Question:

Zali and Zalina were married in 2005 while studying at IIUM. The graduated in 2006 with
LL.B and Zali was called to the Malaysian Bar sometime in 2007. They started an online
business immediately after completing their studies. Zalina continues with the online business
while Zali decided to open his own legal firm. He concentrates more on syariah cases. They
settled down in Ipoh, Perak.

They had purchased one low-cost unit of apartment in Ipoh where they are staying. No strata
title has been issued for the apartment. Besides that they also owned the semi-detached house
in Taiping, Perak. All these properties are registered under both of their name.

There is one unit of double storey shop lot at Teluk Intan, Perak. The property is registered
under Zali’s name.

Besides that Zali inherited from his late father undivided shares of five acres of rubber estate
land with his two other sisters. The land is located in Manjung, Perak.

Zali has a current account at Bank Muamalat where the amount is RM100,000 and he has
shares at the ASN for RM50,000. They have three cars and since Zalina does not have a
driving license, all cars are registered under the name of Zali. (MyV, 2004)

Zali passed away without a will in 2017. They have five children; Ahmad (20), Aminah (18),
Abdullah (16), Aishah (14) and Aida (12). Zali has a mother and two elder sisters.

(a) Based on the above facts you are to advise Madam Zalina on the distribution of the estate
of his late husband, Zali. Prepare a written advice. (15 marks).

(b) Assuming you are the person (not as a lawyer) who will make the application for the
distribution of Zali’s estate. You have to file necessary forms and relevant documents. You
will appear before the respective authority for this purpose. (10 marks)
