COMPROMISE AGREEMENT

UNDERSIGNED PARTIES

CORPORATION herein represented by its duly authorized representative


FRANCE, of legal age, married, Filipino citizen and with an office address
located at Osmeña Boulevard, Cebu City. (Hereafter FIRST PARTY)

And

JOSEPHINE, of legal age, married, Filipino citizen and a resident of


Jaguimit Naga City, Cebu. (Hereafter SECOND PARTY)

AGREE AS FOLLOWS, THAT:

1. Without going into the merits of the case and for the purpose of buying
peace, the SECOND PARTY agreed to settle the case amicably for the
subject check, by paying the total outstanding balance of ONE HUNDRED
THOUSAND FIFTY PESOS (P163,880.54) EXCLUSIVE OF INTEREST AND
PENALTIES, which the FIRST PARTY accepts subject to following
mutually acceptable terms and conditions:

1.1 SECOND PARTY has to pay the amount of TEN THOUSAND


PESOS (P10,000.00) in favor of the FIRST PARTY as a good
faith gesture to comply with the payment of the total
outstanding balance;

1.2 That the SECOND PARTY shall pay the total amount of
(P50,000.00) within (5) months which agreed before
Philippine Mediation Center and attach thereof as
Annex “A”;

1.3 That the FIRST PARTY undertakes to pay the outstanding


obligation in the amount of ONE HUNDRED THIRTEEN
THOUSAND EIGHT HUNDRED EIGHTY PESOS (P113,880.00),
for one (1) year at every 12th day of the month starting on April
2016 until May 2017 at TEN THOUSAND PESOS or more
(P10,000.00);

1.4 Provided, however that full payment of the obligation shall be


settled for not more than ONE (1) YEAR;

2. SECOND PARTY agreed that payments shall be made at the office


address of the FIRST PARTY on the dates agreed above, without need of
further demand or notice;

3. In case the SECOND PARTY fails to pay or violates any of the terms and
conditions of this compromise agreement, the unpaid balance shall
become due and demandable and the FIRST PARTY can move for the
issuance of a writ of execution to enforce the terms and conditions of this
compromise agreement or reinstatement of the case;

4. Both parties prayed that this case shall be provisionally dismissed.

IN WITNESS WHEREOF, the parties hereto have mutually and


voluntarily agreed to the above stipulations and signed this compromise
agreement this March 29, 2016 at Cebu City.
