Jennifer Morrison:

We have previously communicated via email a number of times regarding this request,
and I have also discussed this matter by telephone on two different occasions with your
authorized agent, and this letter will now serve to summarize the status of that request and
Calloway County’s response to same. Your original request was received by Calloway County
via email on October 2, 2018. At that time you requested the following documents:

1. “All emails sent and received by judgelarry@callowayky.com between the dates January
1, 2018 and March 1, 2018.”
2. “All emails sent and received by judgelarry@callowayky.com between the dates July 15,
2018 and September 15, 2018.”

Though these records were maintained in digital format, I made you aware through prior
communications that there were approximately 2,555 emails responsive to your request and that
providing digital copies of same would take my office substantially longer than providing paper
copies, which I understood, based upon the volume, you did not wish to pay for the paper copies.
In an effort to get you access to the records as soon as possible, I offered to your agent to allow
you to inspect the paper copies at my office beginning on October 25, 2018 (following an
extension I requested from October 19, 2018), and then to make digital copies of the documents
you selected following that inspection, which she accepted on your behalf as a reasonable
alternative to satisfy the original request. I have now fully reviewed the records and you may
inspect the non-exempt responsive documents at my office anytime during regular business
hours (Mon.-Thur. 8:00am-5:00pm, Fri. 8:00am-4:30pm). After you have inspected the
documents, please indicate to me which documents you wish to receive digital copies of, and we
will provide copies of same in that format as soon as we are able to do so.

I have determined that a number of the requested documents are exempt from disclosure.
The following documents or portions thereof have been withheld as exempt, and the reason for
the exemption and description of each are as follows:

III. KRS 61.878(l) - Attorney-client privilege exists pursuant to KRE 503 and is
incorporated into the Open Records Act through KRS 61.878(1)(l). Confidential
communications made for the purpose of rendering professional legal services are
inherently within the scope of the attorney-client privilege. Additionally, legal
opinions can be protected by the privilege, provided they are prepared for clients in
the course of legal representation for the purpose of rendering legal advice and not
shared with third parties. 14-ORD-167. Legal opinions given to county staff by the
county's legal counsel, which otherwise meet these criteria, would therefore be
privileged. The following emails are being withheld as exempt from disclosure based
