CHAPTER 12
MARKET CODE

TITLE I
THE MARKET CODE
OF SAN CARLOS CITY, PANGASINAN1

ARTICLE 1
GENERAL PROVISIONS

Section 1. Title – This Ordinance shall be known and cited as “THE MARKET CODE OF
SAN CARLOS CITY, PANGASINAN”.

Section 2. Applicability – This Ordinance provides for the rules that govern the administration
of the public market of the City of San Carlos, including the adjudication of vacant and newly
created stalls therein the levy, assessment and the collection of market fees, in accordance with
rules and regulations promulgated by competent authority.

ARTICLE 2
DEFINITION OF TERMS
Section 1. Definition Of Terms – as used in this Ordinance, the following terms shall mean:
a) Agricultural products – includes the yield of the soil such as corn, rice, wheat, rye, hay,
coconuts, sugarcane, tobacco, root crops, vegetable, fruits, flowers and their by-products,
ordinary salt, all kinds of fish poultry, and livestock and animal products, whether in their
original form or not.
b) Ambulant/Transient/Itinerant vendors – refers to vendors or sellers who do not
permanently occupy a definite place in the market but those who comes either daily or
occasionally to sell their goods. Those who are plying their trade within the vicinity of
the market in search of buyers.
c) Bañera – shall be understood to mean that container made of welded GI sheets, Big, if
the diameter is 16 inches and 10 inches in height; small, if the diameter is 10 inches and
10 inches in height
d) Basket - shall refer to that kind made of bamboo rattan splits or buko (bulo) splits
e) Bayong – refers to any container made of woven silag leaves.
f) Bladed Instrument – refer to any sharp pointed implement used in the market to cut,
strip or otherwise mutilate animal carcasses. The term includes butcher knife, kitchen
knife, cutting blade, sharpening torque otherwise known as “panghasa”, and similar
instruments.
g) Bundle – shall be understood as follows:
1) Large – if the diameter is more than one foot
2) Medium –if the diameter is one foot
3) Small –if the diameter is less than one foot
h) Butcher – refers to any person engaged in slaughtering pigs, beef, poultry, and other
livestocks.
i) Can – shall refer to an empty kerosene can with a capacity of 19 liters.
j) Carinderia or turo-turo – refers to any public eating place within the market zone where
foods already cooked are served at a price.
k) Charges – refers to pecuniary liability as rents or fee against property or persons.

l) Dealer – means one whose business is to buy and sell merchandise, goods and chattels,
as a merchant. He conducts his business as a middleman between the producer and the
consumer and depends for his profits not upon labor he bestows upon his commodities
but upon his skill and foresight with which he watches the market trends.
m) Furniture – refers to any movable article which includes among others, tables, chairs,
and benches, for use in the public market
n) Government owned and/or operated public market – means those established by
public funds, leased or acquired by any other mode or means from persons, and operated
by the government.
o) Lessee/Lessee Operator – include the owner, manager, administrator, or any other
person who operates or is responsible for the operation of business establishment or
undertaking
p) Market Committee – refers to the body whose duty is to conduct the drawing of lots and
opening of bids in connection with the adjudication of vacant or newly-constructed stalls
or booths in the San Carlos City Public Market/s and to certify to the City Mayor, as the
case maybe, the results thereof.
q) Market Premises – refers to any open space in the market compound, part of the market
lot consisting of bare grounds not covered by market buildings usually occupied by
transient vendors especially during market days.
r) Market Stall – refers to any allotted stand, space, compartment, store or any place
wherein merchandise is sold, offered for sale, or intended for such purposes in the public
market.
s) Market Section - refers to the classification of a group of continuous stalls in markets
according to the kind of merchandise offered for sale therein.
t) Market Vendor – refers to any person, engaged in business at any public or private
market in the City of San Carlos in Pangasinan.
u) Market Vendors with stalls – mean vendors who sell their merchandise in one or more
permanent stalls within a public or private market building or buildings.
v) Market Vendors without Stalls – refer to vendors who conduct their trade outside but
within the vicinity of market building or buildings. They include vendors who display
their goods on carts, tables or other portable structures.
w) Operator –includes the owner, manager, administrator, or any other person who operates
or is responsible for the operation of a business establishment or undertaking.
x) Peddler – means any person, who, either for himself or another, sells his goods or offers
to sell and deliver the same from place to place. He usually does not have fixed stall.
y) Person – means every physical or moral, real, or juridical and legal being, susceptible of
rights and obligations or of being the subject of legal relations.
z) Public Market – refers to any public place, building or structure of any kind designated
as such by the council where people, meet and conduct commercial activities, such as
buying and selling of commodities except public streets, plazas, squares and the like. It is
a public place where the act of buying and selling takes place.
aa) Registered Vendors – are vendors who are registered in the city where they reside or
where they are vending or intend to vend.
bb) Rental – means the value or the consideration, whether in money or otherwise, given for
the enjoyment or use of a thing.
cc) Sack – (locally known as sako) shall be understood to refer to one with a capacity of
twenty five gantas.
dd) Stall – refers to any allotted spaces or booths in the public market where merchandise of
any kind is sold or offered for sale.
ee) Stallholder – refers to the awardee of a definite space within a public market who pays
rentals thereon for the purpose of selling his/her goods/ commodities or services.
ff) Street vendors – refer to vendors who sell their merchandise on streets, Sidewalks, and
other public areas other than markets.
gg) Tiklis – shall mean that container made of woven bamboo or rattan splits and it is either
large, medium, or small.

hh) Trader – refers to any person, whether duly licensed or not, engaged in the business of
selling foodstuffs, goods or any item, being old for a price based proportionately to its
weight. The term shall include sidewalk and Talipapa/ market vendors, sari-sari stores,
grocery stores, grains distributors and other similar merchants.
ii) Vendor – refers to natural person who sells goods as a means of livelihood.

