necessary, whether the court of appeals erred by adopting an
interpretation that renders a portion of the statute meaningless.

Whether, if reversal is required, the appropriate remedy is to remand


the case for a new trial based on instructional error.

Does the fact that a case involves deception-related charges make it


permissible for a prosecutor to insist to a jury no fewer than thirty
names that a defendant “lied,” and to argue that she is a “con
artist,” notwithstanding the court’s clear precedent sharply
disapproving of this inflammatory language.

The judgment of the Colorado Court of Appeals is vacated. The case is


remanded to the Colorado Court of Appeals for reconsideration in light
of Wend v. People, 235 P.3d 1089 (Colo. 2010). EN BANC.

pursuant to a “bare bones” warrant affidavit.
