The Certificate of Death,11 prepared by Police Senior Inspector and Medico-Legal


Officer, Dr. Ivan Richard Viray (Dr. Viray), showed that Victoriano’s wife died of
"hemorrhagic shock as a result of a stab wound, trunk." Moreover, in his Medico-Legal
Report12 dated August 21, 2002, Dr. Viray had the following findings:

HEAD and NECK:

1) Hematoma, frontal region, measuring 3 x 3 cm, 3 cm right of the anterior


midline.

2) Hematoma, left orbital region, measuring 2 x 2 cm, 3 cm from the anterior


midline.

CHEST and ABDOMEN:

1) Stab wound, penetrating, right shoulder region, measuring 2 x .5 cm, 2 cm


right of the posterior midline, about 12 cm deep, directed lateralwards and
slightly downwards, piercing the underlying tissues and muscle, lacerating the
upper lobe of the right lungs.

> There are about 2000 cc of blood and blood clots at the thoracic cavity.

UPPER and LOWER EXTREMITIES:

1) Hematoma, distal 3rd of the left forearm, measuring 7 x 4 cm, bisected by its
posterior midline, with superimposed abrasion, measuring 1.5 x 7 cm, along its
anterior midline.

2) G.R. No. 199713

Dr. Romeo T. Salen (Dr. Salen),6 Medico-Legal Officer of the Western Police District
(WPD), conducted an autopsy of Emmanuel’s body on October 11, 2005, upon the
request of the Homicide Section of the Manila Police District (MPD). Dr. Salen
prepared and signed Medico-Legal Report No. W-2005-572 containing the following
findings:
POSTMORTEM FINDINGS:

Fairly developed, fairly nourished male cadaver in rigor mortis with postmortem
lividity at the dependent portions of the body. Conjunctivae are pale. Lips and
mailbeds are cyanotic.

HEAD AND TRUNK:

1. Gunshot wound, thru and thru, point of entry, occipital region, measuring 0.4
by 0.3 cm, inferiorly, directed anteriorwards, upwards and medialwards,
fracturing the occipital bone, lacerating both cerebral hemispheres of the brain,
making a point of exit at the right supraorbital region, measuring 1 by 0.6 cm, 4
cm. right of the anterior midline.

2. Abrasion, left shoulder, measuring 5 by 4 cm, 10 cm from the posterior


midline.

The occipital and frontal bones are fractured with massive subdural and
subarachnoidal hemorrhages.

The rest of the visceral organs are markedly pale. Stomach contains small amount of
grayish sticky liquid.

CONCLUSION:

Cause of death is Gunshot Wound, Head.7

3) G.R. No. 133004

Dr. Napoleon dela Peña,6 the medico-legal officer who conducted the post-mortem
examination of the victim, testified on his findings. The Necropsy Report7 stated,
follows:

1. Gunshot wound, entrance 1 cm. circumference, occiput, left trajecting


medially downward with exit 2 cm. circumference maxillary right.

2. Gunshot wound entrance 1 cm. circumference occiput right trajecting


medially downward left with exit 2 cm. circumference maxillary right.

CAUSE OF DEATH:

Shock due to massive hemorrhage secondary to gunshot wounds.

4) G.R. No. 70836

The necropsy report filed by Dr. Gregorio Blanco, the Chief of the Medico- Legal
Division of the PC Crime Laboratory shows the following injuries found on the body of
the deceased, to wit:

HEAD, TRUNK AND EXTREMITIES:

(1) Abrasion, right supra-orbital region, measuring 0.7 by 0.2 cm. 8 cm.
from the anterior midline.

(2) Lacerated wound, right post-auricular region, measuring 2.5 by 0.3 cm.
10 cm. from the posterior midline.

(3) Contusion, right pre-auricular region, measuring 6 by 5 cm. 13 cm.


from the anterior midline.

(4) Contusion, right supra-scapular region, measuring 6 by 6 cm. 13 cm.


from the posterior midline, with a superimposed abrasion, measuring 3 by
3 cm.
(5) Abrasion, right infrascapular region, measuring 5 by 0.3 cm. 10 cm.
from the posterior midline.

(6) Stab wound, left axillary region, measuring 1.8 by 0.4 cm. 18 cm. from
the anterior midline, 11 cm. deep, directed downwards, posterior wards
and to the right, fracturing the 5th left thoracic rib, along the mid-axillary
line, lacerating both lobes of the left lung.

(7) Abrasion, dorsum of the left hand, measuring O.6 by O.5 cm. 2 cm.
lateral to its posterior midline.

(8) Abrasion, left knee, measuring 0.7 by 0.5 cm. 1.5. cm. lateral to its
posterior midline.

REMARKS:

Cause of death is cardio-respiratory arrest due to shock and hemorrhage


secondary to injuries of the head and stab wound of the trunk.

5) G.R. No. 173824

Dr. Mensalvas, testified that the victim sustained four injuries, three of which were on
the left side of the head and one on the right side. The medical certificate he issued
states that the victim was confined for the following injuries:

1. ACCI; CEREBRAL CONTUSSION

2. EPIDURAL HEMATOMA, LEFT FRONTOPARIETAL AREA

3. SUTURED SCALP LACERATION, RIGHT TEMPOROPARIETAL AREA

4. SCALP CONTUSSION, LEFT FRONTOTEMPORO PARIETAL AREA WITH


UNDERLYING LINEAR FRACTURE OF THE SKULL EXTENDING FROM THE
LEFT FRONTAL TO THE LEFT TEMPORAL BONE.[53]
