The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):

Charge: Criminal Sex Conduct-1st Degree-Penetration-Victim 13-15 - Position of Authority
Minnesota Statute: 609.342.1(b), with reference to:  609.342.2(a), 609.342.2(b)
Maximum Sentence: 30 years or $40,000 fine, or both

Charge Description: On or about July 7, 2018, in the County of Ramsey, Minnesota, the defendant,
Eduardo Delariva-Larios, did engage in sexual penetration with another person age 15 years, and was
more than 48 months older than and in a position of authority over the victim.

STATEMENT OF PROBABLE CAUSE 7/12/2018 11:32:12 AM

On July 10, 2018, officers responded to the coffee shop located at 788 Seventh Street East, Saint Paul,
Ramsey County on a sexual assault allegation. 

Officers met with a 15-year-old girl (YOB: 2003) who said she was working at the coffee shop on July 7,
2018 with the shop's owner, the defendant, EDUARDO DELARIVA-LARIOS aka EDUARDO DELARIVA
(DOB: 01/13/1973).  The defendant asked the girl if she had a boyfriend and she told him that she did. 
The conversation turned to sex which made the girl uncomfortable.  When she later went into the back
room, the defendant followed her, and he began touching her breasts and vagina over her clothing.  The girl
froze with fear too frightened to say anything.  The defendant then began touching her breasts and vagina
underneath her clothes. 

Once the assault was over, the girl returned to the counter, and the defendant followed.  The defendant
asked, “Are you okay?”  The girl told him she was.  The defendant then said, “I would never wanna hurt
you.”  When the girl washed some items in the sink, the defendant approached her again and kissed her on
the lips.  The defendant admonished, “We don’t need to tell anyone or the police what happened – a trial
would be such a mess and long.” 

Officers arrested the defendant who was on the scene.  The defendant said it’s all bullshit and he wanted to
speak to his lawyer.

The girl was seen at MCRC.  She said the defendant was showing her where her clitoris was and then
inserted his fingers into her vagina.

The defendant was later advised of his constitutional rights and agreed to speak to Sergeant Roeder.  He
said the girl worked at a shop in the same building as his coffee shop.  He asked the girl and her boss if
the girl could work at the coffee shop and they both agreed.  She came to the shop to work her first shift on
July 7, 2018.  Their conversation turned to her personal life, and he asked if she had a boyfriend.  The girl
told him she did, and the defendant asked her if they had sex.  She told him they had tried.  The defendant
told the girl she needed to understand how her body worked and how to take care of her body.  The
defendant spoke to the girl about menstruation and bodily functions, and he told her she needed to learn
about the sensitive parts on her body. 

They spoke of the clitoris and different types of orgasms.  The defendant even showed the girl things by
drawing them on paper.  She told him that she wasn’t afraid to learn more, and he “lost his mind.”  He
asked her if she really wanted to learn, and she told him that she did want to learn with her boyfriend.  He
asked her again if she wanted to learn, and she replied, “Yeah, no problem.” 

They went to the back and he touched her body.  He touched her breasts and vagina beneath her clothes. 
He denied penetrating the girl’s vagina.  He said she touched his penis and he told her to stop because his
heart was going crazy.  The defendant told her it wasn’t right and that he wanted to protect her.  The
defendant told her that he would help her in the future if she had a question.  He said he apologized to her
because he knew he had done something wrong.  He admitted he knew the girl was 15.  The defendant
admitted he had made a mistake, and he said he was very sorry.  The defendant added that the girl is very
pretty and she was flirting.  He could not understand why she waited 4 days to report the incident, and he
said she put on a “big show.” 

The defendant has a prior conviction for solicitation, inducement, and promotion of prostitution in Hennepin

NOTICE: Pursuant to Minnesota Statute 609.49, subd. 1 (a) A person charged with or convicted of a felony
and released from custody, with or without bail or recognizance, who intentionally fails to appear when
required after having been notified that a failure to appear for a court appearance is a criminal offense, or
after having been released on an order or condition that the releasee personally appear when required with
respect to the charge or conviction, is guilty of a crime for failure to appear and may be sentenced to not
more than one-half of the maximum term of imprisonment or fine, or both, provided for the underlying crime
for which the person failed to appear, but this maximum sentence shall, in no case, be less than a term of
imprisonment of one year and one day or a fine of $1,500, or both.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