ARTICLE 3
THE CITY MARKET
Section 1. The City Market - The City Pubic Market comprises that property owned by the City
of San Carlos which include all the buildings therein which are now commonly known as
follows:
a) OLD PUBLIC MARKET
1) Old Supermarket Building
2) Phase I-VII, Phase VIII (Vegetable and Carinderia Section)
3) Phase IX, X, XI, XII
4) Market complexes located at Facoma and Palaris St.
5) Commercial Complex located at Rizal St. and Roxas Blvd.

b) NEW PUBLIC MARKET


1) Phase I
2) Phase II including Meat and Fish Section
3) Phase III (Talipapa Section)
4) Phase IV, V, VI- A & B
5) Phase VII (Fronting Roxas Blvd.)
6) Phase VIII

c) All other structures constructed or may hereafter be constructed therein as maybe


authorized by the city.

Section 2. Market Sections – The public market shall be divided into the following sections:
a) Fish Section – refers to the area where only fresh fish, clams, oysters, crabs, lobsters,
shrimps, seaweeds, and other seafoods and marine products shall be sold.
b) Meat, Pork and Dressed Chicken Section – refers to the area where only all kinds of
meats and other meat products shall be sold provided that meat, pork and dressed chicken
shall be separately displayed and properly labeled.
c) Dry Goods Section – refers to the area where only all kinds of textiles, ready-made
dresses and apparels, native products, toiletries, novelties, footwear, laces, kitchenware,
utensils and other household articles, handbags, and school and office supplies shall be
sold.
d) Groceries and Sari-sari Section – refers to the area where only all kinds of cakes,
biscuits, pastries, crackers, butter, cheese, confections, candies, canned or bottled goods
beverages, softdrinks, cigarettes, flour, oatmeal, ham, bacon, sugar, nuts, sauce, onions,
garlic, corn, mongo and the like, eggs, sausages, starch, smoked fish, dried fish, salt,
feeds, soap and other household and food products including firewood and charcoal shall
be sold.
e) Vegetable/Fruit Section – refers to the area where only all kinds of vegetables, fruits,
coconuts, and root crops such as camote, cassava, gabi and the like shall be sold.
f) Eatery and Cooked Food Section – refers to the area where only all kinds of cooked/
prepared food shall be sold. This includes refreshment parlors, cafeterias, and other
selling delicacies
g) Poultry/Poultry Products Section - refers to the area where only live chickens, ducks,
turkeys, other fowls and birds, sucklings or piglets and the like shall be sold.

h) Flower shop Section – refers to the area where only all kinds of flowers, whether fresh
or artificial, flower pots, vases and other materials needed in floral arrangements shall be
sold.
i) Plants and Garden Section – refers to the area where only all kinds of plants, garden
accessories and implements or tools shall be sold.
j) Cereal Section –refers to a place where all cereals like rice, corn, rice and corn bran,
palay and other kinds of cereals are sold.
k) Glass ware and Farm Implements Section – refers to the area where all kinds of farm
implements, such as harrow, linkaw, ropes, and the like are sold. It includes all kinds of
kitchen utensils, floor mats, brooms, plastic products, glass products including household
utensils made of clay.
l) Cold Storage or Service Section – refers to the area where only refrigeration services
shall be made available and the sale of ice in whatever form shall be conducted.
m) Miscellaneous Section – refers to the area where any other business not classified
hereinabove shall be allowed.

ARTICLE 4
SUPERVISION AND CONTROL

Section 1. The City Administrator – The City Administrator shall exercise direct and
immediate supervision, administration and control over the public market and the personnel
thereof, including those duties concerning the maintenance, upkeep peace and order of the
market premises in accordance with laws, local ordinances and other rules and/or regulations
pertinent thereto.
Section 2. The City Market Superintendent – There shall be a City Market Superintendent
who shall be under the direct supervision and control of the City Administrator. The said market
superintendent shall exercise the following powers, namely: Monitor and enforce all laws and
regulations dealing with the public market; administer the lease of all commercial stalls and
preparation of such documents, recommend such matters as may be necessary for the
development of the public market and exercise full control of the administrative, direction of all
personnel except market collectors and other personnel directly involved in the collection
function under such market and other rules and regulations governing the operation of the public
market.
It shall also be the responsibility of the City Market Superintendent to:
a) Implement and execute the plans and policies of the city in the operation of all
government owned/operated public markets within his/her territorial jurisdiction which
normally includes sanitation, cleanliness, security, order and conduct inside the market
premises.
b) Supervise and evaluate the activities and performances of the Market Supervisor and his
subordinates except market collectors and other personnel directly involved in collection
functions and investigate complaints involving their public performances and attitudes.
c) Supervise, evaluate and administer market property including acquisition, utilization,
maintenance, losses and disposal thereof.
d) Monitor, oversee and implement policies on health, sanitation, avoidance of fraudulent
commercial practices such as short selling, tampering of weighing scale and all matters
relative to proper garbage and waste disposal and other mattes that may affect welfare of
the public.
e) Perform such functions and duties that may be assigned by the City Administrator/ City
Mayor.
f) Perform such other function as may be required by the law or ordinances.

