All Praises and thanks be to the Lord of the Universe. Many praises

praise Yourself.

O Lord bless upon our Leader, Muhammad, Your servant Your

Invoke your blessing on Muhammad. Your Servant Your prophet,

To proceed:

“And remind, for verily, the reminding profits the believers.”

Allah  reminds us in the Qur’an that reminders benefit the

believers, so I mention the following as a reminder to myself and you
so that we all benefit from it.

Firstly, the task that has been entrusted to you is great one, and it
should not be underestimated. The most important of which is that
we need to speak with knowledge and when we are unsure of
something or cannot recall the answer we should not hesitate to say
“I don’t know”. The ‘Ulamah of this Ummah used to say that to say
“I don’t know” is nine-tenths of all knowledge. So think, how often
this should be on our lips.
The enormity of speaking with out knowledge has been described by
Allah in the following way:

‫ﻋﻠﹶﻰ ﺍﻟﻠﱠ ِﻪ‬ ‫ﺘﺮُﻭﺍ‬‫ﺘ ﹾﻔ‬‫ﻡ ِﻟ‬ ‫ﺍ‬‫ﺣﺮ‬ ‫ﻫﺬﹶﺍ‬ ‫ﻭ‬ ‫ﺣﻠﹶﺎ ﹲﻝ‬ ‫ﻫﺬﹶﺍ‬ ‫ﺏ‬  ‫ﻢ ﺍﹾﻟ ﹶﻜ ِﺬ‬ ‫ﻨﺘُﻜﹸ‬‫ﺴ‬ِ ‫ﺼﻒُ ﹶﺃﹾﻟ‬ ِ ‫ﺗ‬ ‫ﺎ‬‫ﺗﻘﹸﻮﻟﹸﻮﺍ ِﻟﻤ‬ ‫ﻭﻟﹶﺎ‬ ﴿
﴾‫ﺏ ﻟﹶﺎ ُﻳ ﹾﻔِﻠﺤُﻮ ﹶﻥ‬  ‫ﻋﻠﹶﻰ ﺍﻟﻠﱠ ِﻪ ﺍﹾﻟ ﹶﻜ ِﺬ‬ ‫ﺘﺮُﻭ ﹶﻥ‬‫ﻳ ﹾﻔ‬ ‫ﻦ‬ ‫ﺏ ِﺇﻥﱠ ﺍﱠﻟﺬِﻳ‬
 ‫ﺍﹾﻟ ﹶﻜ ِﺬ‬
“And do not describe what your tongues have lied about, saying:
“This is lawful and this is forbidden,” to invent lies against Allah.
Verily, those who invent lies against Allah, will never succeed.”

He  also says:
﴾‫ﻌﹶﻠﻤُﻮ ﹶﻥ‬ ‫ﺗ‬ ‫ﻢ ﻟﹶﺎ‬ ‫ﻨُﺘ‬‫ﻫ ﹶﻞ ﺍﻟ ﱢﺬ ﹾﻛ ِﺮ ِﺇ ﹾﻥ ﹸﻛ‬ ‫ﺳﹶﺄﻟﹸﻮﺍ ﹶﺃ‬ ‫﴿ﻓﹶﺎ‬

“Ask the people of knowledge if you know not”

Secondly, bear in mind that the Da’wah carriers will face severe tests
and obstacles on the path to seek Allah’s pleasure. Never did Allah 
send a Messenger or Prophet but that they faced great adversity and
pain. We are now carrying the responsibility of the Prophets and
Messengers, since we Call to Allah and His Din, we seek to change
the world order from subservience to man’s whims and desires to the
pleasure of Allah. And all who take to this path, will face the same
perils and obstacles as these noble Messengers and Prophets.
We also need to bear in mind that, although we ask the shabab
to look at the Prophet as their example, and to look at the practical
manifestation of this in the Sahaba and the righteous scholars of the
past and present. It is an undeniable fact that the younger darisin will
always take their teachers as their ‘practical example’. If we are happy
with the minimum whist explaining the ideal, they too will be happy
with the minimum and just wish about the ideal. However, if we can
exemplify the ideals, then insha-Allah they too will aim for the ideal
rather than be happy with the minimum.

