do nbt occur.
5 29. Plaintiff is informed and believes, and thereon alleges, that the customs and
6 policies were the moving force behind the violations of Plaintiffs rights, Based upon the
7 principles set forth in Monell v. New York City Dept, ofSocial Services, the City ofLos
8 Angeles and Does II through 20 are liable for all of the injuries sustained by Plaintiff as
9 set forth above.
10 30. In acting as alleged herein, Defendants, and each of them, caused Plaintiff
II severe physical and emotional injuries, and caused Plaintiff other damages, including
12 incurring attorney fees in the underlying criminal case, all in an amount to be determined
13 at the time oftrial.
14 31. Due to the conduct of Defendants, and each of them, Plaintiff has been
15 required to incur attorneys' fees and will continue to incur attorneys' fees, all to Plaintiffs'
16 damage in a sum to be proved at trial and recoverable pursuant to 42 U.S.C, §1988.

18 THIRD CAUSE OF ACTION

2 36. Plaintiff filed timely claim pursuant to Cal. Government Code §910 et. seq.
3 The claim having been rejected within the past six months, this action is timely.

5 FIFTH CAUSE OF ACTION
6 (Violation of Civil Code §52.1 by Plaintiff against all Defendants)
7 37. Plaintiffrealleges and incorporates paragraphs 1 through 15,33,34,35 and
8 36 and incorporates the same as though fully set forth hereinafter.
9 38. The conduct of Defendants constituted interference by threats,
10 intimidation, or coercion, or attempted interference, with the exercise ofenjoyment by
11 Joseph Wolf of rights secured by the Constitution oflaws of the United States, or secured
12 by the Constitution or laws of the State of Califomia, including interference with his right
13 to be secure in his person and free from the use ofexcessive force under the Fourth
14 Amendment and Cal. Const. Art. I sec. 13 as well as Cal. Civ.Code § 43, and the right of
15 protection from bodily restraint and hann and a bad faith prosecution.
16 39. As a direct cause ofDefendants' conduct, Wolfs rights pursuant to
17 California Civil Code §52.1 were violated, causing injuries and damages in an amount to
18 be proved at the time of trial.
19 40. Due to the conduct ofDefendants, and each of them, Plaiutiffhas been
20 required to incur attorneys' fees and will continue to incur attorneys' fees, and pursuant
21 to California Civil Code § 52.1 are entitled to recovery of said fees.

3 43. As a direct cause of Defendants' conduct, Wolfhas been injured and
4 damages s in an amount to be proved at the time of trial.
5 44. Hernandez acted with a conscious disregard of Plaintiffs rights and safety
6 and shot him intentionally and unnecessarily. Such conduct constitutes malice,
7 oppression and/or fraud under California Civil Code Section 3294, entitling Plaintiff to
8 punitive damages against Defendant Hernandez in an amount suitable to punish and set
9 an example of said Defendant

12 WHEREFORE, Plaintiff prays for jUdgment against Defendants, and each of them,
13 as follows:
14 1. For general damages in an amount according to proof;

16 3. For punitive damages against the individual officers, in an amount
