APPLICATION FOR PROBATION

ACCUSED ____________________ respectfully applies to the Honorable Court

for probation under the provisions of Presidential Decree No. 968 as amended.

Accused respectfully states that:

1. In the Decision dated ________________, he was convicted of the crime of

Serious Physical Injuries and sentenced to suffer the indeterminate sentence
from the maximum term of imprisonment of one (1) year, eight (8) months
and twenty (20) days to the minimum term of two (2) months and one (1)
day.

2. The crime for which the accused was convicted is not an offense against
national security or public order;

3. Accused has not been previously convicted by final judgment of any offense
punishable by imprisonment of not less than one month and one day
and/or fine of not less than two hundred pesos;

4. Accused has not been once placed on probation under the provisions
of Presidential Decree No. 968, otherwise known as the Probation Law of
1976, as amended;

5. Accused has all the qualifications and none of the disqualifications to avail of
the benefits of the Probation Law.

6. Accused is a resident of __________________________, Metro Manila. He

is a dutiful father of limited means who must continue to provide for his
family in Metro Manila. It will be very difficult for him to regularly report to
the Probation Office of ____________________ and likewise meet his
family responsibilities.
7. For these reasons, he prays that he be granted probation in due course, and
that he be allowed to report to the Probation Office in _________________.

WHEREFORE, premises considered, it is most respectfully prayed that:

1. Accused’s Application for Probation be referred to the appropriate Parole

and Probation Officer for the requisite post-sentence investigation and
thereafter,

2. Accused’s application for probation be approved.

3. Accused be allowed to regularly report to the Probation Office of

4. Such other reliefs as are just and appropriate are likewise prayed for.