Section 3. The City Market Supervisor – there shall be a City Market Supervisor whom, under
the direct supervision and control of the City Market Superintendent, shall have supervision and
control over existing government owned and/ or operated public markets as well as those that
may still be established.

He/she shall have the following duties and responsibilities:

a) Execute and implement directive and policies emanating from the City Market
Superintendent as promulgated by the City Mayor pertaining to the operations of
government –owned and /or operated public markets within his respective jurisdiction
which normally includes sanitation, cleanliness, security order and conduct inside the
market premises and its immediate environs.
b) See to it that all stallholders and transient vendors are strictly provided with the
corresponding official receipts and prescribed cash tickets, respectively for the stall or
spaces occupied by them.
c) Prepare weekly statistical data on prevailing prices of goods in the public markets,
including flea market for the information of the City Mayor.
d) Supervise and evaluate the activities and performance of all subordinate market personnel
except market collectors and other personnel involved in collection functions and
investigate complaints affecting their public performances and attitudes.
e) Manage the maintenance and efficient utilization of all market properties, facilities, and
supplies.
f) Perform such other functions and duties that may be assigned to him by the City
Administrator/City Market Superintendent.

Section 4. The City Treasurer - The City Treasurer shall have direct and immediate supervision
and control over all those revenue officers/collectors assigned in the public market.

ARTICLE 5
IMPOSITION OF FEES

Section 1. Imposition Of Fees – The following fees shall be imposed:

a) Rental or fee for the occupancy or use of public market and premises of San Carlos City
(Pangasinan) is hereby imposed in accordance with the following rates:

All corners and front spaces ----------- P 3.00 per sq. meter

All other spaces ----------- P 2.00 per sq. meter

The market fees prescribed herein shall be collected daily as per assessment of their
occupied space in the market as regards permanent leases and whether the merchandise,
goods, wares or commodities are displayed directly or indirectly to public view and
whether sold or not, unless the stallholder concerned desires to pay in advance for a
longer receipt issued.

b) Stall Rental Rates

The stall at the New Public Market will be leased at the following rates per month:

Phase I 2,500.00

Phase II (Ground Floor) 2,500.00

The stall rental rates in the public market as prescribed above shall be increased by a maximum
of ten (10%) percent every two (2) years thereafter while stalls at the Bus Terminal shall be
increased in the following basis:

For the first and second year ----------- 5%

For the third to fifth year ----------- 10 %

c) Goodwill/ Rights Fees

Rights fees for the stall shall be paid in full by the prospective lessees upon approval of
the application and signing of the Lease of Agreement under the following schedule

measuring 3 x 5 sq.m,

All activities incident to the collection of stall fees, fees from trucks carrying merchandise, the
collection of Mayor’s permit fees and licenses and other fees due to the city government and all
accounting work incident to market operation are hereby vested in the City Treasurer. Under his
direction, such work shall be performed by personnel duly authorized by him.

Any stallholder occupying more space than what is duly leased to him shall pay double the
regular rate for such extra space. The lease contract of any stallholder found habitually incurring
the foregoing violations shall be cancelled

ARTICLE 6
TIME AND MANNER OF PAYMENT

Section 1. Time And Manner Of Payment

a. For stalls- The fee for the rental of market stalls shall be paid to the City Treasurer or his
duly authorized representative under the following schedule:

New Public Market


1. Phase I - Within first five (5) days of each month

2. Phase II - Within first seven (7) days of each month

3. Phase IV - Within first seven (7) days of each month

4. Phase VIII - Within first seven (7) days of each month

5. Meat and Fish Section - Within first seven (7) days of each month

Old Public Market - Within first twenty (20) days of each month

In case of a new lease, the lessee shall be required to put up a deposit of P 5,000.00 to guarantee
payment of rentals and cost of repairs chargeable to the account of the lessee, provided that any
balance thereof shall be returned to the lessee upon termination of the lease.

Holder of permanent lease shall pay the fee prescribed herein, whether the stall is open or not for
business, and whether the merchandise, goods, wares or commodities are displayed directly or
indirectly to view or whether sold or not.

The City Treasurer or his duly authorized representative shall issue an official receipt as
acknowledgement of the payment of rentals of fixed stalls.

Section 2. Issuance Of Cash Tickets To Transient Vendors, Prohibition Of Transfer


Thereof – Cash tickets shall be issued to an occupant of the market premises or transient vendors
buying and selling the same and his name shall be written at the back thereof. The cash tickets
shall pertain only to the person selling the same and shall be good only for the goods and the
space or spaces of the market premises for which they are assigned. If a vendor disposes of his
merchandise by wholesale to another vendor, the latter shall purchase new tickets if he desires to
sell the same merchandise even if such sale is done in the same place occupied by the previous
vendor.

Cash tickets may be issued to market vendors occupying market premises at the rate of P 3.00
per day per square meter of space occupied therein or fraction thereof.

Unless otherwise provided therein, the market fee must be paid in advance before any person can
sell, or offer to sell any commodities or merchandise within the public market and its premises.

