Brock" ‘Subject: Response to E-Mail from Councilman Giba Mr. Giba, Your email below makes unfounded allegations of "harassment , Intimidation, ethical misconduct and a hostile work environment” against me in an email document that constitutes a public record. I simply cannot allow this to stand unanswered, es doing so could leave any future readers with a mistaken impression that do not refute these baseless and Incendiary comments. As you've seen, I am copying the City Council on this email. As I report to the full Council, T must ensure that they are aware of thls complex Interaction with you as an individual ‘Council Member, I also acknowledge that they have absolutely no responsibility for your words and actions, and they have not been made not aware of these circumstances prior to this point. By copy of this emall, I am now making the full Council aware of communication in which you have engaged that Is clearly reflective of the types of negative interaction of which you are falsely accusing me. I apologize if this brings you discomfort, but 1 am duty bound to make the full Council aware of several examples as presented below. (Last night) January 25, 2018: You sent the Assistant City Manager a text referring to me which states "Don’t trust him. Can I trust you?” That communication was ‘not only inappropriate, but was clearly Intended to create discord between our City’s Executive Managers. That cannot continue. January 3, 2018: The full City Council received copies of your emall exchange with the City Clerk which made clear Insinuations regarding her departure from previous positions, It was also regrettable that these emalls were sent ‘while our Clerk was on Bereavement Leave. Aug 21, 2017: You sent an email to me stating that "Memet is looking for a new City Manager.” 1 understood that to be another clear example of repeated attempts to intimidate me Into leaving Team MoVal. April 13, 2017: You sent a handwritten card to a line supervisor which included the following text In reference to an email I sent you: “If you really do want to communicate openly and freely then text or call me at Did you tell him I e-mailed you?” The line Supervisor who received this card was clearly upset over your Interaction, as evidenced In immediate presentation of the handwritten card tome. December 2016: Dec 1, 2016: Fall 2016: May 24, 2016: May 16, 2016: July 34, 2015: While interacting with Media staff members who were filming video holiday messages from each Council Member, footage was captured In which you looked straight into the camera and said “Happy Hanukkah to all of my circumcised friends.” While making such a comment was Inappropriate on its face, doing so while interacting with City employees is also unacceptable. During a meeting Involving staff from multiple departments and divisions you use¢ the following words to describe a developer of a proposed residential tract: “That's because he’s Jewish.” As you will recall, I immediately halted the discussion and made it clear that City employees will not engage in a discussion of an anyone's faith. You instead suggested that we just “close the door” because "it’s Just us In here.” Again, I made it clear that your comments had to ‘top. While T regret that you took umibrage to my response, my responsibilities as a senior manager obligated me to step in immediately so that staff members were not subjected to further hostile comments of that nature. You were overheard by Council staff members stating that "DeSantis is the first one I’m going to lay off.” The threatening and prejudicial nature of this statement ts readily apparent. You received written guidance from the Interim City Attorney regarding Inappropriate communication with City staff members, Excerpt: “This is to confirm our conversations In which we discussed allegations that you had spoken to two particular Staff members in a tone and manner that the subject staff members believed constituted harassment that may potentially lead to the creation of an abusive working environment for them.” ‘You sent a threatening email to the Public Works Director which stated: “Maybe we need to expand our audit to include public works. It would be good to see what cost savings can be found since you don't seem to want to work together for that end.” ‘Threatening a department head with an audit is unacceptable ‘communication with a staff member, particularly to one who does not report directly to the City Council, In violation of ethical standards, you forwarded an $14,500 Invoice for payment to a political consultant for unsolicited work on a “JPA Structure Agreement” which had not been authorized by staff or by action of the City Council. In forwarding this Invoice, you indicated “After paid he will send copy and can also bring in an outside firm to assist Pro Bono.” As you know, the former City Manager informed you that she could not authorize such a payment, While I take absolutely no pleasure in making these situations a matter of public record, 1 must not sit idly by while you level baseless accusations against me via an email which itself constituted a public record. Going forward, T cannot allow you to undermine my ability to serve this City Council by circumventing me in your communication with City staff. Effective Immediately: 1. Since you will not allow me to participate in a meeting with City staff regarding the General Plan, there can be no further meetings between you and City staff who report to the City Manager's Office. Tam instructing all City staff members to no longer respond to any written ‘communication (Including emails and texts) from you until further notice. They will direct any inquiries to me so that I can assist you in a prompt and professional manner. 3, Iam instructing City staff to no longer take telephone calls from you. L remain avallable to you by phone to address any questions or concerns you may have, 4, Tam Instructing City staff that they are not to engage in dialogue with you If you come Into their workspaces. Given this Instruction, I respectfully request that you refrain from visiting staff offices so that staff members are not put In an awkward situation. As always, my door Is open to you. Tremain open to reinstituting your direct access to staff if you and I are able to meet and ‘come to an understanding, Until such time, I will gladly serve as your sole point of contact for all matters pertaining to City administration and operations under my purview.