And lastly, let us remember that as Insan, we are going to make

mistakes and fall short of what Allah  demands. And it is because
of this that all of us need to remember Allah  at all times and to
consistently make taubah for our shortcomings and transgressions.
Allah  tells us: ﴾‫ﺎ‬‫ﻧﺼُﻮﺣ‬ ‫ﺑ ﹰﺔ‬‫ﻮ‬ ‫ﺗ‬ ‫ﻣﻨُﻮﺍ ﺗُﻮﺑُﻮﺍ ِﺇﻟﹶﻰ ﺍﻟﻠﱠ ِﻪ‬ ‫ﻦ ﺁ‬ ‫ﺎ ﺍﱠﻟﺬِﻳ‬‫ﻳﻬ‬‫ﺎﹶﺃ‬‫﴿ﻳ‬
“O you who believe, turn to God in sincere repentance.”1
He  also says : ﴾‫ﲔ‬
 ‫ﺍِﺑ‬‫ﺘﻮ‬‫ﺍﻟ‬ ‫ﺤﺐ‬
ِ ‫ﻪ ُﻳ‬ ‫﴿ِﺇﻥﱠ ﺍﻟﻠﱠ‬
2
“Truly God loves the penitent”
And He  says: ﴾‫ﻥ‬
‫ُﺗ ﹾﻔِﻠﺤُﻮ ﹶ‬ ‫ﻢ‬ ‫ﻌﻠﱠﻜﹸ‬ ‫ﺆ ِﻣﻨُﻮ ﹶﻥ ﹶﻟ‬ ‫ﺎ ﺍﹾﻟ ُﻤ‬‫ﻳﻬ‬‫ﺎ ﹶﺃ‬‫ﺟﻤِﻴﻌ‬ ‫ﻭﺗُﻮﺑُﻮﺍ ِﺇﻟﹶﻰ ﺍﻟﻠﱠ ِﻪ‬ ﴿
“And repent unto God altogether, O believers, so that you may be successful.”3

The Messenger of Allah  said: ‘Verily my heart is beclouded so

that I beg forgiveness of God seventy times in a day.’4

We should take every opportunity to be amongst those loved by

Allah .

The Activities of Carrying the Da’wah - Hizb Leaflet

I would suggest that you have a session on this leaflet and let your
students think about what Islam demands of them in the times that
we live in. This leaflet is an excellent summary of the Islamic
commitments and a very important general guide to what the da’wah
carriers should be doing.

Imam Nawawi

The Complete Forty Hadith

Imam Nawawi’s summary of the Islamic Teachings from Forty-two

Ahadith. Includes a full translation of Imam Nawawi’s commentary
on these Ahadith. It is published by TA-Ha publishers.

Riyad as-Salihin

A collection of Ayahs and Ahadith on major Islamic themes.

There are different English editions of Riyad as-Salihin. The Darus-
Salam one is very good quality and cheap for a hardback book.
However, there are some accusations of selective editing and
translating against the Salafis. So you need to be wary of this.

Imam Ibn Rajab

Compendium of Knowledge and Wisdom (Jami’ Ulum wal-Hikam)

Imam Ibn Rajab added a few more hadith to Imam Nawawi’s

collection and then wrote a commentary on each Ahadith.

Fareed
Arabic
The language of our noble Dīn is Arabic, and this alone should be
enough of a motive for the shabab to start learning the language of
the Dīn.
Further to this, I would like to remind you of the Hizb’s analysis of
the decline of this Ummah. The Hizb states, in Mafāhīm Hizb ut-
Tahrīr, the sole reason for the severe decline on this noble Ummah.

