THIS AGREEMENT, made this ________ day of _______________, 2017 between the

SCHOOLS DIVISION OF ILOCOS NORTE duly represented by the VILMA D. EDA, CESO
Division Accountant

VI, Schools Division Superintendent hereinafter called as the “First Party and Elocin Construction
represented by CRISANTO T. PALAFOX, of Brgy. 1, San Nicolas, Ilocos Norte hereinafter
called the “Second Party.

WHEREAS, after the faithfully complying with the procurement process the First Party
awarded the Contractor the execution and completion of such Works, inculding the remedying of any

defects therein. of the project: PB-005- Restoration of Gabaldon (Heritage) School Building – 12

Classrooms, Sarrat Central ES, Sarrat, Ilocos Norte (herein called the “the Works”) and the Entity
has accepted the Bid for Seven Million Nine Hundred Seventy Six Thousand Two Hundred
Fifty Eight Pesos and 53/100 (Php7,976,258.53).

NOW, THIS AGREEEMENT WITNESSETH AS FOLLOWS:

1. In this Agreement, words and expressions shall have the same meanings as are respectively
assigned to them in the Conditions of Contract hereinafter referred to.

2. The following documents shall be attached, deemed to form, be read and construed as part of
this Agreement, to wit:

a. General and Special Conditions of Contract;

b. Drawings/Plans;
c. Specifications;
d. Invitation to Bid;
e. Instruction to Bidders;
f. Bid Data Sheet;

g. Addenda and/or supplemental/Bid Bulletins, if any;

h. Bid form including all the documents/statements contained in the Bidder’s

bidding envelopes, as annexes;
i. Eligibility requirements, documents and/or statements;
j. Performance Security;
BY:
 k. Credit line issued by a licensed bank, if any;
l. Notice of Award of Contract and the Bidder’s conforme thereto;
m. Other contract documents that may be required by existing laws and/or the Entity.

3. In consideration of the payments to be made by the First Party to the Second Party as
hereinafter mentioned, the Second Party hereby covenants with the First Party to execute and
complete the works within One Hundred Eighty (180) calendar days starting from the
execution and notarization of this contract and remedy any defects therein in conformity
with the provisions of the Contract in all respects. Any delay in the execution of the said
project with the terms specified shall be due and demandable without the need of demand.
The penalty of 1% of the contract price shall be chargeable for every month of delay. Any
request for extension shall be made before the expiration of the said period of execution and
can only be granted if it is in accordance with the rules on procurement.

4. The First Party hereby covenants to pay the Second Party in consideration of the execution
and completion of the Works and the remedying of defects wherein, the Contract Price or
such other sum as may become payable under the provisions of this Contract at the times and
in manner prescribed by this Contract and the rules on accounting and audit.

5. The Second Party shall comply with the documentary requirements as provided for by the
rules and the laws on procurement and/or shall provide any document needed or required by
the First Party. The Second Party shall cause and shall shoulder the notarization of this
agreement.

6. The warranty against Structural Defects and Failure shall cover the periods as prescribed in
Section 62.2.3.2 of the Revised Implementing Rules and Regulations of R. A. 9184 from final
acceptance, except those occasioned by force majeure.

IN WITNESS WHEREOF, the parties thereto have caused this Agreement to be executed
the day and year first before written.

Four (4) pages, including this page on which the acknowledgment is written duly signed by the
contracting parties on the bottom margin thereof and Page Two is signed on the corresponding spaces