Cash tickets shall be valid only on the date issued.

Section 3. Surcharges for late or non-payment of fees

a. The lessee of a stall, who fails to pay the monthly rental fee within the prescribed period,
shall pay a surcharge of twenty-five (25%) percent of the total rent due. Failure to pay the
rental fee for two (2) consecutive months shall cause automatic cancellation of the
contract of lease of stall without prejudice of the lessee. The stall shall be declared vacant
and subject to adjudication.
b. Any person occupying space in the market premises without first paying the fees imposed
in this article shall pay three (3) times as such as the regular rate for the space occupied.
c. Any vendor found to have paid a market fee less than that provided for in this ordinance
shall pay a penalty equivalent to twice the fees required.
d. Any vendor who cannot present his or her receipt or cash tickets in the course of
inspection by the authorized market inspectors shall be presumed to be selling without
first paying the required market fees.

ARTICLE 7
RESPONSIBILITIES OF VENDORS

Section 1. Responsibilities Of Vendors – Vendors or persons offering articles or merchandise


for sale in the public market shall have the following responsibilities:

a) Upon entering the market premises, all suppliers, suppliers-vendors and vendors must
pay their market fees in accordance with the provisions of this article. They shall be
required to show to the market collectors all the articles or merchandise they offer for
sale for the proper assessment of the market fees.
b) Vendors in the market offering for sale different classes or kinds of merchandise covered
by distinct and different rates of fees shall be duty bound to pay the separate market fees
for each kind of articles of merchandise.
c) All vendors shall require the market collectors the corresponding receipt or cash tickets
corresponding to the amount of market fees he or she paid. The receipt or cash tickets
shall be preserved and ready for inspection during the market hours. If the market
collectors shall fail to issue the receipt or cash tickets corresponding to the amount paid
or he issue the same less than the amount paid, it shall be the duty of the vendors to report
the matter immediately to the market supervisor, collection supervisors or to the City
Treasurer. All vendors shall display in conspicuous places the receipts or cash tickets
issued for the market fees.

d) No vendor shall be allowed to occupy more than one (1) stall in the market.
e) Vendors shall observe laws, rules and regulations on health and sanitation, public safety,
environment, traffic, and business and trade. Vendors shall:
1) Ensure and maintain cleanliness in their workplaces through the proper disposal of
garbage;
2) Ensure unobstructed traffic flow;
3) Provide for calibrated weighing scales, as maybe appropriate, and price tags of their
wares and goods; and
4) Sell quality goods and refrain from selling illegal and fake products.

ARTICLE 8
ADMINISTRATIVE PROVISIONS

Section 1. Administrative Provisions

a) No person shall be allowed to sleep at night or otherwise take up residence and/or cook in
the public market or in any part thereof. No shanty/structures shall be permitted in or
about the public market.

b) No person shall drink, serve or dispense liquor or any intoxicating drink within the
premises of the public market.

c) All articles displayed within the confines of the city market, whether they are for sale or
not, or are offered directly for sale or not, shall for all intents and purposes be considered
for sale and shall pay the corresponding market fees provided for in this ordinance

d) It shall be prohibited for any person to sell merchandise in places where vendors and
buyer pass or in designated passage ways (pasillo) or alleys used by purchasers in the
market premises; and to sell in anyplace outside of the market premises, merchandise
intended for sale in the market.

The peddling or sale outside the public market site or premises of foodstuffs, which
easily deteriorate like raw fish and meat, is hereby prohibited.

e) No person not having business in or about any city public market, shall idly sit, lounge,
walk or lie in or about the premises of the same, nor shall any person beg or solicit alms
or contributions of any kind in the public market.

f) No dogs or other animals shall be left astray in the market and the Market Superintendent
is hereby empowered to catch such animals and impounds them for disposition.

g) No person within the premises of the public markets shall commit any nuisance, and
disorderly conduct, or make loud boisterous noises, or use profane bulgar languages, or
obstruct the passage ways, or do any act of breach of pace that could disturb the good
order and decorum therein.

i) It shall be unlawful for any lessee to remove, construct or install electrical wiring or
water connection nor alter the structure of the stall without prior permit from the City
Mayor upon recommendation of the City Engineer.

j) No merchandise or article shall be sold, offered for sale or exposed for sale in the public
market unless the same was legally acquired by the vendor or stall holder and that taxes
or any kind due thereon has been paid.

k) It shall be unlawful for any person to peddle, sell or offer for sale, or exposé for sale, any
article in the passage way (pasilyo) used by purchasers in the market premises.

l) It shall be unlawful for any person to resist, obstruct, annoy or impede any market
employee or personnel in the performance of his/her duties, nor shall parents allow their
children to play in or around their stalls or in the market premises.

m) The city shall not be responsible to the occupant of the stalls for any loss or damage
caused by fire, theft, robbery, “force majeure” of any other cause. All articles or
merchandise left in the public market during closure time shall be at the risk of the stall
holder or owner thereof.

n) Any abandoned stalls/articles in the public market building in violation of any provision
of this article or any regulations or rule on the management of the market, shall be
deemed nuisance. It shall be the duty of the Market Superintendent or his subordinates to
take custody thereof. In case the articles are claimed within twenty four (24) hours
thereafter, they shall be returned to their original owner upon payment of actual expenses
incurred in their safe-keeping unless they have not deteriorated as to constitute a menace
to public health in which case they shall be disposed of in the manner directed by the City
Mayor who may also in his discretion, cause the criminal prosecution of the guilty party
or merely warn him against future violation. In case where the articles have not
deteriorated and are not claimed within the time herein fixed, said articles shall be sold at
public auction and the proceeds thereof shall be disposed in accordance with law.

o) No lessee shall sub-let or sub-lease the stall so awarded nor shall any privilege acquired
been sold. Any person other than the stallholder found selling the latter’s stall is a prima
facie evidence of sub-leasing and shall subject the stallholder to outright revocation of his
award.

p) Livestock and poultry products – the injection of water and application of coloring agents
to livestock and poultry products is strictly prohibited.

