The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Stalking - Pattern of Stalking Conduct
Minnesota Statute: 609.749.5(a), with reference to:  609.749.5(a)

Charge Description: engage in a pattern of stalking conduct, to wit: 609.2242 and 609.79, with respect to
a single victim or one or more members of a single household, to wit: K.M.M., D.O.B,. 10/04/1969 which
the actor knows or has reason to know would cause K.M.M., D.O.B,. 10/04/1969 under the circumstances
to feel terrorized or to fear bodily harm and which does cause this reaction on the part of K.M.M., D.O.B,.

STATEMENT OF PROBABLE CAUSE
 
The Complainant states that the following facts establish probable cause:
 
Your Complainant is a licensed Minnesota peace officer with the Woodbury Police Department.
Complainant offers the following statement to establish probable cause: 

On September 17, 2018 Officers were called to a domestic incident at 3312 Hazel Trail, Woodbury,
Washington County, MN. Officer Overbey met with K.M.M. (Victim), D.O.B. 10/04/1969. The suspect, later
identified as James Allen Bergstrom (Defendant), D.O.B. 09/06/1968, had already fled the scene. Victim
stated that she and Defendant had been in an on and off relationship for the past 7 years. Defendant found
something that upset him on Victim's phone. Defendant refused to give the phone back to Victim, when
Victim grabbed the phone back Defendant became enraged. Victim sat down on the couch and Defendant
began punching her. Victim used her arms to defend against the punches as best she could and had
injuries to her forearms consistent with her statement. Victim said she was calling the police and Defendant
left. Victim also showed officers bruises from weeks earlier. Victim stated that she is fearful of Defendant. 

On September 18, 2018 Victim contacted Officer Overbey stating that she was in the Urgency Room at
Valley Creek Plaza; that Defendant had been calling her and following her around all day; and, that
Defendant was currently parked in the Petco parking lot at Valley Creek Plaza. Victim checked her phone
and showed that she had been contacted 11 total times by numbers that she did not know or showed up as
no caller ID. Of the 11 phone calls Victim answered 4 and Defendant was on the other end of the line every
time. The Urgency Room told Victim there would be roughly an hour long wait so she left to make a quick
stop at the bank. When Victim left the Urgency Room she noticed a vehicle speeding toward her and
pulling up behind her, it was Defendant's vehicle and Defendant was the driver. Defendant pulled alongside
Victim's vehicle rolled down his window, and Victim rolled down her window and stated that Defendant
should not be following her. Victim drove away to the bank, went through the drive through, and then left.
Upon leaving the drive through of the bank Defendant's vehicle was in the parking lot. Victim pulled into the
parking lot where Defendant approached her vehicle spoke with her, apologized, and tried to get Victim to
change her story. Victim stated she needed to get to the Urgency Room for treatment and Defendant
stated he was going to follow her there and wait for her to exit after treatment. Victim stated that she was
scared and nervous about Defendant's behavior. 

Ultimately, Officer Overbey responded to the Petco parking lot where Defendant was found observing the
Urgency Room parking lot and front door. Defendant did not provide a statement. Victim stated that
Defendant has a history of stalking his previous girlfriends. Victim also stated that Defendant has a 50 year
order for protection against him stemming from a prior relationship. Victim also stated that Defendant
controls her daily activities; monitors her social media pages; and, has been known to create fake profiles
to stalk people on social media. Victim also stated that she has had to change her residential locks
multiple times to prevent Defendant from entering her home. 

Defendant was convicted of Felony Domestic Abuse; violates 2 or more OFP within 10 years of previous
conviction on 12/17/2007 and sentenced on 02/25/2009 in Washington County Case File No. 82-K3-07-
003949. Defendant was also convicted of Felony Domestic Abuse; violates 2 or more OFP within 10 years
of previous conviction on 07/03/2008 and was sentenced on 02/25/2009 in Washington county Case File
No. 82-CG-CR-08-2906.

STATUTES SECTION 609.49.

FINDING OF PROBABLE CAUSE
From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

SUMMONS
THEREFORE YOU, THE DEFENDANT, ARE SUMMONED to appear on ________ ___, _____ at _____ AM/PM
before the above-named court at 14949 62nd Street N PO Box 3802, Stillwater, MN 55082-3802 to answer this
complaint.

IF YOU FAIL TO APPEAR in response to this SUMMONS, a WARRANT FOR YOUR ARREST shall be issued.

To the Sheriff of the above-named county; or other person authorized to execute this warrant: I order, in the name of the State
of Minnesota, that the Defendant be apprehended and arrested without delay and brought promptly before the court (if in
session), and if not, before a Judge or Judicial Officer of such court without unnecessary delay, and in any event not later than
36 hours after the arrest or as soon as such Judge or Judicial Officer is available to be dealt with according to law.
