MANIFESTATION OF DEATH OF ACCUSED

AND MOTION FOR THE RELEASE OF CASH BAIL BONDS

Defendant’s counsel, unto this Honorable Court, most respectfully

manifests that herein Accused Arnel Lequin y Baring died on July 9, 2017
and moves for the release of his Bail Bond in the above-captioned case,
alleging as follows:

1. That the herein Defendant has posted Cash Bail Bonds for a
total amount of One Hundred Fifty Thousand Pesos (₱150,000.00) for
his provisional liberty during the pendency of the above-captioned case,
as evidenced by Official Receipt Nos. 1519302 and 1519303, both dated
July 14, 2016, copies of which are hereto attached as Annexes "A" and
“B”, respectively, and made an integral part hereof;

2. That on July 9, 2017, Accused Arnel Lequin y Baring died in

Ormoc Doctors’ Hospital, Ormoc City, Leyte, of Herniation Syndrome
Cerebral Edema. A copy of his Certificate of Death is hereto attached as
Annex “C”;

3. That according to Article 89 of the Revised Penal Code of the

Philippines, death of accused extinguishes criminal liability.

PRAYER

WHEREFORE, in view of the foregoing, Accused’s counsel most

respectfully prays for the termination of this case on account of Accused’
death and the corresponding release of his Cash Bail Bonds amounting to
a total of ₱150,000.00.

Other relief just and equitable are likewise prayed for.