ARTICLE 9
MARKET ENTRANCE FEES

Section 1. Entrance Fees – In lieu of the regular market fees based on the space occupied, there
shall be an entrance fee for all transient vendors or any commodity or merchandise being brought
into the public market for sale based on the space occupied by their commodities on the basis of
sack, bundle, basket, can or any convenient unit of measure, at a rate of P3.00 per day per
square meter or fractional part thereof, except livestock ground market at the following rates

Large Cattle -------------- P 10.00/ head

Hogs -------------- P 5.00/ head

Goats -------------- P 5.00/ head

Others -------------- P 2.00/ head

In case the vendor from whom an entrance fee was collected occupies any table, cubicle
to other space with an area in excess of what he paid for, he shall be required to pay the correct
amount of the fee due thereon less what he has already paid as entrance fee.

Duly licensed suppliers or distributors of goods, commodities of general merchandise or


permanent occupants of market stalls, booth, tiendas, or other spaces as well as the same
occupants when they bring in goods, commodities or merchandise to replenish or augment their
stocks, shall not be considered as transient vendors required to pay the market entrance herein
authorized.

ARTICLE 10
AWARDING OF STALLS

Section 2. Duties Of Market Committee – The following shall be the duties of the Market
Committee:

a) Conduct the drawing of lots and opening of bids for the adjudication of vacant or newly
constructed stalls or booths in the public market or his duly authorized representative.
b) Certify to the City Mayor for the result thereof.
c) Adjudicate the transfer of stall holders from section to another, or from one stall to
another, and;
d) Recommend to the City Mayor such measure or actions as maybe necessary in the
resolution of problems in connection with the occupancy of stalls, booths or spaces in the
public market.
e) To make a study of all phases on market matters and to submit comment on, and
recommendation for such study to the City Mayor.
f) In addition, the herein market committee is also empowered to exercise direct and
immediate supervision and control over the city public market in accordance with this
Section and other applicable laws.

Section 3. Application – No person or partnership shall be permitted to engage in any form of


business in the public market without first securing an application from the City Administrator or
his duly authorized representative and having said application duly approved by the same;
PROVIDED, that the lease award granted to stallholders shall constitute a permit or privilege to
do business and the basis of collection of the fees herein provided. All applications for the
awards of stalls shall be filed in the office of the City Administrator copy furnished the City
Treasurer upon payment of the corresponding fees.

a) Application for Lease


1) The application shall be under oath. It shall be submitted to the Office of the City
Administrator by the applicant either in person or through his or her attorney.
2) It shall be the duty of the City Treasurer to keep a register book showing the names and
addresses of all applicants for a stall, the number ad description of the stall applied for,
and the date and hour of the receipt of the copy of the application by the City
Administrator of each applicant. It shall also be the duty of the City Treasurer to
acknowledge receipt of the copy of the application setting forth therein the time and date
of receipt hereof together with the cash bond or deposit if any.
3) Applicants who are Filipino citizens shall have preference in the lease of public market
stalls. If on the last day set for filing application, there is no application from a Filipino
citizen, the posting of the Notice of Vacancy prescribed shall be repeated for another ten
(10) days period. If after the expiration of that period there is still no Filipino applicant,
the stall affected maybe leased to any alien applicant, the adjudication of the stall shall be
made thru drawing of lots or public bidding of the rental thereof to be conducted by the
Market Committee

In case there is only one Filipino applicant, the stall applied for shall be adjudicated to
him. If there are several Filipino applicants for the same stall, adjudication of the stall
shall be made thru drawing of lots or public bidding of the rental thereof conducted by
the market committee on the date and hour specified in the notice. The result of the
drawing of lots or public bidding shall be reported immediately by the Committee to the
City treasurer concerned for appropriate action.

4) The successful applicant shall furnish the City Treasurer two (2) copies of his/her picture
immediately after the award of the lease. It shall be the duty of the Treasurer to affix one
(1) copy of the picture to the application and the other copy of the record card kept for the
purpose.

Section 5. Manner Of Awarding Stalls

Awarding and assigning of stalls to applicants shall be done by drawing of lots and shall be
awarded by the Awards Committee after thoroughly screening the applicant –lessee, and upon
payment of corresponding goodwill money.

Section 6. Certificate Of Awards /Vacancy

Certificate of awards/vacancy shall be issued after the drawing of lots This Certificate shall
authorize the awardee to formally construct the necessary doors according to prescribed
signification and requirements under the National Building Code, install lighting fixtures and
post signboards. Before issuance of the Certificate of Wards/occupancy, awardee shall be made
to sign the Contract of Lease.

