(Taken on June 24, 2015 by Prosecutor Leslie De Los Reyes at the City Prosecutor’s Office,
Iloilo City)

Purpose:

ATTY. LESLIE DE LOS REYES

Prosecution moves to offer in evidence the testimony of SPO4 ROHALLIE C. CALDERON,


through this Judicial Affidavit, for the following purposes to prove that:

1. The Philippine National Police Station at Balasan, Iloilo City received an more call that a
certain commotion occurred due to several gunshot allegedly heard coming from
Barangay Tingui-an Balasan, Iloilo.

2. That the station commander immediately orders to conduct an inspection and


investigate the matters subject of the emergency call;

3. That in compliance with said order, I, along with THREE(3) other police officers went to
said place of the alleged incident to investigate;

4. That such proper procedure and protocols for warrantless arrest and frisking were
observed by the arresting officers who likewise conducted such investigate;

5. He will also identify certain documents and pieces of evidence and other facts in relation
to the apprehension that was conducted by said police office

AFFIDAVIT OF LOSS

I, ROHALLIE C. CALDERON, 20 years of legal age, single, Filipino and a resident


of Barangay Tingui-an Balasan, Iloilo, after being sworn to in accordance with law,
depose and say that:

1. I was previously issued a school ID by the NIPSC-VSC;

2. I used to keep the above-mentioned evidence of identity in my bag;

3. Last October 20 2017, while I was on my computer for a games, I accidentally left my bag
or misplaced it;

4. I tried all efforts to locate the misplaced bag together with its contents but I was not able
to find it;

5. The said ID is now beyond recovery; and

6. I am executing this sworn statement, as required, to enable me to obtain a replacement


for the said lost proof of identity.

IN WITNESS WHEREFORE, I have hereunto set my hand this 25th day of October 2017, Sara,

The direct examination is conducted and Recorded by Atty. Mark Ramirez upon the person of
Dr. ROHALLIE C. CALDERON, before Notary Public Flower H. Ram on November 5, 2010 at the Ram
and Associate Law Office, Room 5 A, Puso ng Iloilo, Bldg.,

Dr.CALDERON is answering the question asked of him in his full conscious state of mid and
that he does so under oath and that he may face criminal liability for false testimony.

BACKGROUND OF THE CASE

Jade Garen is a 35 year old married man residing at No.123 Purok 6, Lapaz, Iloilo City, Who
was found to be strangulated on November 2 Kias, Iloilo City.

EXPERT WITNESS: ROHALLIE C. CALDERON, MD

FACTS TO BE ESTABLISHED:
1. The fact of death of JADE GAREN.
2. The cause of death is asphyxia as a result of strangulation by hanging.
3. That JADE GAREN committed suicide by hanging himself.

DIRECT EXAMINATION OF THE WITNESS

of Dr. ROHALLIE C. CALDERON, the medico-legal-officer who examined the body of the victim, Jade
Garen. He will testify as to the fact of death of the victim.

For the Defendant

COMES NOW THE DEFENDANT, through the undersigned counsel, unto this Honorable Court
most respectfully submits and presents this Memorandum in the above-tilted case and aver
that:

STATEMENT OF THE CASE

On May 10, 2012, plaintiff filed a Complaint For Ejectment against herein defendant.

On August 11, 2013, defendant received summons issued by the Honorable Court to file an
answer.

On September 15, 2014, defendant filed answer against the plaintiff.

On September 22, 2014, preliminary conference was held in the presence of the plaintiff,
defendant, and their respective counsels.

Accordingly, after presentation of evidence, the honourable Court ordered the parties to
submit their respective Memoranda fifteen days (15) days from notice, otherwise, the case is deemed
submitted for decision.

STATEMENT OF THE FACTS


The Plaintiff owned a two-storey apartment located at Deca Homes (Phase 1), Pavia, Iloilo City
covered by ST No. 48102. On March 24, 2004, plaintiff leased the first storey of the apartment to
defendant for five (5) years with a monthly rental of P 3,000.00 payable within the first seven (7) days
each month as shown in the lease contract.

2. ICOW the above cited subject and reference please be informed that on or about 9:00 pm of
November 3, 2013 along Bgry. Balantia-an Balasan, Iloilo a stabbing incident transpired
wherein victim identified as one JOHN CARLO DE LUCA y DEMAKILALA, 25 years old, single,
Student, a native of Lemery and residing at brgy: Ipil Balasan, Iloilo, was stabbed by the
suspect identified as one JAKE ALIAS y POGI, aka “SR”, 26 years old, single, labourer, a
native of Sara Iloilo and presently residing at Brgy. Cabalic Balasan, Iloilo.

3. Initial investigation conducted showed that on cited TDPO, while the victim was walking
along Brgy. Balanti-an Balasan, Iloilo way back to their house. Suddenly, he noticed Jake Pogi
Alias following him. When he reached corner of the crossing, JAKE ALIAS y POGI blocked the
way of JOHN CARLO DE LUCA y DEMAKILALA and said “ GAGO” KA! SINULOT MO SYOTA
KO!”. After his words, he got his knife to his pocket and stabbed John Carlo three times that
caused him fell to the ground. Jake Pogi Alias immediately escape the place after the
incident but he immediately caught by the concern citizen. The residents of the place
immediately helped the victim and sent to the nearest hospital that caused him to survive
from the death.

The undersigned accuses Juan Santiago of the crime of murder, commited as follow:

That on or about 1500h, on 24 June 2017, in the city of Iloilo and within the jurisdiction of this
Honorable court, the said accused with the use of deadly weapon (kitchen knife) at the person of Rudy
Fernandez and wilfully, unlawfully and feloniously, with intent to kill and evident premeditation,
discharged the said deadly weapon in the direction of Fernandez, inflecting fatal wound thereupon.

CONTRARY TO LAW with the aggravating circumstances of the evident premeditation, use of the deadly
weapon and commission during nighttime.
