STATEMENT OF PROBABLE CAUSE 5/11/2018 03:43:33 PM

The Complainant states that the following facts establish probable cause:
 
On or about April 29, 2018, at approximately 11:06 p.m., deputies with the Scott County Sheriff’s Office
were dispatched to the intersection of 185th Street East and Hobby Hills Trail in Credit River Township,
Scott County, Minnesota, on a report that an 18-year-old male on a motorcycle had just been struck by an
unknown vehicle that continued driving and did not stop at the scene of the accident. Deputies arrived on
scene and made contact with G.L.S. (Victim), who requested a rag to wipe the blood on his arms. Victim
was wearing jeans, a leather jacket, and a full-face helmet at the time the vehicle crashed into him. It was
later determined that Victim had sustained a fractured wrist, as well as many scrapes and gashes, as a
result of sliding on the road after being hit by vehicle. Deputies observed that Victim’s motorcycle had
sustained extensive rear-end damage and there were no tire skid marks leading to the area where the
collision took place. Deputies located a piece of blue plastic lodged in the motorcycle’s rear wheel well that
was later identified as belonging to a 1999 Honda Accord. Victim told deputies that he was not involved in
any sort of road rage incident. He stated that he saw headlights behind him in his side-view mirror, the
lights disappeared for a moment, then they came back on and he was rear-ended. Victim was taken to
Fairview Ridges Hospital, where he was treated for his injuries. 

Detective Schultz with the Scott County Sheriff’s Office spoke with Victim on May 2, 2018. Victim stated
that on April 29th he had left his friend’s home in Lakeville around 10:45 or 11:00 p.m. on his motorcycle.
Victim first noticed the vehicle in question when it entered a roundabout and proceeded North behind him
on Kenrick Avenue. Victim did not notice anything suspicious about this vehicle at the time, and it remained
about 4 to 5 car lengths behind him. Victim did think it was strange that the vehicle continued to remain
behind him, even while he was driving under the speed limit. The vehicle continued to follow him onto 185th
Street West past Judicial Road, traveling approximately 55 MPH. At this point, Victim noticed that he no
longer saw the vehicle’s headlights. Victim assumed that the vehicle had turned off onto Judicial Road.
Shortly thereafter, the headlights appeared behind him. Victim then heard the loud noise of the vehicle
revving its engine as though it was accelerating rapidly. He was then struck from behind and slid down the
road. The vehicle drove away. 

Detective Schultz identified the registered owner of the vehicle matching the blue plastic piece found
lodged in Victim’s motorcycle. The registered owner said that he sold the Accord on April 24, 2018, to a
man identified as TIMOTHY LEE BIBY [D.O.B. 11/21/1972 (Defendant)]. 

On May 4th, Scott County detectives went to Defendant’s residence in St. Paul and observed a 1999 blue
Honda Accord with front-end damage parked outside. The damage on the front of the Accord was
consistent with the piece that was found lodged in Victim’s motorcycle. A male smoking a cigarette outside
the residence acknowledged that he was Defendant. Defendant agreed to allow the detectives inside his
home to talk. Defendant stated that he had bought the Accord on the 24th or 25th of April and that he is the
only driver of the vehicle. Defendant stated that on April 29th he worked until approximately 10:00 p.m. and
came straight home. Defendant stated that he did not give anyone else permission to drive the Accord,
and he had the only keys for the car on him the whole night. When asked about the front-end damage on
the car, Defendant initially stated that it was already present when he purchased the car. When the
detectives asked Defendant to explain why a piece of his car was found at the scene of an accident on
April 29th, Defendant indicated that he no longer wanted to speak to them. 

Later that night, Detective Schultz received a phone call from Defendant’s ex-wife, A.B., who stated that
she had received correspondence from Defendant indicating that he may have been involved in the hit and

run with Victim. A.B. provided Detective Schultz with a letter that she recognized as written in Defendant’s

handwriting. The letter stated in part: 

I tried to kill your boyfriend. I was going to the casino and decided to drive by the condo. It’s the first time
I’ve ever done that. I was hoping you would be outside with Jax. I saw a guy leave on a bike and I lost it…
Anyway, I hit him with my car. Turns out he was a high school kid. I hurt an innocent kid. I can’t live like this.
Hey, at least I finally quit smoking… 

A.B. advised that “Jax” is her dog. A.B. stated that she believed Defendant probably learned that her
current boyfriend rides a motorcycle from Facebook. There is currently a Domestic Abuse No Contact
Order in place prohibiting Defendant from having contact with A.B. 

Defendant was subsequently arrested, and admitted to investigators that he wrote the letter.

Defendant is described as 45-year-old white male, approximately 5’11” weighing 165 lbs., with brown
eyes.

otherwise be issued by the Court.