“The reason for its decline is due to one single factor,

the severe weakness that destroyed the ability of the
minds in understanding Islam. The cause for this
weakness was the detachment of the capacity of the
Arabic language from the capacity of Islam when the
Arabic language was ignored both in understanding
and carrying Islam from the beginning of the seventh
century Hijri onwards. Accordingly, unless the capacity
of the Arabic language is mixed with the capacity of
Islam by making the Arabic language the language of
Islam as a fundamental and inseparable part of it, the
decline will continue to drag the Muslims down.
This is because it is the linguistic capacity that
carried the capacity of Islam and consequently
intermingled with it, such that the perfect carrying of
Islam cannot be undertaken except by it; and if it is
neglected, Ijtihad (deriving of ahkam from texts) in Shar’a
(divine law) cannot be undertaken. Knowledge of the
Arabic language is a fundamental condition in Ijtihad.
Furthermore Ijtihad is necessary for the Ummah since
progress within the Ummah cannot occur except by
utilising it.”
There are numerous basic books that a student could start with. My
advice would that whichever book or course you start with, you need
to have a firm resolve to complete that book or course. Different
authors have different approaches, but what really matters is that
once you start one approach you need to complete that approach.

All of the books are in English unless stated otherwise.

“Reader book” approach

This approach focuses on building vocabulary and reading, with the
gradual introduction of grammatical rules.
The advantage of this approach is that it solidifies the basic rules and
slowly builds upon this basic foundation.

Arabic Language for English Speaking Students

Dr. V. Abdur-Rahim

This is the Madinah University series.

The best edition is by the Islamic Academy. The new edition contains
a key to each chapter at the end of the book.

Book one : is very simple and easy. A dedicated student should be

able to go through it without a teacher.

Book Two : A nice step up from book one. Will need a teacher by
now.

Book Three : A bigger jump from the other books: Will definitely
need a teacher.

Kitab ul-Asasi
Three volumes in Arabic.
This book is widely used in Arabic language institutes in north Africa
and the Middle East.

Arabiyyah bayna yadakh (Arabic between your hands)

Three volumes in Arabic.
Used in institutes in Saudi and Egypt.

For kitab ul-Asasi and Arabiyyah bayna yadakh you will inevitably need
a teacher.
The main disadvantage of these books is that it will hard for
beginners to prepare lessons before the class.

The advantage of these books is that, if one is intending to travel

aboard to study at any of these institutes, you can have a head start
by studying here. It may also help in putting you into a higher level at
the institute.

Grammar Intensive Approach

This approach focuses on teaching the grammar rules and
morphology rules in an intensive way. Due to this, a teacher would
be required from the very beginning.
The advantage of this approach is that once completed, a student
should have good reading and writing skills. However speaking skills
is very limited and it is very hard to retain vocabulary with this
approach.

Modern Written Arabic: A Comprehensive Grammar

by El-Said Badawi, Mike Carter, and Adrian Gully
An advanced Grammar with lots of details, however, very hard to use
for instruction and teaching.

A Reference Grammar of Modern Standard Arabic

by Karin C. Ryding
Ryding’s Grammar is a new book and seems to be better than
Haywood and Nahmad in terms of Grammar details, but it is a very
hard text to use to learn Arabic.

A New Arabic Grammar of the Written Language

By John A. Haywood and H.M. Nahmad
A long time favourite in the English language for learning Arabic. It
is easier to use for instruction and learning than Ryding’s book.
However it does not have the same level of detail as Ryding’s text.

Classical Arabic Approach

This approach teaches Arabic grammar the way it was taught in the
good old days of the Khilafah.

The advantage of this approach can be greatly seen for native

speakers or foreign students living in an Arabic speaking
environment. It also serves as the continuation of an established
Muslim tradition and for this reason a students feels that he/she is
preserving the Islamic heritage.

The disadvantage of this approach for foreign students in a non-

Arabic speaking environment, is that it was developed and practiced
in an Arabic speaking environment, where students spoke Arabic but
needed to learn the rules of grammar and morphology properly.
However, this should not be taken to mean that it is now redundant.
Far from it. But this approach is better suited in my opinion to a
Arabic speaking environment.

Aqidah

Standard Aqidah Books

Aqidah Tahawiyyah – written by Imam Tahawi

Aqidah Nasafiyyah – Written by Imam Nasafi

Foundations of Islam – By Qadi ‘Iyad al-Maliki

1st chapter is on aqidah the rest are on the pillars of Islam.