Section 7. Adjudication Of Stalls

a) Lease Period – The Contract of Lease for a stall shall be for period of
______________renewable upon its expiration, unless revoked in accordance with the
provisions of this Ordinance.

Section 8. Notice Of Vacancy

A notice of vacancy of newly constructed or vacated stalls shall be made for a period of ten (10)
days immediately preceding the date fixed for their award to qualified applicant to apprize the
public of the fact that such fixed space is unoccupied and available for lease. Such notice shall be
posted conspicuously on the unoccupied stall and the bulletin board of the public market.

Section 9. Miscellaneous Provisions On Stalls

a) Vacancy of stall before expiration of the lease – if for any reason, a stall holder or lessee
discontinue or is required to discontinue his business before his lease contract expires,
such stall shall be considered vacant and its occupancy thereafter shall be disposed of in
the manner herein prescribed.
b) Partnership with stall holder – a market stall holder who enters into business partnership
with any party after his/her acquisition of the right to lease such stall have no authority to
transfer to his/her partner or partners the right to occupy the stall. In case of death or any
legal disability of such stall holder to continue in his business, the surviving partner may
be authorized to continue occupying the stall for a period not exceeding sixty (60 days)
within which to wind up the business of the partnership. If the surviving partner is
qualified to occupy a stall under the provisions thereof, and the spouse, parents, son,
daughter or relative within the third degree of consanguinity or affinity of the deceased is
not applying for the stall, he shall be given the preference to continue occupying the stall
concerned, if he or she applies for it. Any new lessee shall likewise pay a goodwill fee.
c) Leases personally administer his stall – Any person who has been awarded the right to
lease a market stall in accordance with the provisions hereof, shall occupy, administer
and be present personally at his stall or stalls. He may employ helpers who must be
citizens of the Philippines, including but not limited to his spouse, parents, and children
who are actually living with him and who are not disqualified under the provisions
hereof. The person to be employed as helpers, under no circumstances are persons with
whom the stall holders has any commercial relation or transaction.
d) Dummies, Sub-lease of Stall – in any case where the person registered to be holder or
lessee of a stall in the public market, is found to be not the person who is actually
occupying said stall, the lease of such stall shall be cancelled, if upon investigation such
stall holder shall be found to have sub-leased his stall to another person or to have
convince with such person so that the latter may for any reason be able to occupy the
said stall.
e) Appeals – Any applicant who is not satisfied with the adjudication made by the City
Treasurer or the Market Committee of the stall applied for, by him, may file an appeal
with Secretary of Finance through the city Mayor who may submit such appeal with his
comment and recommendation as he may desire to make on the matter. The decision of
the Secretary of Finance in such case shall be final.

ARTICLE 11
MARKET HOURS

Section 1. Market Hours – The public market shall be open from 3: 00 AM until 10:00 PM
everyday to transact trade or business regarding the sale of permitted articles therein.

The use of any stall or any place in the market as living quarters/ room and/or sleeping quarters
is strictly prohibited and no vendor or stall holder shall remain inside the market buildings after
the same has been closed

Section 2. Responsibility for Loss or Damage of Articles or Merchandise after Closure Time

a) The city government shall not be responsible for any loss or damage of the lessee’s
property caused by fire, theft, robbery, “force majeure” or any other unavoidable cause.
All articles or merchandise left in the public market after closure time shall be at the risk
of the stallholder or owner thereof.

b) All articles abandoned on any public market building in violation of any provisions of
this Article or any regulation or rules relating to the management of the market, shall be
deemed a nuisance, and shall be the duty of the Market Superintendent to take custody of
such articles. Said articles can be claimed by the owner within twenty four (24) hours
thereafter except those deteriorated to constitute a menace to public heath, in which case,
there shall be disposed of in the manner directed by the Market Superintendent who shall
admonish him of his violation or at his own discretion, cause the prosecution of the
offenders to proper court. In case, the articles have not deteriorated and are not claimed
within the time herein fixed, said article shall be sold at public auction, and the proceeds
thereof shall be disposed of in accordance with law.

ARTICLE 12
‘‘SECURITY OF REGISTERED VENDORS IN THE WORKPLACE’’

(Source: Rules & Regulations implementing Executive Order No.452 series l997)

Section 1. Coverage And Application – These rules and regulations shall cover and apply to all
ambulant vendors or peddlers, market vendors without stalls and street vendors

Section 2. Creation And Composition Of A Local Market Council – The City Mayor may,
through an ordinance, create a Local Market Council on the security of registered vendors
pursuant to Executive Order No. 452, s. 1997

Section 3. Functions – The Local Market Council shall perform the following functions:

a) Assist the competent local authorities in the formulation of plans, programs, projects or
activities that will ensure the security of vendors in the workplace;
b) Monitor compliance to the rules and regulations of Executive Order No. 452
c) Recommend appropriate measures to the City Mayor to enhance the participation of
vendors in local socio-economic efforts;
d) Recommend to the Inter-Agency Council in the Security of Registered Vendors measures
to improve the plight of registered vendors.
e) Assist in the conduct of a survey on vacant areas for vending; and
f) Perform such other functions as maybe provided by competent local authorities.

Section 4. Meetings And Quorum – The Local Council shall hold its meetings once every
quarter or as often as necessary. A simple majority of all its members shall constitute a quorum.

Section 5. Survey On Vacant Areas For Vending – The City Mayor shall cause the conduct of
a survey to identify vacant areas within the vicinity of markets, other vacant public spaces,
public parks, city streets or sidewalks in the city street that maybe designated for vending
purpose.

