CITY ORDINANCE NO. 2011-024

AN ORDINANCE PROHIBITING THE CUTTING, DESTROYING OR

IMPAIRING OF PLANTED TREES, SHRUBS, PALMS AND ORNAMENTAL
PLANTS ALONG PUBLIC ROADS, PLAZAS, PARKS OR IN ANY
OTHER PUBLIC GROUND

BE IT ORDAINED, by the 2nd Sangguniang Panlungsod of the City of

Cabadbaran, Agusan del Norte, in its 53rd Regular Session assembled, that:

SECTION 1. TITLE. This Ordinance shall be known as, "No Destroying

of Planted Trees and Ornamental Plants In All Public Places Ordinance”.

SECTION 2. DEFINITION OF TERMS. The terms used in this

Ordinance shall mean:

a. Cutting - the separation of a physical part or a portion of a physical

part of the trees, shrubs, palms and ornamental plants into two (2)
portions through the application of an acutely directed force;
b. Injuring - a damage or harm caused to the trees, shrubs, palms and
ornamental plants;
c. Impairing - to diminish the value of the trees, shrubs, palms and
ornamental plants,
d. Destroying - to ruin, to kill or to put an end to the existence of the
trees, shrubs, palms and ornamental plants.

SECTION 3. For the purpose of implementing this ordinance a Committee

on the Protection of Trees, Shrubs, Palms and Ornamental Plants in the City of
Cabadbaran is hereby created which is composed of the following:

Chairman - City Environment and Natural Resources Officer

Vice Chairman - City Engineer
Members - SP Chair - Committee on Environment & Natural Res.
SP Chair - Committee on Tourism
ABC President
Chief of Police
One Representative from NGO (to be designated by
the City Mayor)

SECTION 4. FUNCTIONS OF THE COMMITTEE ON THE PROTECTION

OF TREES, SHRUBS, PALMS AND ORNAMENTAL PLANTS IN THE CITY
OF CABADBARAN:

1. To formulate policies and guidelines for the proper implementation

of this ordinance;
2. To recommend to the Department of Environment and Natural
Resources (DENR) application for permit to cut trees under their
watch and to the Philippine Coconut Authority (PCA) with regards to
coconut trees;
3. To receive and accept complaints of unscrupulous cutting of trees,
shrubs, palms and ornamental plants within the territorial
jurisdiction of Cabadbaran City;
4. To conduct investigation of the complaints;
5. To prepare and submit reports of the said complaints to the City
Mayor with the corresponding recommendation for their final
action; and
6. To lead in the conduct of information dissemination to the different
barangays in the City of Cabadbaran.

SECTION 5. PROHIBITION. No cutting, destroying or injuring of planted

trees, shrubs, palms and ornamental plants along public roads, in plazas,
parks or in any other public ground shall be permitted except when necessary
for public safety, infrastructure development , enhancement of its and/or upon
the recommendation of the Committee.

The cutting, destroying, or pruning shall be under the supervision of the

Committee subject to the provisions of the Civil Code of the Philippines on
property relation.

SECTION 6. PENALTY CLAUSE. There shall be a penalty for any violation

committed of this Ordinance as follows:

First Offense - a fine of P 1,000.00

Second Offense - a fine of 1,500.00
Third Offense - a fine of 2,000.00

SECTION 7. SEPARABILITY CLAUSE. If any part or portion of this

Ordinance is declared illegal or unconstitutional, the rest of the provisions
not affected thereby shall remain in full force and effect.

SECTION 8. REPEALING CLAUSE. Any ordinance or regulation inconsistent

therewith is hereby deemed modified or amended accordingly.

SECTION 9. EFFECTIVITY CLAUSE. This Ordinance shall take effect upon

approval.