Al-Aqidah al-Qudsiyyah – Written by Imam al-Ghazali whilst he

was in al-Quds

Faysal al-Tafriqah bayn al-Islam wa Zandiqah – Also wriiten by

Imam al-Ghazali.
This book is an excellent introduction to the questions of sects and
how we are to deal with the Muslim Sectarians and the sectarians that
became Kuffar.

This is a must for ALL teachers and I would suggest this as

compulsory reading for the Students as well.

Aqidah Wasitiyyah – written by Imam Ibn Taymiyyah to the people

of Wasit in Iraq.

This book will help to appreciate the Ahl-lul-Hadith position of

Aqidah Matters, and hence the Modern day Salafi’s as well.

Al-Irshad

By Imam al-Juwaini d. 478 Hijri

Imam Juwaini is known as Imam al-Haramyan. He was a great Shafi’i
Mujtahid. He was also one of the main teachers of Imam al-Ghazali.
In this book Imam Juwaini presents the Islamic Aqidah from the
Ashari viewpoint.

It also contains two important chapters of fiqh, one on the Khilafah

and the second on the fard of Amr bil maruf.

This is available in English translation.

The book is a quite advanced book. For this reason, anyone without
knowledge of Aqidah, Usul and Philosophy, will find it quite difficult
to comprehend.
However, the chapters on fiqh are quite straight forward and I would
suggest that these chapters are read by teachers and Students.

The sections on the proof of Allah’s existence and Qur’an should be

read by Teachers.

Luma’ al-Adillah

By Imam al-Juwaini

Another book on Aqidah by Imam Juwaini. This is a smaller book

than the Irshad. The advantage of the translation is that the translator
includes his own commentary as well.

This should be read by teachers and Students.

Fiqh
The importance of studying fiqh cannot be underestimated.
Knowledge of fiqh is absolutely essential for the Mukallaf to be
enabled to abide by the Hukm Shari’i. In fact without the knowledge
of fiqh it would be impossible to abide by the commands and
prohibitions of Allah ta’ala.

It is vital for the Teacher to ensure that the Student has a clear
understanding of what fiqh is conceptually and that this crystal clear
understanding of fiqh should make us all realise our own limitations
in the area of fiqh and Ijtihad and our absolute need for mujtahids and
taqlid.

The reality of the Ummah at this time is that the overwhelming

majority of us are Muqallidin and in fact Muqalid ammi.

The importance and difficulty of ijtihad cannot be underestimated.

Although Ijtihad is required it is only open to qualified mujtahidin. The
hizb states this in the following words :
“It is true that the door of Ijtihad is open but it is open
for the scholars (‘ulama) not for the ignorant.” (Mafahim
Hizb ut-Tahrir)

Standard Books of fiqh

Hanafi

Mukhtasar al-Quduri
Written by Imam Abul-Hasan Ahmad al-Quduri. He died in the year
428 Hijri. It is now 1000 years since his death and his book is still use
in Hanafi Madrasahs in Syria, Jordan, Iraq, Egypt, Turkey, Central
Asia and the Indian Sub-continent.

It is known that Imam Ibn Taymiyyah used to refer to the Mukhtasar

to understand the Hanafi position.
No full translation is available in English as of yet.

al-Hidayah

Written by Shaykh al-Islam Imam al-Marghinani

This is a commentary on the books Mukhtasar al-Quduri and Jami’ al-

Saghir of Imam Muhammad bin Hasan ash-Shaybani.

Imam Marghinani wrote his commentary and it was 80 VOLUMES!!

Realising that it would be too difficult for people to commit to
studying he then summarised this 80 volumes into what is now
known as al-Hidayah. In the modern type print it is usually 4 volumes.

Al-Hamdu-lillah, Professor Imran Ahsan Khan Nyazee has translated

the first volume into English and is widely available in the Islamic
Bookshops.

This book is excellent for some one with some fiqh and Usul
knowledge.
However, it will be difficult for a beginner, in fact it would not be an
exaggeration to say that it will be very difficult for a beginner.

