A. Conjugal Partnership of Gains – Arts.

105-133

1. Exclusive Properties of Each Spouse

a. Arts. 109-115

Case: Plata v. Yatco (12 SCRA 718)

Subsequently, the respondent, Villanueva, sued Gaudencio Begosa alone for illegal
detainer (Annex C. Petition) in Case No. Q-6250, and obtained judgment against him in the
court of first instance, that became final.
The illegal detainer judgment against the husband alone cannot bind nor affect the wife's
possession of her paraphernal, which by law she holds and administers independently, and
which she may even encumber or alienate without his knowledge or consent (Civ. Code, Arts.
136. 137, 140). Hence, as she was not made party defendant in the eviction suit, the petitioner-
wife could validly ignore the judgment of eviction against her husband

b. Property Acquired by Right of Redemption or Exchange with Exclusive Property of Spouse

Case: Rosete v. Prov. Sheriff (95 Phil 560)

2. Conjugal Property - Arts. 116-117

Cases:
Castillo v. Pasco (11 SCRA 102)
As the litigated fishpond was purchased partly with paraphernal funds and partly with
money of the conjugal partnership, justice requires that the property be held to belong to both
patrimonies in common, in proportion to the contributions of each to the total purchase price of
P6,000.

Zulueta v. PAN AM (43 SCRA 397)

Moreover, he having acted in this capacity in entering into the contract of carriage
with PANAM and paid the amount due to the latter, under the contract, with funds of conjugal
partnership, the damages recoverable for breach of such contract belongs to said partnership.

3. Obligations and Charges Upon the Conjugal Partnership - Arts. 121, 123

a. Contractual Obligations Assumed by Either Spouse - Art. 122

Cases:
Luzon Surety v. De Garcia (30 SCRA 111)
Husband bounditself as guarantor - whether or not a conjugal partnership, in the absence of
any showing of benefits received, could be held liable on an indemnity agreement executed by
the husband to accommodate a third party in favor of a surety company.

Reyes, concurring:
This is the ratio behind our ruling in Javier vs. Osmeña, 34 Phil. 336, that obligations incurred
by the husband in the practice of his profession are collectible from the conjugal partnership.

Cobb-Perez v. Lantin (23 SCRA 637)

Ayala Investment & Dev’t. Co. v. CA (286 SCRA 272)

b. Charges Upon the Conjugal Partnership

Art. 122, par. 3

Lacson v. San Jose (24 SCRA 837)

2. Regime of Separation of Property – Arts. 143-146

II. Unions Without Marriage

A. Arts. 147-148

B. Historical Background

2
Cases:
Yaptinchay v. Torres (28 SCRA 489)
But stock must be taken of the fact that the creation of the civil relationship envisaged in
Article 144 is circumscribed by conditions, the existence of which must first be shown before
rights provided thereunder may be deemed to accrue. 13 One such condition is that there must
be a clear showing that the petitioner had, during cohabitation, really contributed to the
acquisition of the property involved. Until such right to co-ownership is duly established,
petitioner's interests in the property in controversy cannot be considered the "present right" or
title that would make available the protection or aid afforded by a writ of injunction.
Maxey v. CA (129 SCRA 187)
Valdes v. RTC (260 SCRA 221)
Nicdao Cariño v. Cariño (351 SCRA 127)

III. The Family

A. As an Institution – Arts. 149-151

B. The Family Home – Arts. 152-162

Case: Modequillo v. Breva (185 SCRA 766)

In the present case, the residential house and lot of petitioner was not constituted as a family
home whether judicially or extrajudicially under the Civil Code. It became a family home by
operation of law only under Article 153 of the Family Code. It is deemed constituted as a
family home upon the effectivity of the Family Code on August 3, 1988 not August 4, one year
after its publication in the Manila Chronicle on August 4, 1987 (1988 being a leap year).

The contention of petitioner that it should be considered a family home from the time it was
occupied by petitioner and his family in 1969 is not well- taken. Under Article 162 of the
Family Code, it is provided that "the provisions of this Chapter shall also govern existing
family residences insofar as said provisions are applicable." It does not mean that Articles 152
and 153 of said Code have a retroactive effect such that all existing family residences are
deemed to have been constituted as family homes at the time of their occupation prior to the
effectivity of the Family Code and are exempt from execution for the payment of obligations
incurred before the effectivity of the Family Code. Article 162 simply means that all existing
family residences at the time of the effectivity of the Family Code, are considered family homes
and are prospectively entitled to the benefits accorded to a family home under the Family Code.
Article 162 does not state that the provisions of Chapter 2, Title V have a retroactive effect.

Is the family home of petitioner exempt from execution of the money judgment aforecited No.
The debt or liability which was the basis of the judgment arose or was incurred at the time of
the vehicular accident on March 16, 1976 and the money judgment arising therefrom was
rendered by the appellate court on January 29, 1988. Both preceded the effectivity of the
Family Code on August 3, 1988. This case does not fall under the exemptions from execution
provided in the Family Code.
