AFFIDAVIT COMPLAINT

I, AGUA BENDITA, 40 years old, Filipino, married and

presently residing at Cogon, Digos City, Davao del Sur,
Philippines, after having been duly sworn to in accordance
with law, do hereby depose and state:

1. That I am the same AGUA BENDITA who is executing

this AFFIDAVIT-COMPLAINT to ask that a criminal case
for VIOLATION OF REPUBLIC ACT OF 9262 or the ANTI-
VIOLENCE AGAINST WOMEN AND THEIR CHILDREN be
filed against my husband, BALDO BENDITA, 42 years
old, Filipino, married and a resident of Roxas Extension,
Digos City, Davao del Sur, for his unlawful acts stated
in the succeeding paragraphs.

Attached and marked as ANNEX “A” is a copy of our

Marriage Certificate.

2. That out of our marriage, we were blessed with one

child, BALDO BENDITA JR.

Attached and marked as ANNEX “B” is a copy of his

Birth Certificate.

3. That because of financial constraints, and that both our

income were not enough to support our family, my
husband decided to work as a call center agent in
Dubai.

4. That sometime on Feburary 2016, I heard a rumor that

my husband had a mistress in Dubai. I confronted him,
he admitted and asked for my forgiveness. For the
benefit of our children, and because I still loved him, I
forgave my husband.

5. That from then on, we had a happy marriage. Until

such time, around December 2016, I noticed that
everytime we had a video call with him, he got mad

and uttered degrading words towards me regardless of

the fact that our child can hear it as he was beside me.

6. Since then, he had not sent any financial support to us.

Even when our child was admitted to the hospital
several times for his check-ups and medicines as he
was very sick.

7. That I tried to support myself and our child with the

minimal income I have working as a housemaid, but it
is still not enough to get by.

8. That around November 2017, a co-worker of my

husband who is also a Filipino, sent me pictures of my
husband kissing a girl in Dubai. I confronted my
husband. He denied at first and finally admitted when I
showed him the picture. He also admitted that the girl
was the same one that was rumored to be his mistress.
My husband asked for my forgiveness.

Attached and marked as ANNEX “C” is a copy of the

pictures.

9. That I told him that I’ll forgive him only when he

promises to send financial support. However, he got
mad and cursed at me. He told me, “Wa man kay
pulos na bayhana! Nagpadako ra ka sa imong
lawas dinha kay di nimo masuportahan atong
pamilya. Pangit na gani ka, wa pa kay pulos.”

10. That since then, our relationship became

complicated. He no longer answers our video calls. He
still has not sent any financial support until now.

11. That I am so aggrieved. My husband just took me

and our child for granted. He is irresponsible as he does
not take care of his family. His philandering and the
degrading words hurt me so much to the point that I
feel like I do not value myself anymore.

12. That my husband and I have not been in good terms.

My husband inflicted psychological violence on my
person.

13. That I am executing this affidavit freely and

voluntarily to affirm the veracity of the foregoing facts.

IN WITNESS WHEREOF, I have hereunto set my

hand this April 29, 2018 in Digos City, Davao del Sur,