With all of these fiqh books, it is essential to realise that you will need
a teacher to be able to fully comprehend the text.
The reason for this is that, legal text books were always written in a
particular obtruse style. Further more the norm in the Islamic State
was that students always had teachers to explain their books. Added
to this is the fact that nearly always these books were memorised by
heart at a young age. In order to facilitate this memorisation process
the scholars would make their works as brief as possible, knowing
that the students would have this knowledge developed by a shaykh
or a senior student.
Just as in our classes, where we go through the textbooks line-by-line,
this was the norm in the Islamic State.
We should realise that in this sense Shaykh Taqī (may Allah be
pleased with him) used the same style of intensive culturing that was
used for over 1000 years.
Maliki

Ar-Risalah al-Qayrawani

This is an intermediate book of Maliki Fiqh, written by the great

Maliki Mujtahid, Imam Ibn Abi Zaid al-Qayrawani, who was known
as “Malik as-Saghir”. He lived in Egypt during the era of the
extremist Shi’i Fatimids.

A Unique point about this fiqh book is that it’s first chapter is on
Sunni Aqidah. This was due to the fact that at the time Egypt was
under the administration of the extremist Fatimid Shi’i. Also, Imam
Ibn Abi Zaid wrote this book at the request of his friend who needed
a basic book to teach his children.
Unfortunately, what was taught to children, most adults in our age
are ignorant of today.

Shafi’i

Matn al-Ghaya li Ibn Abi Shuja’

A basic book of Shafi’i fiqh covering Ibadat as well as mu’amalat.

Umdat as-Salik – Reliance of the Travellor

A Basic book of Shafi’I Fiqh covering Ibadat aswell as mu’amalat. Lots
of extra material in the appendix.
Very competent translation and valuable appendix material by Nuh
Kellor.

Minhaj at-Talibin

A very respected and major book of the later Shafi’i Madhhab.

Written by the great Imam an-Nawawi.

The English translation was done from a French translation of the

original Arabic Text.
Although, done by kafir orientalists, the section on taharah is quite
good and accurate.
I would only suggest this as supplementary reading for the teachers.

Hanbali

Very little of the Hanbali fiqh has been translated into English.
However I have included some PDF files that are rough translations
of a basic Hanbali fiqh book.

Two comparative fiqh books, which include Hanbali fiqh, are listed
below.

Comparative Fiqh.

The Mercy in the Difference of the Four Sunni Schools of

Islamic Law
by Qadi Muhammad Ibn Abdur-Rahman as-Safadi (d.784 H)

This is a very good first book, which gives the fiqh of the four
Imams.

I’ve noticed that the author concentrates on what the Four Imams
say themselves rather than what may be adopted by the Madhhabs.
Due, to this, you have to realise that this book is at a disadvantage
because on some issues other Imams may have come to a different
conclusion and the later scholars fiqh may be preferred as the
stronger position.

However, it is still an excellent introductory book to the fiqh of the

Four Imams.

Bidayat al-Mujtahid wa Nihayat al-Muqtasid

Translated as The Distinguished Jurist’s Primer (2 vols)

An advanced text, focusing on the reasons for ikhtilaf within the

Sunni Madhhabs.
This is very good for analysing ikhtilaf, however, it is not going to
have information on where the Mujtahideen agree. And for this reason
it would be impossible to learn basic fiqh.

This book is ideally suited for Teachers with a good grasp of fiqh and
Usul al-Fiqh.

The whole of this book is available in English translation. It was

competently translated by Professor Imran Ahsan Khan Nyazee.

Financial Transactions in Islamic Jurisprudence (2 vols)

An English translation of Shaykh Wahba Zuhayli’s Fiqh al-Islami wa
Adillatuhu

This massive two volumes concentrates on Islamic contract law from

all Four Madhhabs.

This is better than Ibn Rushd’s book because Shaykh Zuhayli

mentions points of agreement as well as disagreement.
Hisbah
(amr bil maruf wa nahi anil munkar)
Enjoining the Good and forbidding Evil
Since we are based on the Ayah 3:104 it is essential for us ALL to
understand this duty and its comprehensive nature.

The following books will give you an understanding of the classical

scholars and some contemporary scholars.