Section 6. Authority To Designate A Workplace – Within Ninety (90) days after the survey,
and pursuant to the recommendation of the Local Council in the security of registered vendors,
the Sanggunian Panglunsod shall designate a workplace or workplaces from vending through an
ordinance. The use of public parks, city streets or sidewalk for vending purposes shall be subject
to the provisions of Section 16 and 21 of the Local Government Code of 1991 and the Land
Transportation Code respectively.

Section 7. Prior Consultation Required – No workplace for vending purposes shall be


designated as such workplace unless prior consultation with registered street vendors, ambulant
vendors or peddlers and market vendors without stalls, the local police and the affected
inhabitants is undertaken.

Section 8. Registration Of Vendors – the following guidelines shall be observed:

a) All street vendors, ambulant vendors or peddlers and market vendors without stalls shall
register in the city of San Carlos, Pangasinan and shall pay the corresponding taxes, fees
and charges pursuant to existing tax ordinances of this City.
b) It shall be the responsibility of the City Administrator to register qualified vendors. The
registration shall be simplified and shall not follow the regular procedure in registering
businesses and other commercial activities in the city.
c) The following documents are required in the registration of street vendors, ambulant
vendors or peddlers and market vendors without stalls.
1) a duly accomplished registration form indicating the workplace where such vendor
intends to vend;
2) certification from the Punong Barangay attesting that the vendor is a resident of the
Barangay;
3) An endorsement from the president of the vendors association, and
4) Official receipt evidencing payment of taxes, fees and charges.

Section 9. Assignment of vending space

a) The City Administrator thru the City Market Superintendent shall establish a system of
prioritizing vendors for the purpose of assigning workplaces and to accommodate all
vendors, as far as practicable.
b) The assignment of vending workplaces shall be subject to reasonable regulations as to the
size of the workplace and the day and time of vending with due regard to health and
sanitation, traffic and peace and order concerns.
c) Only registered vendors shall be assigned vending workplaces.

Section 10. Limitations on the use of areas for vending

a) Designated workplaces maybe used exclusively for vending purposes.


b) No unregistered street vendors, ambulant vendors or peddlers or market vendors without
stall shall be allowed to vend/sell in designated workplaces.

Section 11. Prior Consultations required – No vending space shall be assigned without prior
consultation with registered vendors.

Section 12. Issuance of Business Permit – A business permit to operate shall be issued to a
registered vendor within ten (l0) working days upon the designation of vending space and
payment of corresponding fees. The business permit shall be renewable every year. It shall
indicate the name of the vendor, residential address, assigned workplace and the day and time of
vending.

Section 13. Display of Permit-

a) The permit shall be in such form that buyers can clearly see the name and address of the
vendors, the assigned workplace and the day and time of vending.
b) All vendors shall display their business permits in conspicuous places in their
workplaces.

Section 14. Vendors Association – Vendors shall be encouraged to organize themselves into
associations for their mutual aid, benefit and protection and for other legitimate purposes. It shall
be the duty of the vendors association to police their own ranks and to ensure that their members
perform the responsibilities embodied under the rules and regulations hereof.

Section 15. Security in the Workplace – Registered vendors shall enjoy security in the
workplace and shall not be arbitrarily deprived of their workplaces.

Section 16. Temporary Vending Sites – Pending the designation of a viable vending area or
areas, vendors occupying a public place or places previously designated as vending site or sites
shall be provided with a viable temporary vending site or sites by the city government . Notice of
temporary transfer shall be given to the vendors at least fifteen (l5) days before the actual
transfer. This rule shall likewise cover and apply to vendors who are granted with permits but
whose workplaces are withdrawn from the list of allowable vending sites. Any change in the list
of allowable vending sites shall only be done after consultations with the affected vendors.

Section l7. Relocation of Vendors – Before any public market is closed, sold or demolished, all
market vendors with stalls and registered market vendors without stalls shall first be relocated by
the city government to a temporary or new public market. Notice of the intention to close, sell, or
demolish any public market shall be made to all concerned vendors at lease sixty (60) days
before the actual transfer or relocation to another market site. Within the sixty (60)-day period,
the city government shall conduct consultations with the affected vendors on the selection of the
relocation site and the implementation of the relocation.

Section 18. Priority in the Assignment of Stalls – In the event a new public market is
constructed in place of the old market that is closed, sold or demolished, market vendors with
stalls who are displaced from their workplaces shall be given priority in the assignment of stalls
in the new market. No vendor shall be allowed to occupy more than one (l) stall in the new
market.

Section 19. Continuing Registration of Vendors- It shall be the responsibility of the City
Mayor to establish a system of continuing registration of street vendors, ambulant vendors or
peddlers, and market vendors without stalls.

Section 20. Exclusion of Main Thoroughfares – No vending activity by street vendors,


ambulant vendors or peddlers and market vendors without stalls shall be allowed in places not
designated as a workplace, main thoroughfares.

Section 21. Identification Cards – The City Administrator shall within (l0) working days,
cause the issuance of Identification Cards to all registered vendors upon payment of reasonable
fees.

