here at 10:00 for the John Hunt versus Boulder City.

THE COURT: Hunt versus Boulder City.

MR. STUBBS: Uh-huh. I noticed that it w as on the 3 a.m.

calendar on-line how ever, w e received notice to be here at 10.

THE COURT: In w hat form did you receive that notice?

MR. STUBBS: It w as in my folder. We filed --

THE COURT: Well, someone’ s gonna -- my clerk’ s gonna
12
pull up the minutes right now to refresh my memory.

MR. STUBBS: Okay, w ell this is the initial appearance w ith
14
a de novo appeal from the City of Boulder City.

THE COURT: Oh, okay.

MR. STUBBS: It’ s the very initial appearance.

THE COURT: Are you the appellant or respondent?

MR. STUBBS: We are the appellant but I represent the
19
defendant.

THE COURT: Alright. Tell you w hat, w hy don’ t you have

a seat, I’ ll get to you right after this then, thank you.

MR. STUBBS: Thank you.

2 THE COURT: So, the remaining parties, w hy don’ t you
3 come forw ard, identified yourself, tell me w hat your case number is.
4 Anyone find the minutes yet?
5 MR. STUBBS: The case number w as C-18-334314-A.
6 THE COURT: Alright, w hoever’ s found the minutes w ill
7 they please read them? Why don’ t you read the minutes?
8 THE COURT CLERK: Well, there are no minutes, the first
9 hearing is --
10 THE COURT: Oh, okay, there are no minutes.
11 MR. STUBBS: Yes, it’ s an initial appearance, Your Honor.
12 THE COURT: Okay, I get it.
13 MR. STUBBS: Boulder City is one of tw o jurisdictions in all
14 of Nevada that their Municipal Courts are not courts of record. And
15 so --
16 THE COURT: I understand.
17 MR. STUBBS: -- w hen w e do an appeal because there is
18 no reporter or no record w e start all over again as if nothing
19 happened before. And so I did file a pretrial motion yesterday.
20 THE COURT: Oh, I didn’ t see that.
21 MR. STUBBS: So, ordinarily w ith these de novo review s,
22 this is for us to set the calendar of w hat’ s going to be happening --
23 THE COURT: Right.
24 MR. STUBBS: -- moving forw ard. And since I filed the
25 motion yesterday usually w hat happens is there’ s a briefing schedule

2 THE COURT: Why don’ t I go ahead and set a briefing
3 schedule then and you can let the other side know ?
4 MR. STUBBS: Sure.
5 THE COURT: Alright, so thirty days for the, I guess,
6 petitioner’ s brief, you w ant thirty days --
7 MR. STUBBS: We’ ve already filed ours, Your Honor.
8 THE COURT: Oh, yeah, alright.
9 MR. STUBBS: Yeah, and it’ s the -- for appellant’ s motion
10 to dismiss --
11 THE COURT: I just don’ t have any paperw ork on this.
12 MR. STUBBS: Totally get it.
13 THE COURT: I don’ t even know if this is an eviction
14 matter or a misdemeanor appeal or some other civil or a de novo
15 request from Justice Court. Why don’ t you tell me w hat this case
16 is?
17 MR. STUBBS: It’ s a misdemeanor case, Your Honor.
18 THE COURT: Alright, misdemeanor appeal.
19 MR. STUBBS: There are four counts, it’ s a misdemeanor
20 case, and then I filed, yesterday I filed the motion to dismiss for
21 vindictive prosecution and on First Amendment grounds.
22 THE COURT: Very good.
23 MR. STUBBS: And so w hat needs to be set is the
24 opposition in reply in-hearing.
25 THE COURT: Yep, let’ s go ahead and do that. Thirty days

1 from today for the opposition to the opening brief.
2 MR. STUBBS: It’ s usually tw enty, Your Honor. It’ s
3 usually set thirty days out for hearing.
4 THE COURT: Tell you w hat, since you have a lot of
5 thoughts on how you w ant this done, w hy don’ t you tell me how
6 you w ant it done.
7 MR. STUBBS: Your Honor, may w e do tw enty days for
8 the opposition, five days for the reply and then w e can have hearing
9 in thirty days?
10 THE COURT: Very good, w e’ re gonna do that, it’ s my
11 order.
12 MR. STUBBS: Thank you.
13 THE COURT: Why don’ t you put your client’ s name on the
14 record?
15 MR. STUBBS: John Bridgeford Hunt, Your Honor.
16 THE COURT: Alright, the record w ill reflect that Mr. Hunt
17 is present.
18 MR. STUBBS: It’ s good see you, Judge.
19 THE COURT: It’ s good to see you. How are you doing?
20 MR. STUBBS: I haven’ t seen you in years, actually.
21 THE COURT: It’ s been a long time, hasn’ t it?
22 MR. STUBBS: Yeah, last time w as at Rob Bare’ s election
23 fundraiser w as the last time w e spoke.
24 THE COURT: Wow .
25 MR. STUBBS: That w as before you w ere elected, Your

2 THE COURT: Yeah.
3 MR. STUBBS: And I’ ve never been before Your Honor.
4 THE COURT: Alright, w ell, it’ s good to see you. Maybe
5 I’ ll see more of you. I’ m handling a lot of these misdemeanor
6 appeals now .
7 MR. STUBBS: I’ m sure you certainly w ill.
8 THE COURT: Alright, the Court Clerk w ill go ahead and
9 give you the dates.
10 THE COURT CLERK: Tw enty days is October 10 th, and
11 five days w ould be -- it’ s five business days, right?
12 THE COURT Yes.
13 THE COURT CLERK: Okay, October 17 th.
14 THE COURT: And then the hearing date?
15 THE COURT CLERK: Tw enty days after?
16 THE COURT: We said thirty -- did you w ant thirty days
17 after?
18 MR. STUBBS: Yes, thirty days is fine.
19 THE COURT: Thirty days after.
20 MR. STUBBS: No, no, thirty days from today.
21 THE COURT: Thirt y days from today. That’ s good too.
22 THE COURT CLERK: That’ s October 17 th -- or w ait, no.
23 MR. STUBBS: Um, have to be after that, the next w eek.
24 THE COURT CLERK: The next w eek w ould be October

2 THE COURT: And usually I step out for these scheduling
3 transcript issues so usually this is something I w ould just let my law
4 clerk handle but you guys w ere here so w e took care of it.
5 MR. STUBBS: And I did submit a courtesy copy of the
6 motion to the Court yesterday.
7 THE COURT: Perfect, I’ ll look at it right aw ay.
8 MR. STUBBS: Thank you.
9 THE COURT: Alright, thank you very much.