Public Duties in Islam

This is a translation of Ibn Taymiyya’s book al-Risalah fil-Hisba.

Maruf and Munkar

By Shaykh Jalal Uddin Umri

He is a contemporary Indian scholar. This is an excellent book on

amr bil maruf. If is full of classical opinions. He rarely gives his
opinion, but rather, the Shaykh (may Allah reward him) gives the
opinions of the Mujtahidin instead.

The Thoery and Practice of Market Law in Medieval Islam

A Study of Kitab Nisab al-Ihtisab

By Dr. M Izzi Dien.

This book includes translation from the book Nisab al-Ihtisab by

Imam Umar as-Sunami (d. around 727 Hijri)

The Book of the Islamic Market Inspector - Nihayat al-Rutbah

fi talab al-Hisbah

By Imam Abdur-Rahman ibn Nasr al-Shayzari, A shafi’i mujtahid

who died 589 Hijri.
Trans. By Dr. Ronald Paul Buckley

This includes a summarised translation of Imam Ghazali’s Kitab al-

Amr bil maruf wa nahi anil Munkar.

This is essential reading for the Teacher and the Student. Insha-Allah,
this will be a great eye-opener to show how Sufi’s used to be greatly
concerned with Amr bil Maruf and played an important political part
in Islamic society.

Suffiency for the Seeker of Truth – Gunya at-Talib

By Shaykh Abdul-Qadir al-Jilani (d. 5 Hijri)

This is the Shaykh by which the Qadiri Tariqa gets its name. Shaykh
Abdu-Qadir (Rah.) was Hanbali in fiqh. This book has an excellent
chapter on Amr bil Maruf. His chapter is nearly identical to Imam
Ghazali’s book.
Again, this will show us what the Qadiri Sufi’s of today should be
doing.
Khilāfah
al-Ahkam as-Sultaniyyah w’al-Wilayat al-Dinniyah

By Imam al-Mawardi

Imam Mawardi was a great shafi’i Mujtahid and he was also the Qādi
al-Qudat (Head Judge) of the Abbasid Khilafah.

This book is one of the main reference books for the subject of
Khilafah.
There are two English translations:
1) Dr. Asadullah Yate – A convert to Islam and follower of the
Murabitun Movement. His translation is easy to read and
published by Ta-Ha.
2) Prof. Wafaa H. Wahba – His translation is more academic
and he uses a higher level of English. I prefer this one.

As-Siyasah ash-Shariyyah fi Islah ar-Rai w’ar-Raiyyah

By Imam Ibn Taymiyyah

Shaykh al-Islam Ibn Taymiyyah was a great Hanbali Mujtahid.

Translated into English by Dr. Umar Farruq

Widely available in most bookshops.

The Just Prince (Sulwan al-Muta’ fi ‘Udwan al-Atba’)

By Shaykh Muhammad ibn Zafar al-Siqilli al-Maliki (d. 1170-72 CE)

Shaykh Ibn Zafar was born in Sicily (!!!) and died in Syria around
1170-72. Imam Dhahabi says he was “a brilliant thinker” and Imam
Khallikan says he was “an accomplished scholar”.

Muslim Conduct of State

An English translation of Suluk al-Muluk by Imam Abul Khair Fadl-
ullah bin Ruzbihan al-Isfahani (d. 927 Hijri/1521)

Translated by Muhammad Aslam.

This book of the Khilafah presents a Shafi’i and Hanafi point of view
of the Khalifah’s duties and responsibilities. This was due to the fact
that these two madhhabs were the dominant madhhabs in Central-
Asia at his time. He wrote it at the request of the local ruler, who
made an oath to Allah, that he would rule by the Shariah if Allah
granted him victory. Imam al-Isfahani completed the book in the year
920 Hijri in the city of Bukhara.

Qādi Abu Yusuf is one of Imam Abu Hanifah’s main Students. He,
may Allah be pleased with him, wrote this book at the request of the
Khalifah Harun ar-Rashid.