Section 22. Sanctions – Any violation of the provisions of this Article shall, upon conviction by
a competent court, be meted with the following sanctions:

a) Payment of a fine of not less than One Thousand Pesos (Pl,000.00) but not more than
Two Thousand Pesos (P2,000.00) or an imprisonment of not less than one (l) month
but not more than six (6) months or both, at the discretion of the Court.
b) Cancellation of the business permit and revocation of the authority to occupy and vend in
the assigned workplace.

ARTICLE 13
MAINTENANCE OF CITY MARKET

Section 1. Cleanliness and Sanitation

a) Cleaning of Market Premises – The Market Superintendent shall see to it that the public
markets are always clean and in sanitary condition including the aisles, divisions, stalls,
floors, walls and equipments as well as the whole tract of lands belonging to the public
markets.

The cleaning of the market premises should be done before the buyers start coming into
the public market. The market buildings and grounds should at all times be kept from
garbage and rubbish.

b) Cleaning of stalls, booths and spaces – At the close of each day’s business and before
leaving, stallholders and transient vendors shall clean their stalls, booth/s, space/s. they
shall also remove all dirty materials and place rubbish and garbage in containers placed
for the purpose.

c) Garbage Receptacle – The public market should be provided with receptacles, which
shall be placed in the most conspicuous and convenient places. Individual stallholders
shall provide themselves with their own receptacles in order to avoid littering in their
premises. Garbage disposed shall be kept inside the premises and shall only be brought
outside sealed and tied and properly placed in sacks or bags upon collection by the
garbage haulers. No stallholders or other person shall place refuse on the floor, stall/s or
any place other than the garbage receptacles.

The city garbage collector will collect garbage deposit in plastic bags, sacks and other
acceptable containers starting at 6:30 A.M. daily or during such schedules to be
determined by the City’s General Services Office.

d) Abandonment of Perishable Goods – Leaving of discarded or unsold highly perishable


goods, such as meat, fish and other sea foods in the stalls or in any place within the
market premises shall be unlawful and person found to have abandoned such goods in or
about the stalls shall be liable under the penal provisions of this Code without prejudice
to the revocation of the lease of the person who is a stallholder.

e) Garbage Receptacle and Cleaning Implements – Each and every stallholder and
market vendor MUST maintain at least ONE (1) trashcan or any other form of garbage
receptacle and cleaning implements like brooms, dustpans, and the like, which shall be
registered with the Market Division Office. Each of the garbage receptacle and cleaning
implements shall be numbered correspondingly in accordance with the system to be
adopted by the Market Division Office.

f) Each and every vendor in the Meat Section and Fish Section MUST scrub the tiles and
floor of his/her respective stall with the use of soap and water on a daily basis at the end
of each market day.

g) Any personnel of the Market Division Office, in addition to the implementing agencies
tasked to enforce Ordinance 09-99, which are the City Administrator’s Office (Task
Force TALEM), General Services Office, PNP, and City Health Office, are hereby
authorized to monitor compliance of the stallholders, market vendors, and ambulant
vendors with the rules and regulations cited herein. Also, any of the personnel of these
implementing agencies is likewise empowered to apprehend violators.

h) Roving pushcarts shall go around each stall of the Public Market on a daily basis for the
purpose of garbage collection and disposal.

i) Fish entrails, scales, and/or anything that would cause clogging of the canals, sewers,
drainage systems, and the like MUST be disposed of properly.

Section 2. Sanctions – Any stallholder, market vendor, or ambulant vendor found violating any
of these rules and regulations shall, upon conviction by a competent court, be penalized with the
following:

a) First offense – a fine of FIVE HUNDRED PESOS (P500.00) and offender will undergo
a seminar for FIVE (5) DAYS to be conducted by the Committee on Waste and
Management or City Health Officer;
b) Second Offense - a fine of ONE THOUSAND FIVE HUNDRED PESOS (P1,500.00)
and an imprisonment of FIFTEEN (15) DAYS;
c) Third Offense – a fine of THREE THOUSAND PESOS (P3, 000.00) and an
imprisonment of THIRTY (30) DAYS;
d) Fourth and succeeding Offenses – a fine of FIVE THOUSAND PESOS (P5,000.00)
and an imprisonment of SIX (6) MONTHS.

ARTICLE 14
CONSUMER PROTECTION AND OTHERS

Section 1. Consumer Protection and Others

a) There shall be a “Timbangan ng Bayan” in the Public Market to ensure that weighing
scales conform with the standard weights.
b) All weighing scales used or intended to be used in the Public Market MUST be registered
with the Office of the Market Superintendent. Upon registration, a special seal or seals
shall be affixed onto weighing scale. A broken seal shall raise a prima facie presumption
that the weighing scale has been tampered.
c) Any weighing scale found to have been unregistered or whose seal has been tampered or
broken shall be confiscated in favor of the City Government Repetition of the violation
shall cause cancellation of business permit.
d) Gambling in whatever form or drinking liquor is strictly prohibited within the market
premises. Establishments authorized to sell and serve liquor are however exempted.

ARTICLE 16
PENALTIES

Section 1. Penalty – Except as otherwise provided in this Ordinance, any violation of the
provisions of this ordinance shall, upon conviction by a competent court, be punished with a
fine of not less than THREE THOUSAND PESOS (P3,000.00) but not more than FIVE
THOUSAND PESOS (P5,000.00) or an imprisonment of not less than SIX (6) MONTHS but
NOT more than ONE (1) YEAR or BOTH, at the discretion of the court.
