APPEARANCE AND MOTION

Comes now the undersigned, counsel of the accused, unto this
Honorable Court most respectfully states:
1) That the undersigned is formally entering his appearance as
counsel for the accused in the above-entitled case for all legal
purposes;
2) That on March 26, 2018 the accused received an ORDER from
this Honorable Court setting the Arraignment and Pre-Trial on
April 11, 2018 at 1:30 in the afternoon;
3) The above-mentioned ORDER likewise required the accused to
submit a Pre-Trial Brief ten (10) days before the schedule
arraignment and pre-trial;
4) The professional services of the counsel was hired only today
and he would need
5) That due to oversight, the accused failed to notify this Honorable
Court that Azure Pacific Trading Company, Inc. had already
closed shop but the accused still continues to hold office at
adjoining premises c/o Sbarro, Iloilo Fishing Port Complex,
Tanza, Iloilo City;

3). That the accused begs this Honorable Court’s indulgence and
understanding since his failure to appear for his arraignment last
October 8, 2003 was due to the above cause which prevented him to
be informed of the above-scheduled arraignment and for no other
reason for which he is sorry and assures this Honorable Court that that
such failure will never be repeated again.

4). That tentatively the arraignment of the accused has been

scheduled on 26 November 2003 at 8:30 A.M. to which the accused
informs the court that he will be still out of town on that date, hence
he most respectfully suggests that said arraignment will be scheduled
instead on the following day of 27 November 2003 at 9:00 o’clock in
the morning.

PRAYER
WHEREFORE, premise considered it is most respectfully prayed
that the order of this Court dated 8 October 2003 be reconsidered and
the Warrant issued for the arrest of the accused be recalled, and, the
arraignment of the accused scheduled on 26 November 2003 be
transferred to 27 November 2003 at 9:00 o’clock in the morning.

Other reliefs just and equitable under the premises are likewise
prayed for.