State in Islam

By Dr. Yusuf al-Qardawi

This books is more focused towards how to gain Islamic government
in today’s age. He espouses the gradualist method. Obviously this is
not for reference to adopt, but we need to know these people’s
arguments from their own scholar’s writings.

Who needs an Islamic State?

by Shaykh Iyad Hilal

Shaykh Iyad has a BA degree in Islamic Studies and a Masters degree

This is a very basic and easy book to start with. Also it has the
advantage of being from the Hizb’s adoption.

Usul al-Fiqh al-Islami

Dr Taha Jabir al-Awani

I know the name might be shocking, but this is a very good

introductory book on usul and its early history. Al-Hamdu-lillah it
does not have any strange views.

Development of Usul al-Fiqh – An Earely Historical

Perspective

By Dr. Muhammah Yusuf Faruqi

Excellent book on the early development of Usul in the time of the

by Shaykh Muhammad Abu Zahra (rah)

This is an English translation of Shaykh Abu Zahra’s works on the

four Imams. The section on Imam Malik is shorter than the Arabic
Text. Which is strange because Aisha Bewley translated it and she is a
Maliki from the Murabitun Movement.

Principles of Islamic Jurisprudence

By Mohammad Hashim Kamali

A classic usul book in English.

Actually this book is “lifted” from a contemporary Shaykh’s book in

Arabic. The Arabic book al-Wajiz fi Usul al-Fiqh is by Shaykh Abdul-
Karim Zaydan.
A friend, whilst studying in al-Azhar, was reading Shaykh Zaydan’s
book and found himself thinking his read this book before. He then
dug out some books on usul and realised that Kamali’s book is
following Shaykh Zaydan’s book in form and content. Oh well …

Islamic Jurisprudence

By Imran Ahsan Khan Nyazee

An excellent book on Usul. I would say that overall it beats Kamali’s

book.
However, teachers should get both books.

Theories of Islamic Law

By Imran Ahsan Khan Nyazee

This is excellent account on the development of Maqasid Shariah in

the Shafi’i Usul.
Prof. Nyazee concentrates on Maqasid as developed by Imam Juwaini
and Imam Ghazali.

The great Maliki Mujtahid, Imam Shatibi, develops his notion of

Maqasid from these Mujtahids.

Islamic Legal Philosophy

By Dr. Muhammad Khalid Masud

This book is a study on Imam Shatibi’s life and Juristic ideas. This is
a very good introductory book to understand Imam Shatibi’s
opinions.

Language and the Interpretation of Islamic Law

By Dr. Sukrija Husejn Ramic

An excellent book on dalalat al-Alfaz (textual indications) from the

Hanafi and Shafi’i Madhhabs.

A History of Islamic Legal Theories

By Dr. Wael B. Hallaq

A very good text on sunni Usul al-Fiqh.

Dr. Hallaq’s PHd was on the gate of ijtihad, and he completely

refutes the Orientalists take on the gate of Ijtihad and decline of
Islamic Law.

Dr. Hallaq is of Palestinian origin, but possibly Christian. He is

regarded as the foremost expert on Usul al-Fiqh in Western Academic
institutions. And, honestly, nobody has come close to what he’s done
in researching Usul and Shariah in Western universities.

Advanced Books on Usul

Islamic Jurisprudence vol 1
By Prof. Ahmad Hasan (rah)

A very detailed book on Usul. Prof. Ahmad Hasan intended to write a

four volume book, but he passed away before completing it, may
Allah have mercy upon him. This book presents material from the
advanced books of Usul al-Fiqh, hence it is an excellent reference
book for the views of the Classical Usuli scholars.

Ijma’
By Prof. Ahmad Hasan (rah)

A detailed study of the different types of Ijma’ in Usul al-Fiqh.

Semi-hard to find in shops.

Analogical Reasoning in Islamic Jurisprudence.

By Prof. Ahmad Hasan (rah)

A detailed study of Qiyas. This is a very detailed work. The author

(may Allah reward him) consults all of the major advanced books of
Usul al-Fiqh in Arabic.

Hard to find in shops.

Treatise on the Maqasaid ash-Shari’ah

Shaykh Taha Ibn Ashur (Rah.)

Shaykh Ibn Ashur contributions to the development of the Maqasid

Shari’ah.
This book is being heavily read and MIS-qouted by modernist
scholars and thinkers.

Al-Hamdu-lillah it’s been translated into English, however, there are

accusations that the translator has taken liberties in translating certain
sections and putting words into Shaykh Ibn Ashur’s mouth. Due to
this caution is needed in quoting this translation.

The Mejelle

Compiled during the last decades of the Uthmani Khilafah.

This book is a collection of qawaid fiqhiyyah (Islamic legal maxims)

collected from mainly Hanafi sources.

It’s a good source for knowledge of qawaid fiqhiyyah and also an

insight into how the scholars of the Uthmani Khilafah re-acted to
calls for reform and changes in the 19th century.

This book was written by Imam Ghazali in Persian. It is based

around his major work Ihya’ Ulum al-Din.

There are two translations of this book. One is a complete translation

from Urdu to English. This is a poorer quality translation and the
print is of poor quality as well. The second is from the US, it is
translated by Muhammad Nur Abdus-Salam. It is a better translation
and print, but is quite expensive and it is incomplete. Each Small
chapter is translated as a small booklet.

There is a reason why you will not find much writings on al-Qada’
wal-Qadar in the same manner as the Hizb.

Historically, the scholars of Islam discussed two questions:

1) who creates man’s actions
2) Why and where is man responsible for his actions

The Hizb says that there is no need to ask the first question, because
it makes no difference to the issue of accountability for his actions.
Rather we should ask the question where is man responsible for his
actions. i.e. a slight modification on the second question.

It’s because of this different outlook that you will find scholars
talking about this question in different ways and raising different
issues.

The Economic Approach to Human Behaviour

Gary S. Becker

Becker got awarded the Nobel prize for economics for this ground-
breaking research. He basically rejects the sociological/psychologist
approach to human behaviour.
He insists that mankind are “rational” and thus their behaviour can
be explained by an Economic approach.
His thesis holds some water because people today are capitalists in
their criteria’s and convictions.
He got the “spark” for this research because he was once running
late for a conference. When he got there he couldn’t find a place to
park, so he thought about the chances of getting caught and the
chances of getting convicted as well, he then decided that because
this was very small he would park his car illegally and go to the
conference.
He then speculated that all criminals go through some sort of
“rational” assessment before committing crimes.
And the rest, as they say, is history.

Also, vitally important is the actual practice of their kufr

ideas.

Islamic Science and the Making of the European Renaissance

by George Saliba
Synopsis
This title talks about the rise and fall of the Islamic scientific tradition, and
the relationship of Islamic science to European science during the
Renaissance. The Islamic scientific tradition has been described many times
in accounts of Islamic civilization and general histories of science, with
most authors tracing its beginnings to the appropriation of ideas from other
ancient civilizations - the Greeks in particular. In this thought-provoking
and original book, George Saliba argues that, contrary to the generally
accepted view, the foundations of Islamic scientific thought were laid well
before Greek sources were formally translated into Arabic in the ninth
century. Drawing on an account by the tenth-century intellectual historian,
Ibn al-Nadim that is ignored by most modern scholars, Saliba suggests that
early translations from mainly Persian and Greek sources outlining
elementary scientific ideas for the use of government departments were the
impetus for the development of the Islamic scientific tradition. He argues
further that there was an organic relationship between the Islamic scientific
thought that developed in the later centuries and the science that came into
being in Europe during the Renaissance. Saliba outlines the conventional
accounts of Islamic science, then discusses their shortcomings and
proposes an alternate narrative. Using astronomy as a template for tracing
the progress of science in Islamic civilization, Saliba demonstrates the
originality of Islamic scientific thought. He details the innovations
(including new mathematical tools) made by the Islamic astronomers from
the thirteenth to sixteenth centuries, and offers evidence that Copernicus
could have known of and drawn on their work. Rather than viewing the rise
and fall of Islamic science from the often-narrated perspectives of politics
and religion, Saliba focuses on the scientific production itself and the
complex social, economic, and intellectual conditions that made it possible.
